A position of authority or trust would be someone who you have a professional relationship with such as boss at work, a teacher at school, or a counselor. In that case, a sexual relationship with a 17 year old is prohibited.

If there is no position of authority, the relationship is legal as long as both are at least 17 years old. That would include a 17 year old and a 21 year old.

Criminal Sexual Abuse is a class 4 felony for the first offense, with a mandatory minimum sentence of 1 year in prison and a maximum of 3 years in prison. A second (and subsequent) conviction would be a class 2 felony with a mandatory minimum sentence of 3 years in prison and a maximum of 7 years.

Note that it is possible to be convicted even if you didn't actually have sex, and people WILL assume you are having sex if you are dating. It's safer to wait until your friend is 17.

"Just" kissing is legal - but you don't have to go much further for it to class as "Sexual conduct"

"(e) "Sexual conduct" means any intentional or knowing touching or fondling by the victim or the accused, either directly or through clothing, of the sex organs, anus or breast of the victim or the accused, or any part of the body of a child under 13 years of age, or any transfer or transmission of semen by the accused upon any part of the clothed or unclothed body of the victim, for the purpose of sexual gratification or arousal of the victim or the accused."

So if you're under 17 and kissing someone, and he puts his hand on your breast - even outside your clothes - it's criminal.

You are confusing the Age of Majority (when you are legally an adult) with the age of consent (the age at which you can be universally held to an adult standard in a set number of situations).

The Age of Majority in Illinois is 18.


The exception is an emancipated minor, which can occur at any age, but is more likely 16 or 17. A court would have to issue an emancipation order for it to be valid.

Be careful, btw...you are not above the age of consent in Illinois. If you live together, it might just be a crime.

you can get parental consent. but the parent needs to be there with you.

When I was 16 I got parental consent and got the letter notarized because my parents worked a lot and it didn't work.

You wont get in trouble for having an under-aged tattoo (if you mean like by the police, that will absolutely never happen) however I seriously recommend NOT getting one until you are 100% certain that it is something you want for the rest of your life. Laser removal is 10x more expensive and 100x more painful. I also recommend getting the tattoo somewhere on your body that is not exposed all the time, you never know what the future holds and that dream job you want my see your visible tattoos as unprofessional. I know these are things you don't really think about when you are 16, but its important. You are a much different person at even 20 than you are at 16.

no where in the law is there a "close in age" clause so, that being said. if you are 17 yes, you can basically have sex with anyone. 17+. the only time a person over the age of 17 would get in trouble -- as the law says, is if the adult is of a position of power.
