What can a landlord do if a tenant refuses to leave after an eviction notice?

That depends on what you mean by “eviction notice.”An eviction notice is issued by a court after a legal process in which the landlord has been awarded possession of the premises.The eviction process is handled by a court and, if necessary, by local law enforcement pursuant to a court order. If the tenant refuses to leave after the eviction notice has been served then he or she will be forcibly removed from the premises. There is nothing the landlord needs to do.A landlord cannot issue an eviction notice because only a court has the power to evict someone from their home.But a landlord can issue a “termination notice” or a “notice to vacate” or similar notices to the tenant pursuant to the terms of the lease. If such notices have been properly issued and served, and the tenant refuses to leave, then the landlord must file a dispossession action in the local civil court which, after due process, will result in the court issuing an “eviction notice” as described above.

Here is something that actually happened to me back in February. Now mind you I live in a smaller city of less than 10000 people do i am sure it varies. 1 year to the day previously I got pulled over for various reasons which was an honest mistake on my part but was my fault none the less. It resulted in my car being towed and a hand full of high end traffic violations. Now being a small town the judge is pretty aware of most people and who your trouble makers are so is pretty good about listening and not handing out stiff penalties unless it is warranted. I was able to strike a deal of pleading to 1 lesser offense, paying my impound fees and fixing issues that would rectify the issues that resulted in my initial police contact. That day I paid my fine and followed the court orders and it was done. Now fast forward 1 year… apparently there was a mistake made in the filing of the paper work and it was showed I was supposed to reappear which I did not spend results in me not showing up in court. 5 days after the missed court date I hear a knock on my door and answer it. There stands 2 police officers and a 3rd around the corner in my back yard watching my back door. After showing them all my documents they also see there is a mistake and are not willing to haul me off in front of my son, so they ask me to come to the station the next morning before court starts. It was an easy process they booked me and sent me over to the court on my own. The judge flips through everything pretty much asks how the last year has treated me and wishes myself well, and tells me to tell the family hello (He is one of my neighbors living on the same street) and sends me on my way. So yes no matter how trivial a warrant will be attempted to be served. It's best to just cooperate and explain your situation because the longer you dodge it the harsher it will get.

I can’t speak for all addicts, but I can tell you what I did. I was a heroin addict. At different times in my life I did different things to maintain my habit. When I first started using, I was just a young college student. I was on scholarship and my parents paid my rent and bills. So my parents would send me money when I needed it and I used all that money to support my habit. I also got more money by scamming men on the Internet. I had men sending me hundreds of dollars a month and every cent of that went into my veins.Fast forward a few years and I’m homeless. Every morning I would run some sort of scam to be able to afford my fix. Some days I’d beg for money in front of a store or gas station. Sometimes I stole things from stores and sold them. I did all kinds of crazy shit for money.At other times, I did work and was a stable and functioning addict. For about a year and a half, I had a great job and was able to support my habit that way. But when my mom found out I was using again, she sent me to rehab and that was the end of that.So basically, an addict will do whatever it takes to get the money for their next fix. They will steal, lie, con, beg, cheat, and pawn things. Whatever they have to do, they will do it. It’s amazing how much energy I put into finding money for drugs. I can’t even imagine how much money I’d have today if I’d have saved that money instead of putting it in my veins. Hah.Thanks for the A2A.
