Fighting a "driving while suspended" ticket?

They have to prove they mailed. They do not have to prove you received it.
Far too many people think they can let a certified or registered letter go sit at the Post Office, not pick it up, and it counts, but it doesn't. Take it from me, the same rules apply to insurance cancellations. More than one person found out the hard way.
All they have to do is prove the letter was mailed to the last known address, whether it is correct or not, whether you signed for it or not.
All you can do, that has any possibility of working, is fight passively, state you did not realize you were suspended, that you did not see the letter, and APOLOGIZE to the court. It may or may not get the fine and/or the points, mitigated, at the court's discretion. If you fight it actively, you are likely to get fined full bore, full points, plus court costs, and a lecture, just like thousands before you.
Believe me, officers, judges, magistrates, court clerks, bailiffs, they have all heard that thousands of times from people thinking they could fight something by saying "I didn't get the letter."

Remember, this isn't a court summons, or similar document, sent out with a court deputy, who is obligated to make best effort to serve you, it is sent post office, who tries once, and leaves a notice for pick-up at the depot.

Ok, so i'm stuck in traffic during rush hour in Georgia (Gwinnett County). I get a buzz on my iphone in my pocket. I take it out to look at it and I have 1 unread email showing on the front of the screen. I then lock my phone and place it back in my pocket.
All of a sudden, a police vehicle pulls up behinds me and slaps me with a texting while driving ticket (code: 40-6-241-2). I hand him my phone and to show him that i was checking my "buzz" on my phone and realized it was an email.. Then i just placed the phone back into my pocket. He goes on to say that i was doing "other" stuff on my phone. I stated yes, i needed a 4 digit passcode to unlock my phone.
I was about to show him that i had no running apps, (by double clicking the circle button thingy) on my iphone but he stopped me and said he's got going to debate this with me.
I'm guilty for unlocking my phone and looking at my unread message icon, but i did not send any text, read anytext, nor did i browse any apps, use facebook, etc... Do I have a case? Thanks in advance!

How do you fight a careless driving ticket in michigan?

Today i was running late to meet a guy that was buying my car, so i was driving down the high way, weaving inbetween cars trying to get there faster. One car followed me to the destination with out me knowing. He had called the police and told the officer i was dangerously driving, and almost "clipped him" even though i didnt. The guy was complaining on how i could of en-dangered people. The police officer didnt see anything, just took the guys word. He asked the man if he would like to give me a ticket or something along those words, and the guy said yes. The officer gave me a careless driving ticket, and the man was on his way. I was told i could take it to court to fight it, so i am going to. its my word against his right? no cops saw the incident, so how is there any proof besides what this guy says. The guy said he lived in grand haven, which was about a hour n a half away from the spot it happend at, and then the court place would be in Paw Paw. Which is roughly 3 hours away from where the whitness lives. I have heard that if the witness doesnt show up to court, then the ticket is dropped. Which is what im hoping. I am just trying to get this ticket dropped because i dont have the money for it, on top of my insurance payment skyrocketing. But im thinking if this douche had the time to follow me to where i was going, im sure he will take the time to go to the court. If i take this to court, what am i supposed to do? Im trying to do anything i can to get out of this b.s. ticket. HELP!!! thanks

Texting while driving ticket help me?

Dear Partygirl:

First, lets get real here. you say it is your dad who caused the shitty situation. I don't see how. After all, you are the one that held the party when your folks were out of town. So you must take the responsibilty for it.

Second, you also were the one who was texting while driving. Well dearest, remember this. Texting while driving is no better than drinking and driving. It is to say the least, extremely dangerous to not only yourself but anyone else around you. Texting while driving is the 2nd leading cause of auto accidents in California, (next to drunk driving). I am in California, and believe me, it is an expensive ticket if you get caught here.

If you have the money, you can pay the ticket, but the points, (or marks), on your driving record will remain. Also, I am not sure how it works in NY, but in CA, you can take a driver school course, (usually 1 day), and by doing so, you can eliminate any probability of your auto insurance rates increasing.

I need to finally ask you. Why are you being so irresponsible? I'm truly sorry to say this, but it seems you are not taking responsibility for your actions, and are ignoring your parents advice as well.

You didn't mention your age, but i suspect you are a teen driver. If so, then you should know this.
When someone wants to be treated like an adult, they should also be acting like one. In your case, you broke the law, and now must pay the price. If in fact this means you also must answer to your father, (should he find out), then so be it. Perhaps another few months of grounding will be handed down. I don't know, but you should expect it.

There is one other thing I would like to mention. You should get on your knees and thank God you didn't kill anyone while you were texting. Maybe you were being careful, maybe not. But someday, if you continue, you may have an accident, and might even kill someone. Perhaps you don't believe me, but when you get older and have children of your own, you will not wish anyone to be distracted while they drive.

2nd ticket, 17 years old in Texas... What can I do?

First of all, let me preface this by saying I am an idiot. I understand what I did was irresponsible and I take full credit for my mistake. This is my second ticket, my first for failing to fully stop at a stop sign while leaving school and my second for speeding on my way home from work. I paid for the first ticket. What are my options for this second ticket? I talked with the municipal court and they said I had to go to court with an adult and either pay the ticket or take an online defensive driving course and then go to the DMV and take a driving test with a state trooper. I only have a 50% chance of passing that test, and if I do not they will suspend my license until I do.

I have a job and school I must go to and I can not afford to loose my license. Our town's judge is not kind. I am ashamed of myself for being so careless and for upsetting my parents so much. I have been unable to sleep or eat for the past week because of the guilt. Please, what can I do?

What law lets 17 year olds move out in Michigan?

Generally speaking, a 17-year-old can leave home in Michigan. The age of majority in Michigan is 18.

You can move out when you are 17. Parents can not report you as a runaway in the state of Michigan if you are 17 years old the police will not force you or take you back home.

Michigan's Runaway and Homeless Youth Act gives police the power to take a minor into custody and remand them to a juvenile facility until a court hearing.

Here is more input:

* The legal age of majority is 18. So, in most circumstances, unless you are emancipated you will not be able to move out at 17.

* The age of majority in Michigan is 18. Anyone under the age of 18 is a minor, and their parents have the right to determine where they live. If you leave home at 17 without parental permission or being emancipated in some manner (marriage, court order, etc), then your parents can report you to the police as runaway.

* Michigan has a similar confusng statute as does Missouri and other states. The legal age of majority is 18, but the Juvenile Code defines an "adult" as being anyone who is the age of seventeen. The "17" designation refers to judicial proceedings only, it indicates when a person of at least that age can be prosecuted as an adult for specified offenses. In addition, the state participates in AMBER ALERT where state law specifies a "child" (not a minor) as being under the age of 17. There is a difference, a minor is someone under the age of 18-years, a child for the application of the state abduction and missing child laws is designated as being under the age of 17-years. The misinterpretation of the laws is what led to the passing of the Michigan Runaway and Homeless Child Act. !!

92 mph speeding ticket 17 years old help!!!!?

Ok what are my chances in court, if i was wrongly pulled over in california? This was at night going down a freeway on the third lane to the right at 60 mph i was heading home. I was going to to merge right to get to the exit 3/4 mile away, when all of a sudden a blue car just shoots past me going ridiculously fast on my right side. After hes gone i continue to merge right and a quarter of a mile later i get pulled over saying i was going 92 mph. So ridiculous i try explaining to him but he doesn't budge. I guess he mistaken me for the car that was in front of me.

The problem is my car is also blueish. The actual color on the car is slate metallic green
In court can i ask the judge to review the dash cam in the car, because i was in the third lane not the fourth until i merged. Would the dash cam be on 24/7?

it says my appearance court is mandatory.

Im afraid of losing my license, i am very careful driver never speeds, and never got a ticket before.
What can i do to defend myself? IS it possible he wont show up in court

Traffic ticket, 4 offences , 17 yrs old ?

Ok I know I'm stupid for doing this but....
A couple weeks ago I got pulled over for running 2 stop signs and speeding (45 MPH in a 25 MPH zone) in los angeles. I also was driving with my best friend while I had a provisional lisense. (I had gotten pulled over twice in one weekend back in may 2010 for not stopping at a stop sign) I also didn't have my lisense physically on me when I got pulled over. When I got the ticket I was 17... What's my punishment going to be? How much will it cost? I'm freaking out my court date is in 2 weeks.
Please help :(

Accident and careless driving ticket in NJ - worth hiring a lawyer?

I was involved in an accident in which I was merging onto a 3 lane highway from a lefthand on-ramp. I had to get over quickly for my exit (NJ infrastructure is ridiculous) and when both I and my husband checked for cars, it was clear. My husband checked again, turning all the way around, and said it was clear. As we were getting over, a car must have come flying up in the fast lane and hit me right in my blind spot on the passenger side. We spun around and ended up on the right hand shoulder. The other driver spoke broken English and came over and started yelling at us so we kind of stayed away from him. No one was seriously hurt in either car. When the cops came, they took our stories and he told me he wasn’t going to give me a ticket.

The next day, I got two tickets in the mail – careless driving and improper/unsafe lane change (since I had to start getting over when the line was still solid white because my exit was close, which yes, I know, is technically illegal). I know each of these are 2 point offenses. I have a scheduled court date at the end of the month. The insurance company has already assessed the damage and repairs will be underway shortly (it’s not totaled) and they told us that based on the look/location of it, it doesn’t seem like it was 100% our fault.

I have called around to a couple lawyers to see what my options are and asked a friend who works as a lawyer for an insurance company as well, but I’m not sure what my best option is. I do plan to go to court – because what’s the worst that could happen? But I’m not sure if it’s worth it to hire a lawyer. It would be anywhere from $350-$500 for them to represent me and I feel like I could probably get the same results they could. Every lawyer I spoke to also mentioned the importance of a civil something-or-other (can’t remember now) that would prevent or at least impede the other drive from suing us later on - can I do this myself? I know if the charges are reduced to a fewer- or no-point offense that I will probably have to pay more in fines. Having a clean record, what should I do?

ANY advice would be helpful.

(P.S. I just moved here from MI and still have a MI license but am planning on switching to NJ in the next couple weeks – is that another issue?)

What changed your opinion regarding guns?

I was raised with shotguns in my house as my father and grandfathers all hunted. I joined the Marines and became trained with the M16 and other guns as well as a shoulder fired missile system. I took an NRA gun safety course when I was around 15 or so. Point being, I was no stranger to guns.I was never and never will be a 2nd Amendment jihadist. However, in early 1992 or so, I drank the Kool Aid and believed the nonsense that Clinton was going to take away guns, blah, blah, blah when he talked about banning assault rifles. So, I ran out and bought a handgun just in case they might become harder to buy in the future.What changed my opinion and made me the rabid gun control advocate that I am today? I moved overseas for most of the 90s and into the 00s and was very fortunate to live in developed countries without a gun problem. It was truly a breath of fresh air to see the local news each day without going into the 2 or 3 deadly shootings that occurred that day nearby. In all my time overseas (around 16 years), I cannot think of a single murder by gun or even a single shooting in all of the cities that I lived in. It was then that I realized that one freedom we Americans sorely lack is the freedom from fear of being shot to death either during a robbery or in a mass shooting. Going about your daily routine without worrying about being shot to death on the street or worrying about your kids being victims in a school shooting or worrying about your wife being shot to death while at church is a very liberating feeling that I highly recommend and would like to enjoy in my country.To be clear, I, in no way, advocate banning guns. However, I would like to see the process of getting any gun to be much more like the process put in place in 1986 for the purchase of a fully automatic weapon by, none other than that GOP messiah, Ronald Reagan himself. In other words, buying a gun should take effort and time and should absolutely include an intense training class on the use of firearms. The USMC required me to receive 75 hours of instruction on the M16 before I was even allowed to hold my first round of ammo. When I was not with my weapon, it was safely secured. I don’t think such requirements are too much to ask when selling someone a weapon that is designed to kill.
