If I have been injured in a car accident, what should I do first?
Personal injury car accidents can leave victims traumatized -- STAY CALM.Everything that happens at the scene and 24 hours after the accident can effect the compensation that you get from your car insurance company when you file a claim.STEP 1.Seek Immediate Medical Attention You should take that ambulance ride if you feel injured in any way even though you don't think you have broken bones and are not bleeding. See a doctor immediately. If you are feeling any of the following symptoms your body may be telling you something -- YOU MAY BE INJURED.PainDiscomfortDizzinessNumbnessSeek immediate medical attention in order to make sure that your injuries do not worsen and by doing so it will strengthen your personal injury claim.Waiting for any period of time will make it harder to prove that your injuries resulted from the car crash. Step 2Take notes at the scene or snap shots with your android. Make sure take snap shots of street corners, names, damage made to both vehicles, traffic light. Take photos of Your Injuries-- this may be valuable when negotiating a settlement with an insurance company or you decide to hire a personal injury attorney, photos will be valuable evidence for your case. Step 3DO NOT ADMIT GUILT!No apologizes -- say nothing, admit nothing. Do not say anything that will jeopardize your claim. Step 4CALL THE POLICEWhy?? You need that police report. Police reports give detailed description of the accident, along with photos. Step 5Understand that this is a process -- settling is not an option, until you have completed all of your medical treatment and your injuries are as healed as they are going to get. Otherwise, you don't know the total cost of your injuries. Don't sign release forms or checks with releases on them before you're ready to settle completely. Signing such forms can release your car insurance company from the responsibility of paying on additional claims.Don't talk to ANYONE about the accident at the scene, or at the hospital.Don't buckle under pressure by the at fault driver to not to file a police report.Step 6Hire a Personal Injury AttorneyCar Accident Lawyer NYC FREE ADVICE New York Personal Injury Attorney NYBrooklyn Car Accident Lawyer26 Court St Brooklyn, NY 11242(718) 233-3913ajlounyinjurylaw.comAttorneyToday 5:00 am – 4:55 am
What is the process of an insurance claim on a single car accident?
When someone has a single car accident and there is no other vehicle or person's property that is damaged, how does a claim proceed, if the owner decides to file a claim? Say a car avoided a deer or object in the road and ends up in a ditch or blows a tire and hits a tree or such and the vehicle is still able to operate. Is a police report mandatory? Does the location have to be exact if this occured in a VERY rural location? What steps would an insurance co. take after being notified? Thanks.

What is the first thing I should do after an accident?
What should you, as a driver, do after a sideswipe car accident?Make sure if possible that both (or all) vehicles are pulled out of the way of obstructing traffic.Make sure that you call 911. If there are any injured parties, tell the emergency operator. Ask them to send police (from whatever is the appropriate district.)Try and identify any witnesses if you can. These may prove essential later on.Talk to the other driver and share your key information. Your driver license #, your vehicle license #, your insurance information (you do have insurance, right?) Do not talk about the accident, give any opinions, place any blame, or anything other than the basic facts.Take pictures if you can do so safely of any damage on both vehicles. Also pictures of the tire tracks and the local environment. (Signage, road, curbs, lighting, time of day, etc.)Go sit down and gather yourself while waiting for police and any medical responders. When police arrive, give them the same information you gave to the other driver and the information that the other driver gave to you. Give as simple as possible a description of what happened. Leave out any opinions and uncorroborated facts. The police will do their own investigation.Do NOT volunteer that you might be to blame. Don’t do anything beyond answering the police direct questions. That’s their job.Call your towing company or your insurance company and arrange for the car to be taken either to your mechanic or other safe location. Have either the towing company or a friend come and get you and take you home.Call your lawyer, and give them the traffic report # and the same information you gave to the police. Now the hard part. Be thankful that no additional injuries have occurred, that you are safe, and that you have done what you could do. Now you have to wait, and that will be the hardest. When you talk to your lawyer, tell them everything, but only the facts. Do not “place” the blame, just the facts, mam.And yes, you do need to set up an initial visit with a defense lawyer.
Auto accident claim help.. Geico?
Here's a suggestion from a very old claims adjuster. If GEICO has accepted 100% liability for the accident process the claim through your own company. Your own company should treat you better than somebody else's company. Going through your own company should be easier. Ask them if they have a "preferred body shop" close to you. That way you take the car to that shop, they write the estimate and send it to your company. Your company will pay you for the damages less your deductible. My guess is that you don't want to pay your deductible and then wait to get reimbursed, which can sometimes take months. I would suggest that you cal GEICO and if they are accepting 100% of the liability ask them to pay your deductible to you "upfront". This way you don't have to wait for the deductible to get reimbursed. GEICO has no legal obligation to do this but I have done it hundreds of times during my career (never worked foir GEICO thouigh) so I know it can be done. Good Luck
I just had my first car accident...?
My first car accident... im 18 & I've been driving since i was 16. i just got my license about two months ago, but since then I've only driven around my neighborhood. i had an interview today at the mall about 20 mins away from my house but i picked up my friends becus we were gonna shop around for a while before my interview. so i was driving on the highway & everything was going smooth. i was focused & i felt confident about driving on the highway. i guess i was wrong becus before i knew it the car in front of me hit their breaks hard for no reason. no other cars was in front of this guy, i think he was on the phone or something becus it just didnt make sense.. i was going 70 mph & slammed into the back of his bumper. me & my best friend in the front had our airbags deflated & the windshield of the car was cracked & the car started to smoke. i quickly got out of the car & told them to hurry & get the hell out. i grabbed my wallet & all of my important papers & got away from the car & went to see the front. the front of the car was wrecked. I immediately started to break down crying. this was the family car .. the only vehicle we had.. & i wrecked it. all i could think about. please tell me how i get through this? i dont ever want to drive again at this point.. i wanna go to school out of state but after this.. i dont think i can. my friend says her chest hurts now & my chest hurts & i cut my neck, its not too bad but it hurts
How should I hire a lawyer after a car accident?
Don’t hire an attorney until you know you need one. Most of the time a claimant can pursue a claim directly against an insurance company without the help of an attorney. You can hire an attorney at any point in the claim process. See how you do on your own first. The adjuster will walk you through the claim process, telling you what you need to do, what documentation to submit, what forms to sign, and the timetable. For example, property damage claims are settled quickly. Injury claims remain open until the claimant has completed treatment and has recovered, as long as it is within the statute of limitations. The vast majority of insurance companies are highly ethical. There are a few bad apples. For them, you may need an attorney. If an insurance company stonewalls you, or if there is a very serious injury or fatality, an attorney may be needed.Having an attorney does not speed settlement of a claim; a claimant can usually get a settlement sooner if he deals directly with an insurance company. Having an attorney does not necessarily result in a bigger settlement. The attorney’s contingency fee (around 33%) and expenses come off the top.If you do hire an attorney, do not get one that advertises on billboards or late night TV. Just sayin’…
