Charged with possession of Marijuana, should i get a lawyer or public defender?

I was arrested about two weeks ago for possession of marijuana. It was less than a gram so i only got charged with possession. Its the first time ive ever been in any type of trouble so its my first offense. I just want to do accelerated rehabilitation programs and community service to get the case dismissed. Im from CT and there are statutes requiring automatic expungement in the case of dismissal of criminal charges. Im hoping that the judge would be lenient on me because Im going to present him with a paper of all my extracurricular activities, G.P.A., and volunteer work. Hopefully, he will realize that Im a good student and that this was just a very stupid mistake. Im 18 and my parents are hardworking lower-class citizens so its impossible for us to hire a lawyer. Should i stick with a public defender or hire a lawyer?

There was about 5 grams of marijuana. and one medium sized pipe. i got two citations one for possession of paraphernalia and one for possession of marijuana. So now i have to go to court. also i am 19 and have a very clean record, and the officer said because i have a very clean record they will most likely drop them to mistameters.

I live in Baton Rouge, LA and was recently charged with possession of marijuana. I am so stressed out about this that I have lost 10 pounds and have begun to have mild acne on my arms (arm acne is something I have never seen or heard of before so I can only assume it is stress induced).

For starters, yes. I deeply regret my actions and will be using this as a learning experience to stay away from trouble in the future.

My court summons says that my court date is May 24, 2011. What can I expect from this? Will this be like going in for a traffic ticket where I speak to a clerk? Will I be speaking to a judge? I have absolutely no clue. If I will be talking to a judge, what will it be like? I have friends who were charged with possession of marijuana in the past and they didn't serve any jail time. However, I'm worried about Louisiana's mandatory minimum sentencing, since I was within 1,000 feet of a school. If they do actually factor this in it could mean 3 months in jail. I don't know if they typically put this on the summons or not but if they do, it isn't on mine. The officer I spoke with said he was going to be putting in a good word for me with the DA since I was polite and "seemingly have a good head on my shoulders" but I don't know how much help that could really be. I would like to think that any reasonable judge wouldn't want to ruin the future of a 20 year old kid who is attending college in an attempt to better his life, but at the same time I can't help but to worry. When I asked the officer if he had any idea what might result from this he said that typically for a first offense it would be a period of probation (more than likely with random drug testing) and a fine, and after the period of probation is up the charge would then be removed from my criminal record. But that is all simply speculation.

If anyone has had an experience anything like this I would really appreciate finding out something.

Ohio Marijuana Possession Charge - 17 years old?

Alright, so this past weekend I got busted for marijuana possession. There was shake on the floor, and a bong underneath my seat(The cop was nice and only wrote me up for possession though - since paraphernalia is a greater charge).
Now I'm wondering, what is going to happen? I have a completely clean record, and have not even a traffic violation on my record.
The cop told me I'm going to have my license suspended. Apparently earlier this summer Ohio law was changed so that regardless if you were even near your car, you get your license suspended if busted with possession. I understand that, and understand this is going to cost me a $100 dollar fine.
How much will my court costs be?
When do you think I'll be brought into court?
These things in my car were my friend's(who was in the passenger seat - where the bong and shake was located) and he admitted to the officer that they were his, and got charged with possession as well.
Could I plead not guilty because of this(these things were not mine)?
I understand that if I am in fact charged with possession this will go onto my court record(Which will be clean of this after I turn 18 I believe), but I've also been told this will go onto my "DMZ record", which will apperently stick with me for the rest of my life. I can't have that. That would greatly **** up a lot of my life. I would lose scholarships, would have trouble getting jobs, and getting student loans.
Can anyone explain what all will happen because of this? I hope I didn't **** up too bad.

Assuming you are not going to fight the charges by going to trial, there are 2 likely courses of action.

1. You could enter a guilty plea. Possession of a Small Amount carries a max penalty of 30 days while Possession of Drug Paraphernalia carries a max of 1 year. With no priors you would likely get a probationary sentence. Not a big deal but you will then have a conviction on your permanent record.

2. Pennsylvania has a program called Accelerated Rehabilitative Disposition (ARD). This is for first time offenders and offers you a chance to have your record expunged. You will need to apply for the program which is run by the district attorney's office. If they accept you into the program, you go before a judge and he gives you the terms of your supervision. Usually 6 to 12 months just like probation, just not supervised as closely. If you successfully complete the program, your record is automatically expunged, meaning you never have to say you have been convicted of a crime. If you are thrown out of the program for whatever reason, the charges come back and you have the right to enter a guilty plea or go to trial.

3. Bucks County may have a drug diversion program that is similar to the ARD program I just described. I am not sure because I don't work in that county but it may be worth looking into.

I am a 16 year old minor charged for possession of marijuana?

First of all what state are you in? Secondly your a minor nothing major will happen just a fine and community service or maybe probation. It won't go on your adult record when your eighteen no one will be able to see your juvenile record. But the state that you are in makes a big difference for example when I was young but already an adult I got caught with weed and got what is called CWOF for 2 years(continued without a finding). Which meant if I stayed out of trouble for two years the charges were dismissed and no conviction on my record. I live in Massachusetts laws are different in most states. Get a lawyer or a public defender one will be appointed to you for free if you ask. Funny thing is, today marijuana posession in Massachusetts is no longer a criminal offence. It's just a civil fine like a speeding ticket. But have your parents talk to the public defender to get the facts and laws for you particular situation. Public defender might be able to just get you a small fine and none of the other bullshit. Just don't go pleading guilty without talking to a lawyer or public defender (same thing one is free one isn't). Good luck your future is just as bright now as it ever was don't worry in a year or two when you turn eighteen no one will ever know this happened to you. Good luck. Don't smoke weed again until it is legal!!! Or at least make sure your in massachusetts. lol

My brother got busted in Virginia for marijuana possession twice, will he likely face jail time?

I really doubt he will be going to Spain this March. For a second offense of possession, he can get up to a year in prison, and/or up to $2500 fine. He might be lucky to get probation, but that still means he is not going to Spain.

That's assuming it is only a possession charge, and not intent. That would be a MINIMUM of 1 year in prison, and could be up to 10 years.


*EDIT* - Yes, the sentence for intent is based on 1/2 oz to 5 lbs. More than 5 lbs is just an insane amount for "personal use". And less than 1/2 oz would be just a possession charge.

It won't be in the papers unless they are very hard up for a story.

Your license will not be suspended nor will your insurance go up.
You were not impaired .

Depending on your State, you will be able to have your record expunged in a couple years.
However , i believe you will get a diversion , in which you will not have a record. Only the Police and the Military will have access to the files.

You will need a lawyer or the Public Defender (free at the courthouse) to make this happen
First offenders have the opportunity to have no misdemeanor record if they satisfy all terms of "diversion", which is an alternative sentence. Probation (It can include fines, alcohol education, random testing, community service etc) is given. All court proceedings are deferred or "diverted" until completion of probation. Once probation is completed and all of the terms of probation are successfully met, the case will be discharged and dismissed. You will have no arrest record to report on school loans or housing applications, and most importantly employment forms.
