California Driving Laws

What is the driving age in California?

Effective January 1, 2006, a new law will increase driving restrictions for persons under the age of 18 who:  Are issued a provisional driver license (DL) on or after January 1, 2006, or Already hold a provisional DL issued on or after January 1, 2005. Provisional Driving Restrictions—You must be accompanied and supervised by a licensed parent, guardian or other licensed driver 25 years of age or older or a licensed or certified driving instructor when you:  Transport passengers under 20 years of age at any time, for the first twelve months.Drive between 11 pm and 5 am for the first twelve months. To determine if these restrictions apply to you, look at the date on your driver license. The date printed just to the left of your photograph is the date these restrictions begin. The new restrictions apply for 12 months following this date. For example: If the date on your license is May 7, 2005, you will have the above restrictions through May 7, 2006. Violation of either restriction can result in a fine and/or community service.  Persons under 18 may not be employed to drive a motor vehicle. When you turn 18 years of age, the provisional part of your license ends. You may continue to drive as an adult using your photo license, which will expire on your 5th birthday after the date you applied.

New California driving law... drivers under 18?

I heard there is going to be a new California state law about people under the age of 18 not being able to drive passengers under 18. I could really use a reliable link to this information, I tried searching the CA DMV site, but couldn't find it. Thanks!

What differences are there in driving laws between California and Oregon?

I recently got my CA driving permit but am moving to OR in a few weeks and will need to get an OR driving permit (meaning I have to take the OR writen test).

Can anyone tell me (or direct me to a website that can tell me) what driving laws/rules differ between the two states so that I don't have to read the entire OR Driver's Manual?

How many points can you get on your California driving record before your license gets suspended?

copied from California DMV Point System & Penalties | DMV.orgPoint Values in CaliforniaThe California Department of Motor Vehicles (DMV) uses a point system to rate driving records, starting each driver with a clean driving record. A traffic ticket, however, can change all that. These are examples of violations that will earn you driving record points:A minor moving violation (traffic ticket).Issues involving certain vehicle mechanics or additional equipment, such as brake issues and child safety seat violations.Reckless driving.Driving with a suspended or revoked driver's license.Being involved in a hit-and-run accident.Driving under the influence of drugs or alcohol (DUI).AdvertisementSuspended California Driver's LicenseAs you acquire points, you place yourself in danger of losing your driver's license. The DMV has the right to suspend or revoke your driving privileges if you accumulate a certain number of points over a set period of time.4 points in a period of 12 months.6 points in a period of 24 months.8 points in a period of 36 months.Contrary to popular thought, driving records are not automatically cleared of all points once the points are over a year old. If you have accumulated points, it's always a good idea to be aware of the DMV Violation Codes.you can check your points on this page

What are the new driving laws in California for teens?

You got that backwards. It is that you must drive alone and you cannot give anyone under 20 years old a ride unless you have a licensed parent, a guardian or other adult 25 years old or older in the car with you.

In California driving laws, is it illegal to hold a smartphone momentarily while only using Maps, or not?

It is illegal. Vehicle Code 23123 prohibits “using” a cell phone, which the courts interpreted as meaning talking or listening to a call. The Legislature responded by enacting Vehicle Code 23123.5:(a) A person shall not drive a motor vehicle while holding and operating a handheld wireless telephone or an electronic wireless communications device unless the wireless telephone or electronic wireless communications device is specifically designed and configured to allow voice-operated and hands-free operation, and it is used in that manner while driving.(b) This section shall not apply to manufacturer-installed systems that are embedded in the vehicle.(c) A handheld wireless telephone or electronic wireless communications device may be operated in a manner requiring the use of the driver’s hand while the driver is operating the vehicle only if both of the following conditions are satisfied:(1) The handheld wireless telephone or electronic wireless communications device is mounted on a vehicle’s windshield in the same manner a portable Global Positioning System (GPS) is mounted pursuant to paragraph (12) of subdivision (b) of Section 26708 or is mounted on or affixed to a vehicle’s dashboard or center console in a manner that does not hinder the driver’s view of the road.(2) The driver’s hand is used to activate or deactivate a feature or function of the handheld wireless telephone or wireless communications device with the motion of a single swipe or tap of the driver’s finger.(d) A violation of this section is an infraction punishable by a base fine of twenty dollars ($20) for a first offense and fifty dollars ($50) for each subsequent offense.(e) This section does not apply to an emergency services professional using an electronic wireless communications device while operating an authorized emergency vehicle, as defined in Section 165, in the course and scope of his or her duties.(f) For the purposes of this section, “electronic wireless communications device” includes, but is not limited to, a broadband personal communication device, a handheld device or laptop computer with mobile data access, or a pager. So, even momentarily holding the phone is illegal: it must be “mounted.” Note that with the assessments added to fines in California, that $20 fine will cost around $160, and the $50 fine will cost about $285. It is not a point on your driving record.

Can I apply for a California driving license while in a long visit with a B1/B2 visa?

It appears that you can apply for a California driver's license while on a B-1 or B-2 visa (indeed, pretty much any visa). You will receive a limited term license based on the date that is on your I-94. If you have less than 60 days left before the end date on your I-94, you will receive a temporary California license; if you have more than sixty days left on your I-94, you will get a regular license that expires when your I-94 does.Do not apply for a AB60 "undocumented immigrant" driver's permit (as some here have suggested); you are not required to have a SSN to apply for a California driver's license if you have documentation of your identity (passport will suffice) and a legal presence document (e.g. I-94) that indicates that you are not eligible to receive a SSN. Applying for a license under the terms of AB60 may jeopardize your status as non-immigrant visitor in the United States.Note that you do not have to obtain a California license if you have a valid and unexpired license issued by the driving authorities in your home country, provided that your license is in English or you have an accompanying IDP that provides an English translation of that license, and provided that your home country is one of the 72 countries that are parties to the 1949 Convention on Road Traffic.
