Legal Action For Indirect Threats

How do I threaten someone without using direct threatening words?

You don’t. A threat is a threat is a threat. You should never threaten anyone. Not for any reason. Sometimes a threat is a crime, you could go to jail. You should say nice things; “Enjoy it while you got it.” “I will remember.” “We are going to remember that.” “May the good lord have mercy on your soul.” “Have nice afterlife.”Less obtuse comments should still be oblique and framed in the form of question; “How would you like to become familiar with the joys of handicap parking?” “Do you have health coverage?” “Do your kids still go to PS11?”

Is it an illegal threat if you say, "I'm going to get a lawyer if you don't..."?

It depends on what you're asking the person to do - generally, this kind of threat wouldn't be illegal, but it could fall into the realm of illegal blackmail if you're asking for money and threatening to get your lawyer so that you could disclose some negative information or illegal activity on the part of the other person.Example: If you know that your employer is doing something illegal - say, openly discriminating against women and minorities - and you say "pay me $100k or I'll get a lawyer and we'll take this public," that's likely to fall under criminal blackmail statutes.  If, however, you're an independent contractor and you're due a certain amount of billed work, and you say "I'm going to get a lawyer if you don't pay what's due me," then it's perfectly legal. As with most legal questions, the specific circumstances and facts of the matter are what make the difference between an action being legal or not.  If you have a question about a specific situation, I'd highly recommend discussing your options with a lawyer before making such threats.

What is the difference between these legal terms; Dolus Directus, Dolus Indirectus, and Dolus Eventualis?

Dolus Directus (direct intent), where the consequences of an action were both foreseen and desired by the perpetrator. You want to kill Bob, so you shoot him.

Dolus Indirectus (indirect intent), where secondary consequences in addition to those desired by a perpetrator of an act were foreseen by the perpetrator as a certain result. You want to kill Bob, so you blow up his car while he and his wife are in it, knowing that you will kill his wife by doing so.

Dolus Eventualis, where a perpetrator foresees consequences other than those directly desired as a possibility. You want to kill Bob, so you lock him in his hotel room, and set the hotel on fire, knowing that it's likely that other people will die.

What can I do if someone made death threats?

I saw this question and an answer here earlier. The answer was good so I didn't feel the need to give another. The answer got deleted. Now the question turns up again in my personal feed? Is this a troll?AnywayDeath threats are signs of extreme hate and helplessness of the person who sends them. They should be seen in the light of this helplessness but also be recognised as a potential threat. If people on the internet utter them to a person that is known to them - address and all - or to a celebrity you need to inform the police. How to Deal With a ThreatI did get death threats in a game for quite a while because I defended human rights and anti cyber bullying. However I felt protected by the fact, that I was hidden behind a gamers avatar. The attacks sounded real though as if quite a lot of people were trying to attack me as best as they could.Lately I get a lot of weird questions here that make me wonder if trolls found me here too. I ignore most of them and started to take pictures as a proof. This is necessary after the weirdest of them disappeared mysteriously.I'm still wondering about the phenomenon and how to react if they should find my address. If I got direct threats on Quora I could always stop them with the help of Quora administration but what will you do about anonymous questions? Since they come directly to my personal account I stopped ignoring them and started to speak out.I am waiting for other Quorans to see and answer the question.

Is threatening a lawsuit considered coercion?

Well the thing is Coercion is not a black/white matter. Its a defense in court.Like Pleading Insanity.Or Fair Use. (I could write a book on how people don’t understand fair use)In general threatening a lawsuit is not Coercion but It CAN BE.You would need to prove that the threat was based on#1: A lawsuit with no real basis.#2: Was more about the monetary or moral effect of the lawsuit. Not the threat of actually losing it.If they threaten to drag your name through the mud, or run you out of money with a lawsuit. It’s 100% Coercion, and if you have proof, you should go ahead and slam dunk there ass in court.

Examples of discrimination..?

Descrimination means not treating equally. If in your class if some student who are rich are treated differently than the other students its descrimination. if a country makes different treatment to white skinned and blacks its a racial descrimination.

Is wishing someone dead considered a threat?

No. Wishing someone was dead is not the same as threatening to kill someone. As an example, I wish many bad drivers out there would just hit a post and get off the road, but I wouldn’t wish they hit a post and die. They might just be decent people, some of them at least.Wishing someone dead is your personal opinion. They could be a horrible, dangerous, careless, spiteful person. You have a right to your own opinion, and the same would be if you were to talk about the President of The USA as well. But to threaten them to death is to threaten them, and that is a criminal act. However, all said and aside, in some countries just talking about such opinions could land you in jail. Try it in countries like Russia, Columbia, many countries within the African Continent, etc.,and you’ll quickly find yourself disappear wiht a trace.
