Hello I am male and 16 years of age. The age of consent is 16 years old in Ohio. So does that mean I can legally have sex with someone over the age of 18? example. someone who is 26.

The age of consent is 16. There is a three year "close in age" exception. Close in age exceptions are for people *under* the age of consent. So for example, a 15 year old with a 17 year old. Once you're *over* the age of consent, you can get it on with an 80 year old if you like. There is another exception in Ohio though: sexual conduct between anyone under 18 and a teacher, administrator, or coach of the school they attend, a cleric, or other person in authority, is punishable as a felony of the third degree.

Okay, well to keep it short I am 16 and this girl is 19. The legal age of consent in my state is 16, shes worried that if we have sex that my parents could sue her or press charges because she is older than me but I thought the law states that if you are 16 that you can legally have sex and your parents cannot press charges. It may be legal but there are loop holes in which you may want to investigate. Here in Oregon, the legal age of consent is also 16 (you can get married too w/ parental consent) BUT your parents can still charge anyone 18 and over with statutory rape even if you consented. And that would suck for the boy because a rape charge would stay with him for the rest of his life. This is how I try to explain things to my 17 year old; The things you do right now in life will potentially effect who you are at 20 and who you are at 35.Think before you act.

This means that if both partners are in that age range and especially if they are very close in age (like 15 and 16) and there was no coercion then it is unlikely that charges would be brought and if they were brought then this exemption could be used as a legal defense on the part of the older partner. Your parents could still choose to report the act as a crime, but it is not actually up to them to decide whether to press charges, instead it’s up to the district attorney’s office to decide whether there is enough evidence to get a likely conviction. Given that I'm sure your boyfriend would have the best legal representation he could get and that this exemption does exist, it seems unlikely that the state would want to spend its money prosecuting a case they'd be unlikely to win.
