Funny, for some reason people think it is illegal to postdate a check. It is not illegal. In collections law a collector can not demand a postdated check, so maybe that is where this urban myth comes from. And in fact FedEx is issuing a postdated check and I am fairly certain they know the law on payroll checks.
Pardon the digression. This has to do with bank policy and general banking rules, a bank is not supposed to deposit a check before the date on the check. Why wont banks take certain 3rd party checks?

Those two scenarios are the policies at alot of banks, including the one I work at, because there is a high chance of fraud. In the first scenario, you could have found the check, and signed it and claimed it was yours. If you're getting a check, always be sure it's made out to you, and avoid that issue.

The second check, is sort of the same. Who's to say you didn't just take your bandmate's check and write pay to the order of? The bank doesn't want to take the chance that the check will returned, and checks usually will be returned if anyone other than the payee deposits or cashes the check.

So, while it isn't "law" it is the banks policy, and they don't want to take the chance that you stole the check. Identity theft is very prevalent these days. They will need whoever wrote it over to you to go in, get thumb printed, and take their information. It's a hassle, but how would you feel if someone took your check and just wrote "pay to the order of" and cashed it? Not very good.

Edit: Now, cash is not a recognized way of writing a check to someone. The only way it can be accepted is if the person writing the check puts it as cash, walks into the bank, and cashes it. Premium account or not, they are right in not letting you deposit it or cash it. The more you fight them on it, the more suspicious they will become and might put a flag on your account. Like I said, I know it's a hassle but just get a new check written out, and bring in your buddy. Why should they have to tell you 3 times?

Banks and check cashing places are tricky...they either charge you an arm and leg or they dont let you cuz you dont have an account there. But if you have a friend that you trust and that trusts you and you know the check is good you can sign the check over to your friend and have your friend give you the cash. On the back of the check where you normally sign you simply write "pay to the order of (insert friends name here)" then sign your name. Then when your friend goes in to deposit it he/she will sign it and put their account number under their signiture like normal. This way you arent paying any fees or dealing with angry bank people!
