Is my dog or me legally liable for a dog bite?

I was walking my dog on a leash when a nother dog owner came down the street. I took the slack in my leash and sat my dog down because she gets excited at other dogs, especially little ones. as i was petting her the other dog approached and when the little dog was close to my dog the little dog jumped on its hind legs. My dog grabbed the little dogs leg in her mouth but did not chew. The little dogs owner tried to rip her dog out as i got my dog to open her mouth.

My question is, am i legally liable for their vet bills? my dog was leashed and restrained and just protecting herself because she got scared.

Am I liable if my dog bit another dog on my property?

My neighbor asked me to split the bill after he took his pitbull to the emergency room two days ago. Here is the background story:

I live in California (for law purposes). My neighbor was walking his 4 month pitbull again without a leash. (I told him two months ago to not walk his dog next to my gate without a leash because my dog starts barking). It is also a $250 ticket in CA for not having a dog on a leash. He disregarded what I said and this time his dog approached my gate, where my dog was standing. His dog stick his head in partially and my dog defended his property by biting his lip. I have an Akita. He was in my backyard behind a gateway that separates the drive way and back yard. He pulled his dog away by throwing cola on my dogs face. By the time I ran out, he already took his dog inside and later went to the emergency room. His pitbull had several stitches and he wanted us to split the bill. I told him that I will do no such thing because I have told him in the past to put his dog on the leash. If he was a caring dog owner, then he would have avoided this situation. I even told him this TWO months ago. He said that he will be suing us now for damages and will look into putting my dog down.

Does he have any rights? Can he use me?

I was looking up some dog laws. Owners do not seem to be responsible if another dog trespasses on the private property especially when they dog was not on the leash.

Please help me out! I have been stressing out about this the entire week.

Am I liable if my dog bites the groomer?

My 3 year old pug bit her groomer because the groomer cut at least 2 of her nails too low. This was her reaction. The bite broke the skin. She is not a vicious dog and has never reacted like this when getting her nails clipped. She still had 2 nails that were bleeding when I picked her up. She seemed traumatized, nervous and not herself. The groomer wanted me to sign a statement that I would take care of all medical bills should he require stitches, but I declined. He still continued to groom other dogs. He stated that he would have to report her to animal control and they may have to quarantine her for 30 days. Am I liable for medical expenses?

Who is liable if a stray dog bites a person?

The stray dogs are nobody’s liability. However, in most countries (e.g. India) the law recognizes their right to live alongside a community even if they are not owned by anybody.The municipal corporation(or the concerned local body) is responsible for vaccinating and sterilizing(neutering) them so as to keep diseases away and population in control. The same corporation is also liable to provide anyone who’s bitten with anti-rabies treatment, free of cost.

Am I liable for a dog bite if I told the groomer to muzzle him, but she didn't?

And NO - I have not failed as a dog owner! I got this dog from the local pound. He was shivering in the corner of his run, and miserable. He was approx 4 years old when I adopted him. The shelter told me he was a potential "fear biter", who had most likely been abused and neglected. I gave him the loving home and second chance at life that he deserved. We have now had him for 5 years, and our excellent, loving care has resulted in no bites for the last 4 years and 6 months! But since I AM such a good and responsible dog owner, I still let people know the potential is there!

Also, just so you know the three times he did bite, once was me, and twice was my hubby. I never let him around other people when he was in his major biting period, and I do not let strangers pet him, even to this day, for fear of just never quite knowing.

If my dog bites someone who trespasses am I liable?

Trespassing needs to be better defined. If you have a gate around your property and a sign saying to be alert of the dog and the mailman comes onto your property and get bitten, you are probably liable.Second case. You have an auto yard guarded by three vicious dogs, a sign warning intruders, and a padlocked gate. At two AM somebody with a bolt cutter breaks the padlock and enters your property in an attempt to rob you—and the dog gets to him. You call the police but you are probably not liable for the dog bite.

If my friends dog bites someone else am I liable because it happened on my property?

My friend had his lil chihuahua at my house last weekend. Anyway, my other friend, who never met this dog before started to put his face in the dogs face. I don't know if he was making kissy faces or blowing in the dogs face. Regardless, I guess the dog got annoyed and bit him on the lip.

A week later I found out the guy that got bit now wants to sue me for something I didn't even do. Am I liable because it happened on my property? I'm sure my homeowners will cover this 100% but I think this absolutely unfair. I'm not just going to roll-over and let this happen. Is there way I can protect myself?

Who is liable if an off-leash dog gets bitten by my dog?

Legally it would be the owner of the off-leash dog. Before she passed my Boxer loved going on walks. However, she was never fond of being pet or having other dogs approach her when she is on her leash due to protective tendencies. She is fine with being pet if I took the leash off but I never took her off her leash around another dog except twice. One time it was with a Labrador. We were walking past the Lab’s house when he ran up to use. At first my dog snapped at him but when I took the leash off and went in his yard (with the owner’s permission) they started playing. The last time it was with the same dog and that was two days before she passed away. In the same neighborhood there is what I assume to be a Jack Russell mix. I was walking my dog in that area of the neighborhood and we were coming out of the lower part of it where there is a small creek. I was on one side of the street and on the other side was a couple with a larger dog. Whenever I see another dog walking past us, I always make my dog get into a sitting position. I got her into the sitting position but then that damn JT mix (from what I heard from the Lab’s owner it wasn’t the nicest dog. One time it was just me and a friend on a walk and I swear he would have bitten us if he got any closer) came down the road after his owners off-leash. He then ran up to my dog and growled at her. In return my dog lunged at him with a harsh sounding bark. Because of her strength I was pulled to the ground (keep in mind I can keep my dog in control) and while the couple got their mini dog under control my dog stood over me. Because I didn’t want to risk her trying to lunge again I got her into a laying position, though she decided I was still in need of protecting and laid across my lap. The owners of the other dog were nice and went on their way after I reasurred them that I was fine. My dog and I stayed on the ground for a minute or two before we also went on our way. Neither she or the other dog were injured.The story was unnecessary, but it’s a fond memory I have of her. Basically what I was trying to say is that if my dog injured their dog, they wouldn’t have had the right to get mad or try to press charges if they wanted to because my dog was on-leash and theirs were not.

Who is liable if an on-leash dog injures an out of control off-leash dog in a strictly on-leash area?

Speaking from my own experience, I've had this occur. I always walk my pit bulls on a leash unless we're deep in the woods. On two occasions, unleashed dogs have run up to my dogs, and my dogs have attacked them. In both of those cases, I warned the owners to keep their dog away. In one instance, the woman blew me off and shouted "He's fine, he just wants to play with your dog!" Just as she finished saying that, my dog lunged at her dog and grabbed a hold of its chest and shoulder region and shook the hell out of that dog. After several minutes of chaos and pandemonium, I got the dogs separated. I wouldn't let her near them as I didn't want her getting inadvertently bitten, but while I was separating the dogs, she called the police. I waited for the police to show up, and since we were in the city limits, my dog was leashed and hers was not, as well as my providing a warning meant that I wasn't liable for the rather substantial damage my dog did to hers. It happened another time as well. This time the couple heeded my warning and tried to get their dog back, but he was on charge. Things didn't go so well for him either. They of course called the police and again, I was following the rules, they weren't, so I wasn't charged, nor was I required to pay their vet bills. It's unfortunate, and I feel bad for their dogs, but you've got to have control over your animals.

Why am I liable if my dog attacks a burglar?

I am wondering where you live where this is a concern.Where I live, trespass on someones property without permission pretty much means you forfeit any right to cry foul if something bad happens to you.As an example - some meth monkey thought he would climb over my back fence a while back. I wasn’t home at the time to ask him what his intentions were, but the fact that he was carrying a crowbar at the time makes me think he wasn’t there to sell cookies.My German Shepherd WAS home at the time, and took exception to this unannounced visitor.When I got home I found a torn pair of sweats, the crowbar, and a swath of blood going back over the fence. The security tapes are hilarious.And no, I was not liable for Mr. Meth’s puncture wounds, although the cops did come to my house after the junkie checked into the hospital to make sure my dogs rabies certificate was current. They got a laugh out of the security footage as well.
