Contact your local state attorney general office, or your states labor department. They can answer some of your questions. but your job should have some sort of job protection or Family Medical Leave, or short term disability. You need to learn and read about your companies leave of absence program. And do a search on the internet for the federal program that all companies have to abide by, which is the Family Medical Leave act. Lawyer might be good, but think about the cost. Sams Club, should have some sort of job protection if you get hurt on the job.. if they do fire you because of that then get a lawyer for damages and lost wages, and sign a lawyers contract called a contingency contract. they get paid, if you get paid from a settlement.

If my bank mistakenly deposits $1,000,000 into my account, am I legally allowed to spend it before they realize their mistake?

Once a bank deposited mistakenly 150,000 in my account, I took it all and when bank sent me a notice, I refused to pay. The bank then collected the money from my other bank account which was with same bank. The bank informed me that how mistake was done. It was due to same debit card number on diffrent accounts. I went to a lawyer and sued the bank 1. Mishandling accounts2. Intention to create negetive credit report (before this incident I tried to apply for a loan and bank refused it since I had bad credit score)3. Agnoy caused. 4. Mental harrasment. The case was judged in my favor and bank needed to pay me another 250,000 as damages. Court also ordered bank to pay 150,000 to the person who lost money and damages of 100,000 Soon after this the bank manager was changed and bank forced closed my accounts giving reason a really bad credit report and as a negetive customer. I again filed a case against them since no bank can deny your account on basis of credit report. Since now this time it was in media, bank settled the case outside the court giving me 500,000 and 250,000 to my lawyer. Later after a year I applied for a loan under certain special conditions and bank approved it without going for in depth investigation. I was unable to pay installment on time so they sent a recovery agent to me who tried to force money illegally, since I have CCTV installed, I had all proofs that it was bank's agent trying to harras me. I sent it all to my same lawyer again and before any case could be filed, a settlement was made in which bank closed my loan and offered me a million dollar as damages. I again applied for loan bank approved it and even I don't pay my installments on time bank never calls me or sends a reminder. You see you need to have presence of mind and a good lawyer.

How do I write up a complaint about a co-worker?

You are being used as a set up in my opinion. Anything you say in print that accuses anyone else, even if it is true and a good attorney gets a copy, you are in for a lawsuit. If this person looses their job, pay or has any setback, you can be liable as well as any company. Any co workers you mention as well could potentially sue you at a later date. I would never do that letter, if it is demanded you do this, make the executive secretary draft and type it before you ever sign it as well include the reason you are signing it is because you were told to by the executives of said corporation. I did a similar thing upon being requested what I saw and what I though occurred in a state run workplace and I signed it.There was a hearing without me being notified and I was re assigned to remove me from the situation, which lead to me resigning as that was their plan on any involved to begin with.
Another situation I was transfered into a situation upon doing bookwork I found discrepentcies from the person I replaced and upon investigating I found where she had stolen thousands and I of course reported it. The Division manager came in and told me to give them a total and I did, they checked it all out and agreed and even found more. I was asked to sign a letter to that affect and I refused to. They got her to come to their office and confronted her and of course she knew why. I was told she even admitted that but they agreed to not prosecute her if she agreed to repay it back and she walked out. The next thing I knew the district manager resigned, a new one walked in, 3 others were fired and it was all done in minutes a plan.I was told all things were now fine and just never mention it and that woman walked away clean. I feel if I signed that paper I would have been gone as well. Some things are not seen, or maybe you are not aware of all the facts so be careful. if they will not add their names beside yours, then you do not need to sign yours either.

Help! My co-worker keeps asking for a ride.?

How can I put a stop to it? I don't want to be mean, but I don't want to drive her anymore. It's okay if it's once in a while, but she keeps asking for a ride since it's on the way home. She doesn't even offer money for gas, and even if she did I don't want it. I just want to get off work, and drive home. I had to lie to her sometimes just so I wouldn't have to drive her off. But is there a better way?

Why is Canada bringing skilled immigrants with rosy promises while there is no job here? My family and I have spent all our life savings and all we got are survival jobs despite our MBAs and years of management experience. Can we sue the government?

I being an MBA along with management experience back in India can very well understand what you are going through. This is the most common and natural situation in the begining for all who come here. I have been here since 5 months now and can share what I have learnt.There is lots of difference in the business model of Canada and other Asian countries, lets take India as an example here. In India maximum business contribution comes from small scale retailers(Shopkeepers) and in Canada its the supermarkets(Walmart/Superstore etc). Since there are endless numbers of shops in India, manufacturing/service companies need extra hands to reach them. This is where major number of MBA’s get their jobs in various departments. In Canada since there are lesser points of contact hence companies require lesser people. Ironically the supermarkets require more people over here which you have termed as “Survival Jobs”.In Canada its the skill that is valued rather than a sweet sounding degree or qualification. So its better if one can explore the options and start working on skill enhancement.The government policies and the system here promotes equality of income in jobs to a large extent. One can at the most earn double than the survival jobs in most of the cases. If a person wants to earn more and believes he is capable of doing that after having A+ qualifications and experience then for him its entrepreneurship that might work and not the job. I can bet if one has a promising business model here, then there would be lots of financial institutions to back him up.Sueing the government is not the right thing because the goverment over here does some good works as well. They care for children and senior citizens. Provides good infrastructure, human life is valued etc etc. All in all they invest peoples money on people which many governments fail to do in the right way. I guess this also might be the reason for motivating many immigrants to move here.Lastly, I would say we all are responsible for our actions and instead of blind faith, one should be intelligent enough to do some homework before investing all his money in anything. Furthermore Canada Govt will not hold anyone back if somebody didn’t got what he expected. Anyways, life is a journey with ups and downs which one should enjoy and overcome respectively.Got a bit lengthy though!!

My employer has released my paycheck to a former roommate of mine without my consent or knowledge. can i sue?

Details:
Due to personal conflicts I recently moved out of my roommate's house and relocated to a different state hundreds of miles away. Moving in short notice I had no choice but to simply quit my job. My former roommate and I worked at the same restaurant chain. I completely moved on the Wed 22 of Demcember. Since having worked half of my pay period my paycheck from my employer was due to be out on the Fri 28th of December. I was hundreds of miles away so to collect my paycheck I was considering to consent the release of my paycheck to my brother who still lived near my work over the phone. However, I receive a phone call on Wed January 3rd from my former roommate's mother demanding that I pay her son back the money I owe.
And that my paycheck from my employer is now in their possession and she went to the bank to try to deposit it to her bank account. But she failed to do so.
Today is Thursday, January 6th, 2011. I have not received my paycheck yet.
My employer released my paycheck to my former roommate without my consent or knowledge.
My former roommate possessed my paycheck from my employer without my consent or knowledge.
Can i take legal actions against both parties?

Sexual misconduct in work place with boss and coworker?

I work in a small office of 3 women and one man the boss/owner.
I have worked there for 3yrs 6mon. All of this started soon after I started work. At that time there were just myself and the other woman that the misconduct is taking place with. I on several occasions walked in on the sexual misconduct (both are married but not to each other) I spoke with Ann and told her this was very upsetting to me and that I should not have to walk into my work place an witness this type of behavior. I told her what she did was her business so don’t make it mine. Well I continued to walk in on them until I had enough. I confronted both of them and let them know how upset I was.
I felt very disrespected. This was my work place not their love shack....
Well they have become more discrete about it but I know it is still going on. I am very disturbed by this. I feel like she gets away with anything because she is doing the boss. I have become very adjatated over this.( since Jan 1 she has missed 14 days of work plus took a week vacation)
The tension in the office is VERY high more that likely because of me I cant stand her flaunting around.
He bad mouths her to me when she is not there and then when she returns all is Sweet. Yesterday I called in sick and also today , I have only called in one other time this year. I get a phone call from my boss who Is very Irate. Telling me all this S*** is going to stop he is sick of having 3 staff members and only one of them showing up.(that one staff member has been me 99% of the time.) I proceeded to remind him of this but he proceeded to tell me that If things don’t get worked out he is going to cut us both to part time. And that he is not going to fire us because he is not going to pay unemployment. Part time hell she doesn’t even make it part time but she still gets all the benefits plus extras that I wouldn’t want. But now I am being threatened.. What gives...She misses to and three days at a time. And then comes back to work and he treats her like Now big deal. I think she just screws her way back to the top. I wish I had filed with EEO for hostile work environment but looks like the statue is 45 day from the time of the incident.. I am at my wits end. I don’t want to quit my job, THATS WHAT SHE WANTS AND SHE HAS RAN OFF SEVERAL OTHERS EVEN THE BOSSES DAUGHTER (who also caught them ). I need some good advice...not sure where else to ask about my situation.
