Who knows more about the law, criminal lawyers or cops?

Think about it. A lawyer must graduate from college with an acceptable grade point average to get into law school. Then he or she must endure a grueling three years of law school where they are totally immersed in the law. Then they have to study for and pass a very difficult test called the bar examination that lasts several days where they prove to the bar examiners that they have mastered the legal principles involved in a wide variety of legal areas including criminal law.Now, let’s look at the average cop. He or she may not have some college or a degree. Many policemen in rural areas are high school graduates (or not). Some cities, usually dependant on the salaries they can afford to pay police officers, may require some college or even a degree, but often these are from taking night school classes or online education. Not to be an education snob, there are a very large amount of people with extraordinary intelligence and of high achievement who never went to college or who received their education in non-traditional ways and went on to do great things. However, I would think that most of these people go into areas other than law enforcement.Generally, police officers must graduate from a police academy before they are allowed on the force. They receive a fairly substantial amount of training in the law while learning other things such as police procedures, handling suspects, etc. However, their legal training is mostly concerned with recognizing conduct that is prohibited by a statute or ordinance, and how to arrest a person and conduct a search without violating rights protected by the federal or state constitutions. Some cops are pretty good at these things and understand the rationale behind the laws and why there are checks an balances on their conduct in performing their job, but most police officers know criminal law like I know tax law: just enough to get them in trouble. So who knows more about the law? It will almost always be the lawyers.

What does a criminal defense lawyer do?

In a criminal case there are 2 attorneys involved: 1 representing the Defendant (the person charged with the crime) and 2. the prosecutor/or district attorney (same thing just called different things in different states). The prosecutor works for the government, usually a county, and pursues the case on the states behalf. Witnesses and victims may have attorneys, but they take no part in the proceedings.

NO lawyers can go from side to side, not even in civil litigation, that would be called a conflict of interest (which I will not go into defining because you asked that we keep it simple ;)

Top firms pay lawyers $160,000 a year. Okay. Lawyers represent clients, and these clients have to pay their lawyer. If I am a lawyer for Firm X, and I win a $75-million-dollar lawsuit, don't I get a piece of that? But what if I dont get called for any cases? Do I still make my $160,000 salary?
