Difference between EIN and Texas Tax registration application?

I am a programmer by trade, but I am looking forward to starting a small business and operating online completely using a web-store. And I want to keep everything legal. So I have a few questions:

1. What is the difference between EIN (aka federal tax identification number) that is issued by IRS vs Sales tax permit that is sold by the state of Texas? Which one do I need and what is the purpose for each? Do I have to use both of these to pay different taxes?

2. Do I have to charge tax to customers who are not in my state (Texas)? Or do I only charge it for customers in Texas? If I sell to someone in California, who pays the tax to the state of California?

3. Where do I go to register the name of my business?

4. Is it necessary to form a corporation? Or can I operate without forming one?

my major concern is #1. I see the two forms and don't know the difference between the two and what purpose each of them serve. Do I pay both federal and state taxes???

Do I need to get a new EIN to hire employees?

No, you are already an established business, you do not need to get another EIN unless you are changing the class of business you have (from LLC to something else) or you are closing and opening up a new business.

You hire employees, fill out the paperwork. Just remember if you take out taxes, you are responsible for payroll taxes and filing the 941 form every quarter. The IRS doesn't mess around with those, I know from experience. Once you start taking out taxes, you can't stop. You must always do it. You can however, hire contractor workers (same as employees to you) but give 1099-misc forms so you don't take out taxes and end up responsible for payroll taxes. You need to search the www.irs.gov website to find out more information regarding all your options and what you will be responsible for as an employer. Oh and don't forget workman's comp and your state unemployment tax.

Self-employed, but do I need an EIN to pay a helper?

It's still more complicated than the other answerers have proposed. It depends on whether she's an employee or an independent contractor.

You may apply for an EIN, whether or not you need one. There's no cost.

If she's an an independent contractor, then you don't need an EIN; if you don't have one, and need to file a 1099, you'll need to give her your social security number on the 1099 as payor. If you don't trust her, that could be a problem. There may be additional state requirements. For example, California recently (2003?) added a requirement that, once you pay or contract to pay an independent contractor $600 or more, you need to file a statement with the state employmentagency (EDD) within 30 days, so that the state can contact you to withhold payment if there is any outstanding child support obligations.

There's a space on Schedule C to provide an EIN, if you have one. It doesn't otherwise effect the return.

Do I need an EIN (Employer Identification Number) if I am operating a sole proprietorship consulting business using a DBA?

I'll answer based on my experience in these matters:Your personal SSN will suffice if this is a DBA sole proprietorship.  And, you will report your income/losses/deductions on your Schedule C of your personal tax return.However, you will be joining the liabilities and risks of the company with your own.  Any problem in your personal life or business life that reaches the point of a settlement or judgement against you will be able to go after assets on both sides.  As a simple example, if there is a slip and fall on your property, the injured party can go after your personal assets as well as your business assets, if they can prove you are at fault for the accident.  This may not be a desirable situation for you.This is why many businesses incorporate and file all the necessary forms.  To keep these risks separated.I'm not an accountant nor a lawyer.  Just an experienced business person.  Contact a lawyer or accountant in your jurisdiction for specific advice applicable to your personal situation.
