Can my girlfriends mom get a restraining order against me?

In Maryland, there are two types of so-called Restraining Order. They are called a "Protective Order" and a "Peace Order." The thing is, in order for the mother to file either, you have to have actually DONE something to warrant it and be a genuine danger.

You cannot be targeted by the more serious Protective Order because you would have to be your girlfriend's former or current spouse, father of her child, or living with her. Furthermore, you have to "abused" her in some way, not simply be disliked by her legal guardian. Because she is 16, this is out.

A "Peace Order" is easier to obtain, but again you have to have done one of the following withing the past 30 days to your GF:
* Act that causes serious bodily harm
* Act that places the petitioner in fear of imminent serious bodily harm
* Assault
* Rape or sexual offense
* False imprisonment
* Harassment
* Stalking
* Trespass
* Malicious destruction of property

It would seem to me you have NOT done these things, and therefore the mother has no grounds for a Peace Order. Granted, she could potentially LIE on the form. The judge may see through her lie or she will simply not have any evidence to support it.
Note however that if she does give false information, she will suffer the consequences of filing a false report, which could include her being fined or even being sent to prison for a short period.

Can I get a restraining order on my aunt?

I just want to apologize for any missed spelled words I'm on my phone. Anyway here's the story my aunt has always been crazy and she never gets a story straight and posts EVERYTHING ON THE ENTERNET! But long story short it all started with a pretzel! But here is what I have on her. I have been ignoring her...June 1- the dumb pretzel incident
June 2-constantly texting me and wouldn't stop harassing me posted private business all over the internet spreading lies and even talked about me to my friends they where extremely uncomfortable
June3- "accidentally"got texts about me from her group messages
June13-texted me about making a scene at my baby cousin first birthday on June 14
June14 -tami threatened to hit me "you better stop disrespecting me because I will slap you in the face in front of everyone" she said this because I refused to talk to her
July1- tami started messgeing my friend publicly talking about me spreading more lies
I have photo proof of most of this! Im also 18

Can we get a restraining order against our neighbor?

My son rides his motorcycle on only our property. A new neighbor has built a home perched on the edge of his property overlooking ours. As it happens, his house (which is built at the very edge of his property) overlooks an area which we had a trail that my son rides a motorcycle on. At first my son started to tell us that they would stare at him and try to intimidate him from inside their house and we were hesitant to believe him. Later, he began to tell us that they were even taking pictures of him as he rode on our property. Again, we thought surely he was mistaken. Recently, though, he called home on his cell phone to tell us that the neighbors were standing on the edge of their property, just over our fence and were videotaping him. I went to the fence and sure enough, they were.

Is there any way to get a court order telling her to stop filming my son on our property? He wants to file a restraining order, even, because it is very uncomfortable to be filmed.

What happens if you get a restraining order against you?

I asked stuff about a restraining order in a previous question (my boyfriend, his brother and his brother's wife were served with a temp restraining order and have to go to court to contest it..it's totatlly false, and two of them have rock solid alibis, since they were at work, but my boyfriend was home with me washing the car) so anyway......my boyfriends sister is crazy, and she's trying to "get back" at us (the whole family) because no one will suport her and her kids, we want her to *gasp* get a job! and not be on welfare, and we won't let her husband harrass us. Anyway, now she thinks she can lie to the court and get a restraining order against my boyfriend, even though he's done nothing...and she probably can.
If this happens, what does that mean for him? Will it hurt him at work? Will he have a record? Will he have trouble getting a job or going on field trips with our daughter? It sounds silly, but I'm seriously concerned about this stuff...thanks...

Is it legal for me to throw dog poop onto my neighbor’s property when it's her dog's poop on my property?

How can she cause you any grief for doing so when she allowed (openly or by ignoring her dogs actions) the dog to use your yard. You are just returning the favor. I consider this being neighborly! Obviously, the dog belongs to your neighbor as does the dogs poop, therefor you are just returning the processed dog food she bought and fed her dog. Humor aside, she doesn't have a leg to stand on. In my town, if a dog is even seen on the property of another without permission, the owner is FINED $200 for the first offense and $400 for each subsequent offence. The only limit to the number of fines is the ability to prove the violation... I.E. they can be fined CONSTANTLY without end. It matters not if the dog is on a leash, being walked without a leash or is running free, the fines apply. If the dog got off its lead, got out of the house or got out of the yard THE FINES STILL APPLY because you are supposed to have FULL CONTROL of your dog 24/7. No excuse will be accepted. I aggressively scan my security cameras whether or not I find evidence beforehand because eventually their urine deposits will manifest themselves as dead grass spots. Once the owner is caught on film, that photo is given to the animal officer and they get the fine. Neat and clean... not like the health issues they willingly created. Once fined, they are now liable for the damages caused (see above) as well as criminal trespass on posted property. Yes, I aggressively pursue all. Before you get all uppity you need to know I LIKE dogs! I don't have one because of the constant upkeep they require. I don't want them fouling my yard. I don't want to follow them around and pick up thier crap and I don't want my house and vehicles to STINK. (Yes they do, YOU just can't smell it any longer). If you say there is no upkeep, you are most likely one of those who don't clean up after your dog, don't walk it or allow it to run free creating health issues 'at will'.The end result is I have a nice lawn, I help the animal control department with expenses (although I disagree, they get 100% of the fine $$) and those who know me who have dogs, know I like them and keep them off my property accordingly.

In the U.S., does Child Protective Services need a warrant to enter your house?

From my understanding and from personal experience, Yes, they do.Basically, whenever, CPS wants to FORCE their way into a persons home they must have a court order to remove the child(ren) signed by a judge.That said, most of the time CPS won't and doesn't “need” to get a court order (which isn't all the difficult for them anyway as they have the ability to hold ex-parte hearings with a judge 24 hours a day without the parent(s) even knowing that they are coming or the reason why, let alone having the opportunity to prevent the removal) to get into most people homes; because, most people simply allow them to come in.Moreover, most of the time when CPS comes knocking on your door it's because someone has accused you of abuse and/or neglect via the child abuse phone line and they are INVESTIGATING the allegations and NOT removing the child(ren).However, if CPS really believes that the child(ren) is in IMMEDIATE DANGER and gets a “signed removal order” and therefore, can forcibly come in your house and remove the child(ren), they then have a certain amount of time, normally between 24–72 hours to hold a hearing to determine whether there is cause to keep the child(ren) in state custody OR whether the child(ren) will be returned to their parent(s) due to lack of evidence of abuse and/or neglect.I hope this helps:)

(e) With respect to property other than a dwelling, curtilage, or an occupied motor vehicle, a person is justified in using reasonable force against any other person if the person reasonably believes that the force is necessary to immediately prevent or terminate the other person's trespass on or criminal interference with property lawfully

Keep an eye out for whoever it is that's stealing your property. When you see them protect your property with force and remember the dead don't talk, your story is going to be the only one law dogs hear. Say it with fear and stick to it.

As for those bb kids shoot them too, law dogs would. It's hard to identify a bb gun from a real gun when you're freaked out because someone's shooting at you.
