Can you cash a check with my name and my husbands name at my bank?

You may NOT. My answer to you is, Just add your husband name to the account, then it is done.
The IRS instructed banks not to deposit or cash checks like this unless both parties are present.
The only way to cash a check is to be present you and the husband and both sign the check, then
either of you could deposit the check in any account of you, as far both signed it,
IRS checks may and could be cashed by a business who authorized by the treasury to handle third party checks. It is known by FCEN of treasury dept.

I need to know if I can cash my husband's check. He is in jail for tickets and our family desperately needs his check cashed by Wednesday to pay the rent since he was our sole provider. I don't have his ID but I have any other type of paper work they may need. I was in the midst of a divorce. I got a refund check from our homeowners insurance company made payable to both my husband AND me. I endorsed the check with my name only and deposited the check into my bank account. My now ex husband just found out and is pissed off. He said what I did was illegal. He said that I needed his signature as well. I had no idea I needed both signatures and I would think that my bank would have said something if that were true, or refused to cash or deposit the check. Thoughts?

Short answer is NO NO NO. If you have a joint account you could deposit the cheque then make a withdrawal.The reason the cheque has a specified payee is so that the payor has a record that the payment was actually made to the payee. This requirement is satisfied by depositing the cheque to an account with the payee’s name on it or having the payee actually endorse the back of the cheque.As I have written before the biggest hurdle people face when banking is establishing a relationship with their bank. Find a bank open an account and do all of your business with that bank and don’t pull any fast ones.

Yes, you can cash a check with someone else's name on it in the US, and this is called a 3rd party check. You would ‘counter-sign’ the check. That is to say, the person whose name is on the check would endorse it or ‘sign it over to you’. They would sign the back of the check, and then you would sign it, and then the bank would cash it for you, or technically they would more likely deposit the check into your account and then give you cash up to the amount of the check’s value IF you have that amount of money in your account to ‘cover’ the amount of money they are handing you. That amount would likely have a hold against it in your account for a couple of days.The hold policy would be something your bank would decide. Some banks may allow up to a certain amount of money to be credited for the check immediately, not incurring a hold for checks up to some limit they set. They are managing their liabilities in this way, limiting the possible amount they could lose if the check, or the signature comes out as invalid.When it comes to whether a store or check cashing business would let you cash third party checks, that is up to how much risk they wish to take on, and their own policies for such things. At this point, a lot of places will say, no, that is too much risk, and they will say to take it to a bank. Think of it like this; for every party involved the risk grows. If you were to take your own paycheck to a check cashing business you would likely be signing the back of the check and handing it over to them, making it a third party check (you, your employer, and the check business) they would then be endorsing it too and depositing it. If that check were someone else's, signed over to you and then deposited by the check cashing business it would have 3 endorsements on the back, making it a 4 party check. If the "different name" is another person, then they can endorse the check, and then write that it is payable to you.  Then you can cash it.  Most banks will not require that "third party checks" be deposited, and the funds held for a few days.If the "different name" refers to you, (for example, an alias, maiden name or DBA name) then legally, you can cash it.  However, most banks would not accept a check for other than the name on record.  In that case, you could endorse the check with the "different name", make it payable to your regular name, and then cash it.  (Obviously, if you do this when "different name" is not you, then it would be fraud).

If i'm on my husbands account but my name isn't on his checks yet can i still write and sign the check?

Ok Soooo we JUST ordered a new 4 boxes of checks. And me and hubby just joined our accounts he's the main person. BUT i do all the bills and write out all the checks can i still sign the checks since i AM on the account even thou my name isn't on it OR do i have to have him sign them. That's what we were doing before i was on his account he would sign a book of checks we'd have it in the lock box and i'd fill it out to what it would need to be. Are we going to have to do this again till the 4 boxes are ussed up.???

First, who is the check made payable? If the check is made out to you, you can do anything you want with it. If the check is made out to him, he should endorse it with the the phrase "For Deposit Only" and they should accept it. If you want cash your name would need to be on the account.

Can a wife sign and cash a husband’s check without permission?

If the check is made payable to him and him alone, no, unless she has court-approved authority, such as in the case of incapacitation.
