Which laws do police officers least enjoy enforcing?

Do you recall the Ferguson Mo. shooting case? Well in part let me show you another side of that case. Ferguson had sometime ago lost the business which had employed a large number of people. With the lost of this business, there were a lot of folks unemployed. Which in turn meant that people were not spending the money for other things like car registering and property tax. income to the city was down. So in an effort to bring in more money’s to the city. The City counsel enacted some traffic laws to be enforced. (Now some of these laws were already on the books, they just hadn’t been enforced in a vigorous manner) So now the orders come down, get out there and write citations. The thing is, these laws were not because of public safety, but because of low income to the city. That’s a hard sell to folks who are already having to do without and all it does is make those folks ANGRY. If you can’t put your car on the road, your left with having to walk and if your walking very far, the way your going to walk is a straight line. that also means your not going to walk all the way down to the corner to cross the the street. your just going to jay walk and forget the traffic light. Now here comes an officer, who’s telling you, you must not jay walk. The officer is the enforcement tool of a city who is taking more money from you, then you have to feed your family. Now the Angry boils over and we all know what happened. The enactment and required enforcement of laws that are not in and of them selves immediately related to the safe operation of a vehicle. will only generate ill feelings. Cities and Countries who do enact these laws only for the money they will be in, put law enforcement officers, in a tough place. those are the laws that I disliked the most trying to enforce.

Is there a difference between a police report and a accident report?

Different states and departments may have different types of classifications, but basically any type of report that the police have to write is a police report. Usually a non injury, property damage only, traffic collision report just describes the facts and circumstances relating to the collision and then based on all the factors attainable at the scene, the officer makes an informed decision on who is the most at fault party, or if both parties are equally at fault. Ultimately it is up to each parties insurance company to determine who is most at fault and pay the damages. The police report of the incident is generally what the company will use as a means of determining the respective settlements.

Are you allowed to give a police officer the middle finger?

I'll allow a law enforcement officer to answer that question in his own words....I'm parked in the lot of one of  the two Stab-n-Grabs in town, catching up on some paperwork, when the  local teenage hell-raiser screams by on the highway, arm out the window  and grinning like a chimp as he gives me the finger.Naturally, I cut in behind him, and follow for about two blocks before I turn on the lights and pull him over.I walk up to the door, and gently ask for his drivers licence, insurance and registration."What for?" he asks, all innocent."Because I asked for it." I reply, equally innocent.He  gives me the requested documents, I walk back to the Super Scooter and  check him and his pickup for wants and warrants. All clear -- for once.I walk back to the driver's side door, flip open my Book of Citations and begin writing.He looks at me, sputters a bit, then yaps, "You can't write me a ticket!""Why not?" I ask, filling in Block 9."Because you can't!""The answer 'because' doesn't work on my nieces and nephews," I answer, X-ing Block 23, "Articulate a reason.""You're a cop! My daddy says you can't be insulted by anything!""That is correct." I sign with a flourish."So you can't write me for flipping you off. I'm not signing that.""Correct. How-some-ever, this is not a ticket for flipping me off. You extended your left arm horizontally out of the drivers side window.""So?""So,  anyone who passed Drivers Education should know that an extended left  arm is a signal for a left turn. You failed to turn left. Sign here,  this is not a plea of guilty, it is merely a promise to appear in  court.""You're ticketing me for ILLEGAL USE OF A TURN SIGNAL?!"I am SO going to hell for that one.*sigh*He paid it, though.Source: I should be so ashamed of myself.I'm pretty sure it is legal but be aware of how and when you do it and the unintended consequences!

How do you protest a "texting while driving" citation when you weren't texting?

The only option for not getting the "texting while driving" ticket off your record is to plead not guilty.  It turns out that you can't take a driver's education course to remove it from your record.  Fortunately, you can opt to have your case heard by submitting a letter for consideration by whoever makes the final judgment ("trial by written declaration"), instead of physically going to court.  The officer involved also submits a letter, then a decision is made.I read online that officers get paid $0 for filling out the paperwork for "trials by written declaration", whereas they get paid overtime to appear in court, so typically officers show up in court, but about 30% of the time they don't respond to "trials by written declaration."

My neighbors keep calling the police on me and falsely accusing me of criminal acts. I am afraid to go outside of my house. What do I do?

I have a neighbor that is fixated on my husband. She seemed a little off, but once she found out about his time in prison she developed a full blown obsession. She wrote the association board for our community a complaint about him slamming doors and watching her when she was outside. This was nonsense but they still had to address it with us. She wrote subsequent letters to the board stating he has a key to her car, and gains entry to turn on her radio...that he lets air out of her tires...that he's getting in her home and releasing ants...and he's poisoning the food in her refrigerator. We'd see police at her door, but they never stopped by to talk to us. One day last fall, my husband was riding his bike. This neighbor pulled her car in front of him and slammed on her brakes, causing him to fall off his bike. Her behavior was now endangering him so we went to the police to file a report. The police were helpful, and knew our neighbor well. Apparently she'd filed lots of police reports about my husband and a few other men from the neighborhood. The police recognized she has mental health issues and never pursued her later complaints. So what can you do? Try to have your cell phone ready to record if you think your neighbor will confront you. Keep a cool head, there's nothing wrong with not engaging in an argument. Don't be afraid to talk to the police to see what your options are if you're being harassed. You don't want to end up on the wrong side of this problem.UPDATE: my local police department reached out to the neighbour's daughter, the daughter called my husband to apologize and let him know she will be intervening in a medically supervised care program for her mother. She made sure he has her contact info should we have any problems. I give her all the credit in the world, she was wonderful and it's great that she wants to be involved in her care! Here's hoping my neighbor gets back on track.

Is it legal to drive at 80 mph if everyone is driving at that same speed, even though the posted speed limit is 65 mph?

It isn’t legal to drive over the speed limit, but if everybody is going 80 mph, you only get a ticket if you’re the one caught, and the officer can only pull over the one at the back of the line. Make sure there’s somebody else behind you going the same speed and you’ll be good. Call that car your friend, the ticket insurance policy. Unless that car behind you is a police car.If there is a police car behind you and it’s light are not flashing, ease off the accelerator, but do not brake. This will discreetly slow you down. If a bunch of other people are noticeably going faster than you before he clocks your speed, he will pass you to track somebody else.If the car behind you is a police car with its lights flashing, pull over when it is safe to do so. Believe it or not, if you are in the left lane on the freeway, they prefer that you pull over to the left shoulder, since this allows them to approach the driver’s side of your car more safely. The officer will ask you how fast you were going. Tell him you were going about the same speed as everybody else. This will lead to a conversation. The bottom line is, if you were going a safe speed (about the same as the other cars you were with) you shouldn’t get a ticket. No matter what happens, be polite. If the officer gives you a ticket, you can go to court to defend your position.They usually pull over a car that is going noticeably faster than everybody else, and in this case you will get a ticket and you should just pay the fine, but sometimes an officer will pull a car out of a group of cars that are all going 80 because he has to meet a quota or something, or maybe he’s hoping the driver will pay the fine without challenging the ticket.

If you get pulled over and have been drinking and get out of your car and chug liquor can it be proven that you were drinking before you were driving?

Yes, this is a well known ploy, especially among habitual drunk drivers, for avoiding DUI charges or convictions. Our own police, with their experience, are experts at using this to get out of DUI convictions. There was one case where an RCMP, iirc, hit a motorcycle near his (the RCMP’s) home, went home after the accident before police showed up, and then claimed he'd had a few drinks to steady his nerves after the accident, when he had come back to the accident scene and been breathalyzed.However, the police doing DUI checks are wise to this, and will attempt to control you physically immediately on exiting the car, including a pat-down for alcohol, to avoid just this sort of thing happening.Edit:. I should mention that this is only to get out of the presumption of intoxication due to being over the legal limit when tested, or refusing the breathalyzer which carries the same penalty (here in Canada). It raises reasonable doubt about any blood alcohol test that is done, improving the chances of a favorable outcome if charged.
