14th Amendment means all students should pay in-state tuition?

There is no loophole. No one who is charged out-of-state tuition is having their privileges as an American citizen taken away (college is optional, and going out-of-state is even more optional), nor is paying more tuition depriving a person's life, liberty, or property or denying a person equal protection under state laws. Even if there were cases pertaining to someone trying to argue against this, I can't believe it would be taken very seriously at all.

If you look at the resident policies for any state they include that someone must reside in that state for a full year and be completely emancipated from family if under a certain age (usually 22 or so). Nothing has changed since you went to school. Anyone can become a resident of a state so long as they fit the requirements, and in these requirements it always includes proof that you intend to remain as a resident of the state long-term. And a student who lives in a dorm except during break when s/he returns home and who possibly works but only part-time isn't really good proof of "Hey, I'm going to live here for the rest of my life and my many, many years of working here will provide taxes to help contribute to education costs, allowing other residents like me to enjoy the option of a higher education."
