Can I Sue This Company

Can I sue a company for hair in my food?

In the USA, you can sue for anything.

However, since you saw the hair before you even opened the package you were not harmed other than for the cost of the candy. As the saying goes, "no harm, no foul."

Take it back to where you bought it, show them the hair and demand your money back.

Can we sue companies in India?

Yes absolutely. The very purpose why people incorporate a company is to able to sue and be sued under a name of legal entity. The reason is that company is a vast multitude of persons you can't go on to sue everyone individually. So, this name or the company who embodies a fictional personality of legal person is there to be identified by law as one person ( legal person ) for purpose of suing. For example, if you buy a car from Tata Motors, you can't go on to sue Guenter Buschteck. Because Tata Motors is a different person from its chairman Guenter Buschteck. Or you can't go on to sue the particular plant of Tata Motors which manufactured the car , or the worker who has fitted the nut bolts of the car, or the engineer who designed the car, or the authorised dealer. If you go on doing that, you will keep on searching the defaulter for your whole lifetime. . Therefore, to ease this difficulty law has provided that you just file a suit in the name of the company which has been incorporated as per the companies act. Now, it will be their responsibility to find the defaulter , whether it's the authorised dealer, or the engineer or the worker. Tata Motors will take internal action against the deafulter. It's their internal matter. First their duty will be to make up your loss in case you prove your claim against the company. Thanks for requesting answer. I hope it was helpful! Thanks for reading! :)EDIT :- However, there are times when the Courts often pierce/removes/uplifts the Corporate Veil. So, the officials of the Company enjoy immunity as long as they are playing it very fair and legal. Take the example of Subrato Roy Sahara who has been languishing in jail for last 2 years, because of a fraud committed against investors. In this Supreme Court of India has pierced the corporate veil to coerce the Sahara Chief to pay back the money of investors.Similar example is that of Satyam Scam where RamaLingam Raju was roped in for the auditing scam.Hence , in every case where there is fraud committed by the company, the Court may pierce the Corporate Veil to punish the people responsible for it.Although your position is the same, you will still initiate the case by filing a suit in the name of the company, thereafter , it is up-to the court that , it exercises its discretion to remove the corporate veil or not.

Can i sue a condom company if the condom breaks?

No. Condoms break all the time, and it's because of 3 main reasons, which are all fault of the buyer, not the manufacturer:

1. Wrong size
2. The condom was reused (the instructions say to never use one condom more than once)
3. The condom was used too long; like during continuous, rough sex. In other words, it's the operator's problem, not the company who made it.

Nice try, though.
