Charges for pulling a knife.?

I was in my car and driving really slowly like 5mph while my girlfriend walked slowly beside. We were having a moment..But anyway. These four Chinese guys walked really close behind my car. And since i had the sunroof open i could here them talking. They were saying stuff like what a gay car, and he looks stupid and blah blah this continued for about three more minutes. Then one of them said if he hits me with the car theirs going to be a problem. They could have walked around the car so i could talk to my girlfriend, but no they stayed walking right behind my car. Then one of them acted like they were going to kick it. And that's when i jumped out and pulled a knife and he said i didn't kick it! and i said i don't care don't do it again. And got back in my car and me and my girlfriend drove away.

Am i going to get into trouble. like, if they call the police. i had no intention to injure them..I just wanted them to leave me alone. I'm 16 in Alabama..

As long as the blade is not more than 5 1/2 inches in length (from where the blade begins until it ends) and as long as it is not classified as a butterfly knife or switchblade which would mean any knife that opens either by pressing a button or by force of gravity or centrifugal force then you should be ok...I would not take it to school or any other place that is designated as a place where weapons should not be brought. That would depend on the local...city/state…laws of the area they would be in.When I was a young boy, there were no specific laws as to age or size of knif that a young lad could carry. Not even to school. That was back in the 1950s (late) to the mid 1960s when I left high school. Since then, society has changed…can’t say that it’s all be for the better…mostly worst looking at it lately…and began drafting and enacting laws for nearly everything people do in their daily lives. Some of those laws…very few in fact…had/have valid merit for being; the others were just to be making laws, since that’s what we pay taxes for…for them to enact and pass laws. So, not to be considered lacking in their job capabilities, they just started writing laws whether they made sense or not…mostly NOT. But they still go passed and are still on the books.Now you have to be 18 to have a pocket knife in your possession, even if it’s only 3–4 inches long…open. Use to be, every boy…even some girls…had and carried a pen knife; some even a 8–9 inch hunting knife and nothing was said. Now it’s ‘Lock and bar the doors, hide the wife and kids! We’re under attack!” Yeah, right!!Most places today most likely have some kind of law restricting young kids (under 18 years of age) from having any kind of knife….even a toy one, in some places…just like toy guns. Those are No-Nos! BULL!! Dumb laws, dumb mentallity on the lawmakers part and society for allowing them to pass such laws…most times passed in defiance of what the people wanted.

Bail: Maybe. The police might bail him pending further enquiries or pending deciding whether they're going to charge or not. If the police charged him straight away and didn't bail him, then he'd appear pretty quickly in a magistrates court which would decide bail.
There are lots of potential reasons for refusing bail, but, without going into it all and just on the hypothetical info you've given, I think he probably would get bail.

Offences Committed: Possibly: possession of an article with a blade or a point in a public place (though if it was a work tool this would probably not apply, also does not apply to penknives with blades less than 3"). Assault, Battery, ABH, possibly a technical GBH s20 but likely to be charged as such (only one of these would be likely to be charged. Probably battery or ABH).
Punishment if Convicted: Hard to say. Sentencing is so complicated that lawyers won't give their own clients an opinion on it without thoroughly researching the point and then only very tentatively. ABH (Assault Occasioning Actual Bodily Harm) carries a maximum of 5 years if tried in a Crown court. Minor case like this would be likely to be a Magistrates Court matter, in which case maximum 6 months. Maybe not even a custodial sentence.

Defences: As mentioned before self-defence or defence of another, using reasonable force, is generally a full defence. If the defendant were convicted despite such a plea, because, for example, force was excessive, then his sentence would be likely to be less than that for an unprovoked attack.

Is it legal for a minor to carry a pocket knife?

Theres no problem with you carrying it outside. Just not in sensitive areas such as Schools, Court Houses, ETC. I carry a Swiss Army Knife and sometimes even my Spyderco Endura which any knife enthusiast knows is a pretty mean knife. Cops have caught me using it sometimes for like small tasks like cutting a string or rope or somehting. they just say "Woah little man careful with that!". And i am 14.

Bottom line: just dont carry it in school or a court house, and dont whip it out in the middle of alot of people, sometimes they will get scared seeing a kid with a knife.

As far as the state… Pennsylvania has some of the easiest and most well-written knife laws of any state. They basically allow everything but switchblades, daggers and sword canes.HOWEVER… they have what I like to call the “common sense” clause, which forbids the carrying of a blade intended "for the infliction of serious bodily injury which serves no common lawful purpose."Now this might sound confusing, BUT it was clarified in 1975 in a court case. A man was arrested with a 30 inch machete… walking down the street… at 3:30 in the morning… in a high crime area… in downtown Scranton.The judge basically said, had the man been carrying or wielding this blade in a jungle or other suitable environment, then it would have been fine, but that it was completely unsuitable for an urban setting.So as far as I can see… feel free to strap that Bowie knife on your hip when camping or hunting… but don’t bring it to the mall unless you want a SWAT team response.I’m stuck in the People’s Sozialist Republik of Taxachusetts, where I can’t even drop a Gerber multitool in my pocket without worrying about a “concealed weapons” charge… and I’m licensed to carry a concealed FIREARM. Can a minor carry a gun?

RIght, i'm a minor, but I like fishing and hiking, and may do allitle hunting in the future. I plan on doing allot of fishing out in the middle of nowhere, and i would really like to have something other than my bowie knife in the unlikely event I'm attacked by a bear or cougar, or a predator of the 2-legged variety. I know that at 18, you can carry a rifle or shotgun, but i'm interested in a handgun, specificly a revolver. So, can I legaly carry a handgun under the age of 21 in the state of Oregon, Washington, or Idaho, or anywhere else for that matter? if so, can I legaly carry it concealed? if not, would a back pack, fannypack, or in my waistband, but I have a jacket on over it, but not trying to hide it, be considered concealed? also, can anybody tell me if theres much of a differance in acuracy between the NAA blackwidow with the 2 and 4 in. barrels? thanks.

Being arrested doesn't mean you'll be convicted.  Cops arrest a lot of people in situations like this and it gets worked out in the courts.  Generally it's not illegal to defend yourself, but as with most things when it comes to the law, it depends.  Sometimes you have to defend yourself in a reasonable manner without excessive force.  For instance, if someone slaps me, I can't stab them.  I have to be in danger that warrants me stabbing or shooting them.  You can still get in trouble for possession of a weapon.  Weapons are often illegal and/or regulated.  So, while it might be legal to shoot someone who enters your house in some states, you could still get in trouble for having an unregistered gun.  And in some places it's illegal to have certain kinds of knives, such as switchblades.  You could be within your rights stabbing someone who attacked you violently, but still get in legal trouble for owning the weapon or carrying it in public.
