Can I switch car insurance after a car accident in which I was at fault?
Car insurance policies can be switched any time without considering the fact that there was a claim in which you were at fault. Switching of the car insurance policy is allowed through portability which is available under car insurance plans. In an accident where you were at fault, the claim would be made in your existing insurance policy. If it is a third party claim made by another driver on your policy, the claim would be taken to the motor accidents tribunal. The tribunal would dictate the amount of claim payable. The decision of the tribunal takes time. In the meanwhile, if your policy is up for renewal, you can switch to another car insurance policy. However, you would still be liable for the claim incurred in the previous policy. if a lawsuit is filed by an individual hurt in the accident, it would be in your name even if your switch policies. Your old insurance policy would, however, pay for the damages suffered by the third party. If there have been own damages too, your old policy would pay for them too up to the Insured Declared Value applicable under the plan. Any additional costs and deductible would be paid by you for your car’s repairs. Moreover, since a claim is already going on in your existing policy, you would lose the accumulated no claim bonus discount in the premium. So, switching of car insurance plans is allowed on policy renewals even when you have made a claim in your old policy for an accident which was due to your fault.Recommended Reading: know about the used car ownership and insurance transfer
What happens after a car accident with no police report?
The consequences would depend on the severity of the situation.Minor accidents don’t warrant a police report. When the accident does not injure anyone and the damage to property or car isn’t serious, often the driver just files a claim with his/her insurer and everything goes back to normal. If it’s a two-car accident with no injuries, minimal damage, and both drivers are insured, the police don’t usually get involved. For accidents that resulted in severe injuries and damages to property: Hospitalization and medication for injuries, car repair, damages—all that exceeds your deductible would have to be paid out of your pocket if you don’t file a police report. You need a police report if you want to file a lawsuit or plan to get the other party’s insurance to cover your damages.A police report speeds up the processing of a claim, and sometimes, not having one or delaying the report can mean not getting your insurance to cover your damages. Insurers look at a police report to verify that the claim is genuine, meaning that the accident was real, to check who’s at fault, and to validate the damages claim.Generally, reporting to the authorities is one of the first things you should do after an accident. The only exception is for accidents resulting in minor damages. Different states have different laws on filing police reports after an accident and as responsible drivers we should know the policies in our area.
Car accident with no police report but insurance information?
I go into a minor accident a few days ago. My car was not damage but he had a long stretch on the the left side of his car. I told him I was would pay for the damage. He agreed to not get out insurance involved in this but ask for mine just to make sure I could through with the agreement, so I gave it to him. I met up with him yesterday to see all the estimates that he had and saw there were more damage to his car now than there was a few days ago. I told him that I would only pay for the strech to be remove and that's it. He's said no and is asking for 1900 or else he'll go to my insurance. We didn't call the police so there's no police report. Can he report this and would it be a valid claim if there was no police report?
Car Accident, No Insurance?
Sure you can take him to court. But you won't win anything and he may end up with a judgement against you. His not having insurance does not change anything. You still struck his vehicle in the rear. You are still at fault. If I took out a magic wand and *presto* magically made a valid insurance policy appear on his car prior to your hitting him....does the accident still happen? Yep. So his lack of insurance is irrelevant. You can tell your claims department he did not have insurance but that does not change anything. You are still at fault. You are still responsible for his damages. He yelled and you and threatened to sue. Also not illegal. And, if you sue him....his counter suit is guaranteed. His neck will be sore. So, now his threat to sue is an actual law suit. How do you know he "KNEW he didn't have insurance"? Sometimes people make an honest mistake and miss a payment and the policy lapses. He showed the cop the insurance card (which would have the effective dates of the policy and those dates would cover the date of the accident). Get over it. You hit him. He acted horribly at the scene. It happens. His lack of insurance does not change anything. It's over.
Minor Car Accident, No Police Report, what should I do?
I was in a minor car accident about two weeks ago here in Florida. I was pulling out of a Walmart at night onto a busy road. There was a car in front of me. Either the car started to move and stopped or I though it did. I rearended the back bumper of the car. No police were called and no police report was made. The girl driving the car, was the teen daughter of the owner of the car. I never spoke to the driver, however, my husband did see her sitting in the driver's seat. The mother said we did not have to call the police but could exchange information. She said that I probably thought her daughter was moving, but being a new driver she had been hesitant. I gave her my name, number, car tag number and insurance company. She said she could live with the bumper damage, but would contact me. Almost five days later, I heard from her. She said she had an estimate and would send it to me. I texted her my email but did not offer to pay anything. When I got the estimate, it was $775 which I thought was excessive. I have yet to contact her back despite here contacting me. What rights do I have and what should be my next steps?
I was at fault in car accident and other driver’s insurance company is contacting me. I don’t know what to do.?
I was at fault in a car accident a couple weeks ago and admitted fault to the police and to my insurance company and was issued a citation. The other driver’s insurance company reached out to me wanting information on the accident. I read online that talking to the claims adjuster of the other driver’s insurance company is a bad idea. Should I give them a call back? Does anyone have experience with this? I thought admitting fault would avoid me having to speak with anyone else and that my car insurance would be taking care of all this?
Can you make an auto insurance claim without a police report?
I just got into a minor accident a few hours ago. I accidentally bumped into the guy in front of me. I seen the damage to his car and it was just a crack on the rear bumper. No damage has been done to my car besides a bent license plate. Then he claims that I scratched him spoiler too. I said I would pay $500 for the damage but he wanted $2000 from me. I said I don't have that kind of money and he when ahead and called the police. Officers came a few minutes later and assessed the damage but they didn't file a police report. They had us make an agreement and he accepted my $500 offer. Since I didn't have cash on me, I said I need to make a trip to the bank. Both the other car and the officers follow but mid-way the officers stopped following because the bank is in a different police district. When we arrived to the bank, he refused my offer and wanted $2000 to pay for the damage. Then we just exchanged insurance information. I only wrote down the insurance policy number, model of the car, year it was made, his address and whom is insured to (his parents and not him). However since I forgot my cell phone today at home, I could only do so much. He took pictures of my insurance card, driver's license, license plate number, the damage to his car and took down my number saying that we will "talk" it out. Like him the car I was driving is only insured to my parents. I am only 20 years old, this is my first car accident and I have no idea what to do next. I told my parents about the indecent and they said that he cannot file an insurance claim without a police report but I see differ from the answers I fought online. Please help me!
