Can a "Theft" be filed for unpaid Purchase Order?

A company placed an order with us via NET 30 and are refusing to pay. When we call them, we get transfered to one person in accounting, who then states we should be speaking to another person. The person who we are forwarded to is never at the office, does not pick up phone calls, and does not return phone calls. We have left at least 10 Voice Mails, can we file for Theft? That company has our merchandise and is refusing to communicate. Passing it over to collection agency would mean us waiting even longer and a possibility of not being successful. Has anyone ever had such experience, or would anyone know if this would be applicable for a Theft Case?

First, it is highly likely he does not even know you exist, so would you want to ruin him financially for something you mother did? Also, though she named him, in reality, 30% of paternity test come back negative, she she may not have really known who your father is.

As for your question, that depends on the state. Under the 1988 Child Support Enforcement Act, when the parent does not file for child support, the child can file after the age of majority for their state, and up to the limit for that state.

In the majority of states, that means up to one year past the age of majority, but New York and Indiana allow it up to age 21. In Mississippi, the age of majority is 21.

In Ohio and Michigan, it is up to age 23, and in Louisiana, it is age 25. In a few states it is not allowed at all.

The retroactive amount is also limited by state law, from two years in Florida, to 18 years in Ohio.

However, it still requires a judge's approval and Judge David Grey Ross, Commissioner of the Federal Office of Child Support Enforcement came out against the policy so many judges are unwilling to approve them.

In a California case, the children of David Bren, (age 18 & 22) were allowed to sue their father for $134 million dollars in retroactive child support. The parents were never married. However, since 1988 the father paid the mother $18,000.00 a month in child support. Unfortunately, he paid it without a court order, so it was a considered a gift.

My Ex has never paid Child Support?

Of course its not unfair.. the fact is you basically "loaned" him his share of the money all those years by providing for your children 100%.. and now he needs to pay off the loan , so to speak. My mother in law, had 3 children by he x husband, her kids are 40, 39, and 36.. and she just won a judgement a year ago for 125,000.00 that he x husband has to pay in child support.. if he had paid it years ago he would of only owed 30,000, but with interest it came to 125,000 and she was awarded it, and now she's forcing him to pay and she's 62 years old.. so go after him.. the fact is he had 3 children, the fact is, he should of helped support the children but he didnt.. and the fact is, he owes this money.. and i can tell u , if he owns anything house, car etc.. they will put a lein on all his assets, and he cant sell any of these assets until u are paid in full, and even if he dies.. those assets are liquidated and ur paid off before any of his family including a new wife get their share of it.. so dont give up.. no man should get away with being able to walk away from his children and his responsibilities.. u didnt climb on top of yourself and get ur self pregnant so why should he get to just go have a great life while u and your children struggled so hard.. hope he had fun in his youth cause his older years are going to suck paying the childsupport now.. :) but i also agree with the c/s enforcement worker.. i dont think u can go after him unless childsupport was established years ago and he just never paid it.. i dont "THINK" u can go after child support after they are of age if there was never a child support order established in the first place.. but if there was an order in place at the time of your divorce and he never paid, then go after him , cause u'll definately get it..

The child support was owed to your mother, not to you. She paid the bills. If she is deceased, there might be a civil claim you can file on behalf of her estate, but you would need to check with the State to see if that is an option. Child support has lots of specific laws that apply, and her estate may not qualify or it may be coming to her without you having to file. I am not an attorney, but I have personally seen child support claims carried against persons into their 60’s, so if the State says he still owes it, there may be some way to get it out of his estate.Your father owns his stuff and doesn’t owe you anything. After he passes, you could sue his estate to set aside the will. In such cases (if the estate is big enough), the heirs in the will may be willing to settle with you for a negotiated amount just to get the estate closed. As long as it is being challenged, they can’t get their part, and that can be a motivator to settle. But you have to have deep enough pockets to pay an attorney to pursue it. And there is no guarantee you would get anything.Your own success and happiness is the best revenge, so I would let it lie. You could get his entire estate and it won’t give you peace.

What happens if you do not pay child support and there is a court order to do so?

A judge ordered child support to be paid by my ex. The order was dated June 24th of this year. So far my ex has still not paid a penny of child support (three months after the court order was put in). He is already in arrears (my child is over a year old now). Is he going to get in trouble for not doing as the judge ordered?

Depending on where you live, you could go to jail, lose your drivers license, AND have the support directly taken from your paycheck before you even get it.

Husband was never served with child support papers, now he has to pay.?

My husband has a 22 year old son. When he divorced his wife, he was granted joint custody, but the child support was to be worked out between him and his ex wife. The entire life of his son, he had his son during the summer and paid his mother $400 a month during the school year to provide support for his child. Now the child is 22 and he is being garnished for $389 per month in child support arrears. My husband was never served, his check was never garnished, his taxes were never garnished or taken away, throughout this childs entire youth years, there was no triggers that would clued him in to owing any type of child support or of there having any type of order for him to pay. Now his child is 22, and here comes a order stating that he owes 35,000 in back child support, that he had no clue about. It depends. Where do you live? How old were you when you were disabled? In CA, if you were disabled while you were a child (under the age of 18), child support can be for LIFE. How do I know this? Because I have a disabled child. She is now 30 and I still get/pay (it’s the duty of BOTH parents to support a disabled child for LIFE) child support. Does it pay for all her needs? No. Do I pay a disproportionate amount given that I have 100% custody? Yes. But it helps lessen the never ending needs of providing for a disabled child while single. So don’t listen to other people until you’ve figured out the laws of your own locality.

When a child dies and the father is on child support, will the child support stop?

I don’t know how other people who have not been caught up in the child support hustle can answer this question like I have seen the real estate person answer but the truth of the matter is if the family court system can still hold you responsible for a child to be proven not yours after a DNA test do you really think they gonna let you off the hook because of a lil thing like death? The system is not set up for the benefit of the child! The system is set up for the match of dollar for dollar from the Fed Gov. it’s like getting caught up in the criminal system. Once you in you in it for life. They can come at you anytime with they BS and instead of color it’s a war on fathers situation. You a male you get fvcked plain and simple. Take you’re four days a month and just be happy with what they are giving you in the first place. So if the child dies you still on the hook for the remainder of the payout period. Look it up in the Fathers Lives Matter groups if you question what I have just revealed too you.

Why do I have to pay child support when I have never had DNA testing nor have I ever met or been in contact with or had any relationship with the alleged child?

My ex-wife and I got divorced when my son was 4 yrs old and I was in the Army. I had visitations to a point. The judge informed me that my child support would be $168. a WEEK! I got on the bad side of the judge when I ask, “Why so much?” He motioned me to step forward and placed his hand over the microphone and said, “Sergeant, You have a room, food and clothing that the Army gives you. You will pay the support for your son to have the same.” That judge died a few years later! I paid on him without regret until he turned 18 all through AFDC and it came straight out of my military pay without me seeing it. My visitation lasted til my Ex-wife met a real loser and moved to another state without notifying me. That was about two years later! I tried to find him through the courts and since I was paying through AFDC [a federal agency] the court told me, through my Attorney, that she would have to O.K. AFDC to give me her address. I found out when he was 18 where he was and went through family court for a ‘TERMINATION OF CHILD SUPPORT’ motion. When we went to court he was there. He told me that his mother had told him that I was killed in Vietnam. Since he received the summons to appear, he and his mother have not spoken.After court, I found out that I had a grandson and my grand daughter was on the way. We have gotten closer over the years, my son, his wife, my grand kids and now a great grand son. I met my Ex once lately and her response was, “Why couldn’t you let it be and stay DEAD TO US!!!”SHE’S A REAL BITCH from HELL !!!
