*URGENT* Legality on 16/21 YO sex/relationship in Indiana w/ parental consent?

In the state of Indiana, the legal age of consent is 16, I believe. There is so much mixed information on the internet, however, that I am wary about trying to pick out the truth on my own. Can someone tell me: Is it legal for a 16 year old female to be in a sexually active relationship with a 21 year old male, if parental consent is given?

Green_Conservative - To clear things up for you, when someone is over the age of consent they can legally consent to sex with anyone. A person having consensual sexual relations with a person over the age of consent CAN NOT be charged with having sex with a minor. That is what the age of consent is all about.

Age of consent means that the person is the age that is legally presumed to possess the mental capacity to understand the seriousness of their actions and can give consent to have sex.

The answer to the second part of your question is: maybe. Some states only require that both parties be of lawful age. Kentucky is such a state. As long as both parties are over 16, consensual sex is lawful (unless the law has changed since I moved in 2001). Florida, where I spent the last few years of my police career was more strict. The lawful age of consent was technically 16, but the other person couldn't be 24 years old or older. It appears from the other answer, some states have a different standard, which is not surprising at all.

The thing to keep in mind with any "is it illegal" question is that every state has different laws with different details and nuances.

Edit @Mutt: There ARE laws about adults talking to minors if the talk is about sexual conduct, soliciting sexual activity, etcetera. Some states even have child pornography laws that do NOT require a visual image...meaning that texting a written description of a sex act with a minor would be child pornography.

Can a 20 year old date a 16 year old in the state of Indiana?

First you should probably check the state laws on age of consent , most states I believe are between the ages of 16-18 ! Then if your smart , you should talk to the girls father , there is nothing then a piss- off father of young girl ! Those are the best ways I think of to keep yourself out of trouble, just remember that you would dealing with a young girl and not a woman ! I should probably tell you that even if the age of consent is 16 in Indiana, the parents still have the option of having you arrested and with statutory rape ! The age of consent in Indiana is 16 years of age. So in this situation, one person is within the age of consent, and one person isn’t. That I know of, kissing isn’t considered statutory rape, only sexual activity would be considered statutory rape. I would double check with local laws though.With that being said though, I would watch out. Although throughout life 3 years might not seem like a huge difference, that is a huge difference in teen years. A 16 year old is (or at least should be) at a more advanced maturity level than a 13 year old. Lets not forget that one person is within the age of consent, and one person isn’t. One wrong mistake, and the 16 year old will end up in jail and be filed as a sex offender.No matter what, in my honest opinion, a 13 year old and a 16 year old should not be kissing to begin with. That to me is just wrong. The 13 year old is barely starting middle school, while the 16 year old is already a sophomore, potentially going on junior in high school. Most people would find that wrong, and if I had a kid that was only 13 years old, and he/she was kissing a 16 year old, I would stop it immediately.
