Can A Landlord Kick You Out Sooner Than Thirty Days If You Are Paid In Full For That Last Month

Do I have to give my 30 days notice on the 30th of the month?

I live in Minnesota. Today is the 7th of February. I told my landlord yesterday that we would be moving out on March 8th. She said no. She said even if we do move out, we still have to pay a full months rent in March. I told her I would gladly pay prorated rent for March, and have it paid on the 1st. She said it does not work like that, and if we did not pay a full months rent she would keep our full deposit. She said if she found someone to move in that we "better have our s*** packed and ready to go." It states in the lease that we must provide 30 days notice. Nothing about having to provide it on the 30th of the month. The thing that I'm nervous about is that we did move in on the 1st of the month. And in the lease it does say that the [full amount] will be paid on the 1st. I just assumed that it did not included when you moved out.

Keep in mind this lady is very very shady. She has a "no tolerance" policy, yet I have called the cops on a tenant 3 times and he has not been kicked out..it's rumored that he sells drugs to her (which I very much so believe).

My landlord evicted me today, it is a one bedroom apartment. He told me I had to leave ASAP, because he was going to move into the apartment. It was a verbal notice.

* My question is if I by law get the 3 months free of rent, because he is throwing me out.
What can I do? Do I have to go to my city council?

How does my sister kick out her soon to be ex-husband that is no longer on the HUD lease, the rent lease and hasn't paid his share of any of the bills and food within the past thirty days for which he refuses to leave?

Sorry, I dont know the answer. But I will say if he has been abusive or threatening she can get a restraining order to keep him away. He will need to bring police to move out his stuff. I have not had to do it but I understand you can evict a roommate but I dont know about a spouse. For better or worse etc. Good luck to her

I assure you that not paying your rent is one of the worst decisions that you can make. Your life will not be the same after an eviction. It can be a very traumatic experience.Every state is going to have slightly different eviction laws but here in Ohio my company has a very large rental portfolio in the Cleveland area and this is how we handle tenants who do not pay rent.Rent is due on the 1st.Rent is late on the 2nd.We call tenants 3x day from the 5th through the 10th.We put up 3 day notices on the 10th.After the 3 day notices we file for eviction. Once we file we will no longer accept rent. At this point the non paying tenant can't pay or get out of the legal ramifications of their actions.We win the court eviction and get a write to regain possession of the property. The eviction remains on your record for life. It will be incredibly hard if not impossible to find another landlord willing to rent to you.We send in the bailiffs (guns drawn) to the home. If you do not open the door they kick it in and forcibly remove any occupants living in the home.Everything that the tenant owns is placed on the curb by a moving crew. They can clear out an entire home in about 2 hours. They are not vary delicate with your possessions. Everything stays on the curb until 5pm. Scrappers and thieves usually come by and steal anything of value. At 5pm we bring a dump truck and load up everything that is left and take it to storage. After 30 days in storage we take it to the dump.After all of the above a non paying tenant can also expect the following to happen.We take you back to court and sue you for back rent, legal costs and damages.We garnish your wages until all debts are paid off.As you can gather from everything above being evicted is a terrible experience that is 100% preventable by you. We can't afford our rent anymore. My husband lost his job and his new job is half the pay. How can we get out?

READ your lease--carefully
TALK to your LL, explaining situation and ask what can be worked out. If you have been a tenant for more than a year, have paid on time, kept place up, give 30-60 days notice, they are likely to be willing to work with you to get a new tenant and release you from lease. . . .It's your problem, not your LL's, and LL has right to rent from you for term of lease, but LLs are people too, even if they hear far too many sob stories and excuses.

Can a landlord keep the amount given as a deposit of 1 year if I move out before 8 months?The answer is in your lease, give it a read.Unless you have a clause that allows you to terminate you lease early, you still owe all of your rent through the end of the lease. So, what this means is youowe your landlord a lot of rent. If you leave without paying it, not only can your landlord keep your deposit, they may very well take you to court for the rest.Landlords are required to mitigate rent loss in most parts of the United States, but not all. What this means is if you break your lease early, the landlord is required to try to rent it out to someone else and can only charge you for the time that the property was actually vacant. But let’s think about a few things here, how motivated will the landlord be to rush out and find a new tenant when they have you on the hook for the rent.Is it fair?Yeah, it’s very fair. You signed a legally binding contract to pay a certain amount of rent for a specific time. When you breach the contract, it has a very direct impact on the landlord. The mortgage, insurance, HOA dues, maintenance, taxes, etc all still have to be paid, even when you don’t pay rent.A good landlord knows that their property will not be occupied and paid for 100% of the time. I always budget based on the assumption that my units will be occupied 11 months a year. My average renter stays 5 years, but after 5 years I may not be able to refurbish and re-rent in only 1 month. Over the last 20 years, my units have been occupied over 96% of the time, but I work very hard to keep the tenants I have and it is why my average renter stays 5 years and my occupancy rate is so high. If I allow renters to bail out after 7 months and I can get a new renter in only 1 month, my occupancy rate would drop to 85% and in addition it increases my time, work, and expenses. That would suck and that’s not fair.

Yes, you can be evicted. And yes, of course you will still owe rent, but you are actually overlooking much more serious consequences:For example, I have 3 houses that I’ve given 60 days notice to leave (30 is all that is required) since they didn’t want to sign new year leases. I have renters for 2 of them already, and likely will for the 3rd, before the end date.Now, say one of them did what you suggest, and just said “hey, I can’t find anything and I know its going to take you a month or more to evict, so I’ll just stay here!”Well, in that case I am NOT just filing eviction, I am going to sue them (and their parent cosigners) for some very serious money, likely multiple thousands more than just the rent. Why? Because I’m going to have to put up all of my new tenants, in most cases 3 students, in hotels while I wait to get the squatter out, since I won’t have the home ready as promised. Plus likely pay storage and moving expenses for their stuff.Your not finding a place is not your landlord’s problem, but your staying beyond the date can become one of the most expensive dumb moves you could do!

Can you get evicted on a month to month lease?

I was on a one year lease but my lease was up last September and I never signed a new lease my rental office said that I would be month to month buy I never signed anything saying that I m month to month. I m wondering if I can be evicted if I stop paying rent in order to move to another apartment, and am I supposed to give my current rental office notice of me moving even though I m not on a lease?
