Those with criminal records, (the Rehabilitation of Offenders Act does not apply to U.S. visa law), certain serious communicable illnesses, those who have been refused admission into, or have been deported from, the United States, or have previously overstayed on the VWP are not eligible to travel visa free under the Visa Waiver Program.

However, they will be questioned by an immigration official at the U. S. port of entry regarding the refusal by the Embassy or Consulate.
Therefore, they should ensure that they carry evidence of their intention to depart the United States at the end of the visit. This is generally satisfied by furnishing evidence of strong social and economic ties to the traveler's place of permanent residence. There is no set form that this should take as each person's circumstances differ. If the immigration officer is not satisfied that the traveler meets the qualifications for non-immigrant status, the traveler will be denied entry.

Just try to apply for the online electronic travel authorization (ESTA) to travel under the Visa Waiver Program. It will just cost you $4.00 processing fee if your electronic travel authorization is denied.

If a passports stamped with refusal to INA Section 217 will the immigrant be able to come back on another VWP?

My boyfriend is from Ireland and was in the US for 6 months on a j-1 visa and then 3 months on a VWP tourist visa and went back to Ireland right at the end of the 3 month visa so he wouldn't be penalized for overstaying in the United States. He was in Ireland 5 days before trying to come back to the US (he had a roundtrip ticket back to Ireland as he was attempting for another 3 month VWP tourist visa) and was denied entry at customs at the airport. The customs officer stamped his passport with a stamp that dealt with refusal according to INA Section 217. Will he ever be able to come back to the US on another VWP 3 month visa or will he always need an actual visa directly from the embassy? If so, if he has the proper sponsorship from his family what are do you think his chances would be to obtain a 6 month tourist visa?

no, not really. a tourist visa can't be converted to a K3 nonimmigrant visa or a CR1/IR1 immigrant visa. a person in the US can apply to adjust status based on their marriage to an American citizen, once an I-130 immigrant petition is filed and an I-485 adjustment of status form is filed. check out www.uscis.gov and look in the form section for the instruction sheet for the I-485. however, the adjustment of status request isn't always approved and a person coming into the US with the intention of doing this could easily be turned around at the airport and sent back.
