Can police set-up road sobriety checkpoints near bars/clubs?

They can set up a sobriety checkpoint anywhere theoretically, but there are certain protocols that need met. First, the chief of the jurisdiction must approve the checkpoint. Second, highway-safety data is used to determine the need for the checkpoint. If there are a high number of accidents, and/or a high number of DUI/DWI-related accidents on that particular stretch of road, that is where the checkpoint will be set up.

Certain other considerations are assessed, such as whether the area is safe. You don't want to have it around a blind bend, for example. You need a long length of road to set up plenty of signs and other devices notifying oncoming drivers of the checkpoint. You also need an area for "the pit," which is where officers will conduct standardized field sobriety tests (SFST) and also the BAC tests. SFST practitioners are the only officers that are to conduct the tests. Either an intoxilyzer operator or a phlebotomist will need a separate area to perform the breath or blood test.

ok heres the deal.
my parents are getting a divoce after 20 years of marriage because my father has a alcohol and drinking problem.
my father left my mother, brother, and i about a month ago. ive had absolutely no contact with him since then.he has a massive drinking and xanax problem.
the biggest problem is that he has a prescription for his pills.
he normally drinks up to 12 beers a day mixed with 3 xanax pills at one time.
this has caused him and my mother to constantaniously argue and fight for the past 5-10 years, we've gotten into fistfights,etc because of it.

Now what i want to do is contact someone (possibly the local sheriffs office) (where he is staying) and inform them of the situation and if its possible they can send a unit out to supervise his activities and arrest him because there isnt a day that goes by that he doesnt drink and drive nor take pills.

Can a Police Officer have me set up someone to sell drugs to me?

The other night my friend was pulled over for driving like an idiot. There was me and two other people besides him in the car on a non school night. He right away saw our blood shot eyes and started asking where the weed was and what not and who had been drinking. The only person who was drinking was the driver who had about 4 shots of liquor about 3 hours before, but nonetheless he was underage so he got taken in. Long story short everyone got searched and the cop found my weed in my wallet but didnt arrest me or read me my rights, he told me he couldnt take me to jail because he didnt have enough room or some bullshit. But he told me if i want to make this weed go away, i could call him and set it up to have me buy a half ounce off of someone and he would arrest the person saying he is just observing the area. First off i want do i have to do this if i want to be cleared, and 2nd of all i told him to stay out of my wallet, so did he do an illegal search and that is why he is cutting me a break? thanks

Can anyone drive my licensed vehicle even though I have a DUI?

Yes anyone who is a licensed driver can drive your car (unless they LIVE with you and are not on your insurance). If the person is on your insurance OR does NOT live with you, they can drive it. No they wont be pulled over. And I am glad you are not planning on driving your car! Yes have someone else drive you around with your car if they are a license driver.
Yes, I am pretty sure you can still renew your plate etc because the DMV doesnt care about your DUI. Because you are allowed to have a car in your name but allow another driver to use the car. My car is in my dad's name for example (because he pays the ins for it). So for all the DMV knows, you could be paying for a car for someone else, but in your name.
And no I wont lecture you because you are doing the right thing by not driving and having someone else drive for you.
If you are still unsure contact your car ins company and ask them who can drive your car, since you cant.
No the police wont pull the driver over unless they speed, etc. The DUI is registered under YOUR name on your license if the police look it up. Your license plate is not marked with DUI.
When police run plates all that comes up is if the car is stolen (which it isnt) and if the car license plate number has unpaid parking tickets.

How long is jail time for a 50,000 dollar warrant.?

I went to jail for DUI, they set me up a court date and didn't see my name. Asked the clerked and told me no results are in. I didn't do no blood or urine test. The lady then said I should wait for a letter in mail .. It's been more then 8 months and still nothing. Now I have a 50,000 warrant .. What should I do? I have the paper proving I went but no DUI results. Am I going to jail ?

CA DMV "Charges Set Aside" DUI Info?

What it means? It means you beat the wrap you lucky SOB. I got pulled over blew a .06 they still took me to jail and booked me for a DUI. I was not very cooperative with the arresting officer. That may explain why he arrested me. 2 weeks later I got a notice saying charges have been "set aside" from DMV. 2 weeks after that I showed up in court as ordered. My case was not on the docket. I asked the DA's office why not and they said, I could walk "lack of evidence to prosecute". So I did. Also remember only DMV has the authority to revoke your driving privileges not the criminal court. IF the DMV say charges have been set aside the DA aint got a pot to piss in. You can walk. They might get you for the speeding or what ever bs the arresting officer said was "probable cause" in my case they did not do ****. Don't trust cops. Its this mentality that got me off. If I would have believe that cop I would have been screwed royally. Did not blow into the field sobriety tester and passed on the "Roadside Olympics". I told them to arrest me and take me to jail, they did. Since they had nothing to book me on they offered me the breathalyzer again. I took it but it was 2 hours later. I totally passed. Spent the night in Jail, car got towed, had to pay to get it out. ETC. cheaper than filing an SR22 sunshine. So yeah, you got off. But guess what I just got a ticket today for a california stop. IF you live in SF bay area be careful man. I have lived here my whole life (47 years) and have never seen it this HOT! Cops are enforcing everything.
