Can Child Support Deduct And More Then What The Court Ordered Each Month Even If I

Can they deduct child support from commission check in ohio?

My fiance gets paid in two seperate checks. One is his base, and the other is his commission. His ex wife gets 67% of his base check towards child support which breaks out to be about 800.00 a month. We were wondering if they can take any of his commission check as well, or if that is what he will be allowed to keep to live on.
He is ordered to pay 1200 a month, but that was based on his previous job. He was laid off about a year ago. He now makes half what he was making. He is in arrears, but is slowly paying that back. I also have to mention that his ex wife has very few bills. We have the kids baout 40% of the time, and we have been covering their needs as they arise(coats, new shoes, school expenses, ect). She lives with her parents and has made it glaringly clear that she doesn't have to pay rent. She doesn't work becasue she "wants to be a stay at home mom" becasue her children need that(thay are all in school all day now). My fiance also pays 300.00 a month alimony which was recently reduced. He was paying 750.00 per month until she couldn't afford her van anymore and we took over payments on that for her so that she can transport the kids. And yet, him and I will take 2 seperate cars everywhere when we have his kids and Mine(7) becasue neither of our cars fit all of us.
SO can someone please let me know if they are also going to start taking his commission checks too?

What happens if you do not pay child support and there is a court order to do so?

A judge ordered child support to be paid by my ex. The order was dated June 24th of this year. So far my ex has still not paid a penny of child support (three months after the court order was put in). He is already in arrears (my child is over a year old now). Is he going to get in trouble for not doing as the judge ordered?

I have child support enforcement working on this matter, but I am surprised that he is not in contempt of court by not paying his court ordered child support immediately.

Well here in Ontario I deal with FRO to garish his wages. Now I understand what you mean...these people are so unorganized its not even funny. I was granted support is August of 2007 and waited 7 months for them to send the deduction order to my ex's work and have the papers filed. Then I had to wait an additonal 30 days for my direct deposit to go through.
I still dont get payments every month..I have to call and then they tell me they will call his employer and remind them(the employer has 35 days to send in payment to FRO and then FRO sends in to me)and I laughed the first time the lady on the phone said this to me cause I thought 'this is ridiculous'! You really have to be on these people...I have noticed I dont get anywhere unless I keep calling. Other than that, I just have to wait, which really sucks.

But they were good on enforcement---when Mike did not orginally respond after court FRO took away his license and had a warrant out for him. LOL
I have only received 4 full payments so far--I suppose I am doing better than yourself though...just keep on them and I make sure you got all your papers in and you are showing up to court and he will be the one to face penalty. I wish you luck...I know how frustrating the court system can be.

Why were my child support payments taken out of the third pay period in one month.?

Contact your accounting or HR department, and ask them to double-check the wage garnishment.

IF they are not supposed to deduct more than $255/month, they owe you money. Have them skip a deduction in the next month, or restore your pay in this month. They are probably not legally supposed to deduct more than the court order says.

However, there is a possibility that your court order says something else, so do check.

It may have been a simple oversight in payroll. Codes for garnishment need to be set up to say "take $___ dollars per paycheck UP TO $255 per month" and some payroll clerks miss the "UP TO" part.

go to local district attorney office to file a claim
or go back to court & ask for wage garnishment order & have served on fathers employer & then employer will automatically deduct and send... don't forget to ask for arrearages (back child suport)
ps- FATHER is also responsbile for kids, not just you! And have him pay for health insurance too

Advice on child support issue, father in military haven't received any payments?

The military has nothing to do with any child support issues. They will enforce a court order to pay child support by deducting it from his paycheck, but thats it. And the military requires paternity testing for any children born out of wedlock regardless of if the father is on the birth certificate or not. The same thing applies for the child to be able to be enrolled in DEERS. You are going to have to go to the child support office and file for support. They will paternity test him and then you will have a hearing for the amount he will have to pay you. The judge will also order if he will have to pay back to the date of the birth of the child - which in that case it will make his first few payments higher until he is caught up. He'll bring the order to the finance department and have it taken out of his check.

To your updates:
Even though he signed the Volunatry Acknowledgement of Paternity he still has to have a court ordered paternity test. The child support enforcement will do this for you and it doesnt cost anything. The military has policies in order to ensure the soldiers are doing their part of taking care of their dependents, but only after the soldier is proven to be the father with 99.99% certainity (if the child was born out of wedlock). The only way that can be done is though a paternity test. It's just standard procedure.

As for the medical - As part of the court order he might be forced to enroll your child in TRICARE, but that all depends on if the judge orders him to be the provider of the medical.

Don't get me wrong, I am all for paying child support - but bailie is wrong! The military does require a paternity test and if he isn't the father he doesnt have to pay child support! That's just ridiculous!

I know for 100% sure because I am going through the SAME EXACT SITUATION right now, except my husband is the one in the Army who will be paying the child support! =)
