Reporting 1099-MISC income as Other Income vs Self-employment income?

Some 1099MISC is not subject to SE tax. For example, if you won a sweepstakes prize, or if you were given payment for participating in a medical study. The reason this is not subject to SE tax is because you are not in the trade or business of winning sweepstakes or participating in medical studies.

Some sporadic work is subject to SE tax. For example, if you are a police officer and a few weekends a year, you are hired to do security outside of your normal work. Since you are in the business of being a police officer, this is also subject to SE tax.

The fact that you haven't heard from the IRS regarding your self-employment income doesn't change the fact that it is subject to self-employment tax. Expect to receive notice from the IRS requesting your SE tax. It can take up to three years to notify you.

You should amend your returns to include the SE tax to minimize penalties and interest.

What are good incentives to offer employees to motivate them and make them feel good?

You have some wonderful ideas already and I can add. One of the most rewarding incentives is "praise". Too often employees are criticized for something done wrong. Good employees that show on time, do their job, don't complain need "encouragement" knowing their work and presence is appreciated. "Praise" three times more often than criticizing each week.

Personnel files often contain the "negative" ONLY. These files effect income, promotion, etc. Any "well done" or exceptional work needs documenting and put in the files as well. Another "wrong doing" to employees that will effect performance is the "performance review". Too often management grades below actual performance to "allow room for improvement". This will "deflate" a good employee fast if they are doing a great job NOW.

Georgia Pacific in Atlanta conducted an experiment in one of their many departments. Management praised employees often, properly graded performance reviews, placed positive "beyond the norm" remarks in personnel files. These simple acts increased moral and overall production improved.

Is it legal for a registered CNA/PCA to work as a self employed person if insured and declaring witholding?

My friend is an excellent CNA, but too old to work in nursing homes. She intends to become self employed and independently work for elders (or younger) and help them stay in their own homes including hospice care. She intends to declare income tax, and have liability insurance. She also intends to collaborate with a home nurse and family.

I can see her point, the nursing homes are becoming living hell and she was sick ALL the time when working at those places. She's barely been sick a day in 4 years since she's been staying out of facilities. The crimes committed against humanity are horrible--the neglect, abuse, working in hostile environment.

I know this depends on the state. She wishes to become employed in Wisconsin, where she has not worked since about 1999. She recently obtained her Wisconsin CNA license and is registered in that state, but is not working there yet.

Her main goal with elders is to take care of 1-2 elders, such as husband and wife, at home until they die so they don't have to go to a nursing home. Is this legal?

She also would like to work in private homes with families who have terminally ill children to keep them in the home as long as possible, and optimally thriving. She feels she needs more education and experience in this area, though, so it's not likely she will enter that category any time soon.
