I want to get custody of my niece how do i do it? Heres her story. She is 4 years old I have lived with her from 3 months to 2 1/2 years of age. when i move out her mom and dad split up. her mom started dating a loser and her dad started doing pills. after a while her mother began doing pills. i would have her at least 4 days a week while working 50 hours and they would split the rest. her mother has recently split from that guy and has had a couple more in and out now she has started seeing a guy that does meth and thinks he can tell my niece what to do or tell her mother how to parent. i am not okay with her being around this. i have her all the time and i dont get any food or financial help from her mother and she gets to take her whenever she wants. i hate that i have no say in her life and her mom sees her as a pay check and not a beautiful loving child. she has been potty trained since she was 2 and now she is having accidents all the time. day and night. she grinds her teeth at night and is always crying in her sleep. she tells me mommy always spanks her and puts her in her room and my mom told me she heard my sister call my niece a bit@# and a dummie. im sick of it im sick of doing all i can for her and not having a say on who shes around and how she grows up. please let me know if you know how i can get custody

You need to call Child Protective Services and have her investigated. However be ready for a battle. If they deem her unfit, the children will be removed from the home and she will be given a case plan to work. She has a year to get her act together. Now since she is in your parents home the children will be removed from there. You need to state that you want them and you need to be homestudy ready. Basically you have to be a licensed foster parent in order to get custody of the children while your sister works her case plan. They will still have visits with her while she is doing all of this. If after a year she has shown NO improvement and I do mean NO improvement then termination of parental rights can be started by the state. If she shows improvement even a little the children will be returned to her. They call this reunification. Likely she would have to show that she can support them without living with her mom and that she is clean no drugs. It sounds like these kids need an advocate. They don't have a good home life. How can I get Custody Of My Niece and Nephew?
My niece told me about verbal and physical abuse her and my nephew (13) were going through at home with my sister and their step-father. One night my niece (16) called me to come get them and so me and my dad did. We were planning to work things out between family members, but my sister showed up two days later with a deputy sheriff to "get her kids back". After the deputy talked with the kids he decided that they didn't need to go back to my sister's house. In addition, we had pictures and recordings proving abuse. Later the same evening, the deputy called my parents and told them that he had contacted DHS and that we needed to meet with DHS the next morning. We did and DHS spoke with my sister also and she agreed that the kids could stay with us rather than being placed in a foster home. Now it is almost four months later and we are trying to get custody of them. They do not want to go back to live with their Mother. We had a custody transfer paper drawn up by a lawyer, but my sister refuses to sign it. She says if it is worded that we get "shared" custody then she would consider it. We are trying to keep from going to court, but at this point I don't know what else we can do. Their mother and step-father were told by DHS they needed to get anger management counseling neither have attended yet. She has only come out to see them once since they have been living with me. DHS said she could visit them at my parent's house without the step-father. She doesn't call either. I think she is only wanting to keep custody to be sure the child support keeps coming to her. It isn't about the child support to me or my parents. We are wanting to be able to make medical, school, and any major decisions concerning them in their Mother's absence. Do you think I should take her to court? I don't want to lose my niece and nephew to foster care. They are happy now and I don't want to upset them anymore. What can I do?

It seems like neglect or laziness on your sister's part but I doubt you can gain custody without other proof of neglect/endangerment/abuse. You could call CPS and report her but the first step they take would be to investigate and get a social worker involved. They wouldn't immediately remove the child from the home because of lice. (Though lice can make a child miserable!) its a good thing this child had you looking out for her. Good luck!

Mysister is a pot head that cannot keep a job, with a boyfriend who is 13 years younger who also cannot keep a job she will not allow us to see the children often because we do not want to support us. the kids love me, the only thing is I am 20 years old. working as a nanny (off the books) i have my own two bedroom apt. though. and I have had this apt for 3-4 years. it is mine. the children are 14, 6. my sister is 34. she has another son he is 3 and we dont know him so her boyfriends family can go after him (we've already spoken) and my sister has no clue. she has aggreed and will let me come get them for 2 weeks on monday because they are on vacation. she smokes tooo much weed and the 14 year old is complaining and thinkin about running away. what should i do. am I too young. and my family is here to support me. My grandmother did the same thing with my sister and i. she gained custody of us when we were younger.

I am 23 years old and I want to get custody of my niece. My nieces "Dad" is not in the picture and never was from day 1. He isnt even on her Birth Certificate. My Nieces "Mom"(my "sister)) does not properly raise my niece. Most of the time(85%) my niece ends up with me because my sister doesnt want to deal with her. I fear for my nieces life when she is not with me. I want to get custody of her. I have about $8,000 I can invest in court fees, lawyers, etc. My sister is a broke bum. I would like to know 1. My brother and his ex girlfriend had a baby, my niece Kendra Gipson she was taken from his ex girlfriend and now is in the custody of a another family. My parents lost a custody case b/c my brothers name is not on the birth certificate nor does she have his last name or a DNA test, But he is the father. Currently he is in jail but in the mean time my family and I have not seen Kendra in years, b/c they went from letting her visit two times to blocking our number to changing their phone number completely. I just yesterday went over to visit my niece at their home granted I could not call to see if was okay but I was determined to try any ways. I went to the door as she barely opened it, introduced myself as Tamika, Kendra's aunt and I was wandering if it would it be okay to see her for a minute.Then their daughter closed the door and stated hold on.she came back and told me to leave. My Niece and Nephew Ages 5 & 3, were taken from my brother and his girl friend 2 weeks ago. They went to their maternal grandmother, but she can't or wont keep them. They can't go to my mother due to her boyfriend's past drug abuse/domestic violence. My husband and I called the case worker and said we would like to have them. Originally she told me that someone from our CPS would need to come and check our house and we agreed to all of the drug testing, and house checking and questions and what not. After a week no one came and we called her back and she then said that we couldn't have them. First it was because of my age (22), then it was because we're out of state ( they're in NY and we're in PA) Shortly after we talked to her she started pushing for them to go into foster care. She has continually come up with more reasons why so and so cannot have the kids. The kids mother's cusin offered to take them and they said whoever takes them has to be in NY state. So my SIL offered to take them and then the caseworker said it has to be Broome County. My brother's girlfriends oler kids father offered to take them and then she said it had to be a blood relative. Time is running out, they're going to be put into foster care unless we figure out what to do. The caseworker is against everything we've tried to do so far and has also said if we petition for custody she'll fight us. We love my neice and nephew, they're very familiar with us (niece stays here so much she has her own bed. We have enough room, Neither of us have a criminal history or do any drugs. We have 2 kids of our own that are very well taken care of. I've offered to give her statements from their schools and doctors, we offered to do anything we had to, even if it meant driving them up to NY every week so they could continue their safety plan. Can I still file for custody and possibly win? Do I have a chance here at all?
