Can I Get A Post Office Box In New York If I Am A Resident Of Another State

Do I really need a registered agent in New York if I live in Albany and also have a NY UPS box for the business address?

In New York, you don't need a registered agent. To form an LLC in NY, the NY Secretary of State must be designated agent of the LLC for service of process. Essentially, this means that the Secretary of State is serving as your LLC's registered agent.Some incorporation/LLC formation companies will tell you that a NY registered agent is required by law; they either don't know the law in NY or are trying to trick you into paying for their annual registered agent service. Even if you hire a registered agent for your LLC, someone can serve process on your LLC by doing it via the Secretary of State. In such event, the registered agent is somewhat redundant.You will need to provide a forwarding address where the Secretary of State will forward papers to in the NY LLC Articles of Organization. This can be any address, even a PO Box. Just remember to check it often so that you don't miss papers with important deadlines. For one of my NY LLCs, I use the PO Box in the post office closest to home and check it once a week.I'm a lawyer, but not your lawyer. What do homeless people in the U.S. have as "permanent residence address" in their driver’s license?

There was a General Delivery address in San Francisco and I had no trouble getting an ID when I was homeless. The Shelter I was in would have allowed me to use their address too.The problem I had was as I started getting on my feet and wanted to open a Post Office Box so that I could file a provisional patent. I actually had to stand at the counter and refuse to leave because they were not going to rent me a box with the General Delivery address on my ID. I was almost in tears with fear, frustration, and anxiety as I was holding my money orders and printed applications (for the PO Box and a patent) and explaining that I was homeless and just trying to get my life back on track. I told them they were going to have to go ahead and call the police because I wasn't leaving without a PO Box or a booking number to show that I had done my best. The police came and I seriously thought I was going to get arrested even though I was being entirely civil. I didn't get arrested and I did get a Post Office Box by the time I left. Now can we start the debate over "Driver License" being called a "Driver's License?" It could be a Driver's Driver License. There are actually a couple of states that still call it a "Driver's License." Which by itself bothers me, but is not quite as bad as "Drivers License." To the best of my knowledge each license to drive is only good for one person. Correct? Arkansas, are you going to fix that?

U.S. Postal Service: Do I legally have to have a mailbox?

Nope. You do not legally need a mailbox. Any mail that you would receive after you remove your mailbox would be marked “NMR”. That stands for “No Mail Receptacle”. It would automatically be returned back to the sender. If you do this, put a sign up indicating that you no longer have a mailbox for USPS to deliver. We will handle the rest.A word of caution: IF you ever receive anything important via mail and you do not have a mailbox, it will be sent back. Do not try to go to the post office and try to get somebody to intercept that one piece. It will not happen and it will be a waste of time for everybody involved. Do not blame us for returning something that was important. If you truly do not have a use for your mailbox, feel free to remove it at your own discretion.I mention the above because I am a current letter carrier and a backup supervisor. Customers have done this in the past and I had to tell those customers (both as a letter carrier and a supervisor) that we are not responsible for any mail that was returned due to an endorsement of “NMR”.

You will be unable to obtain  PO Box in a post office in the US without:Being on hand to provide valid ID and a have a proof of residenceBeing on hand to sign the appropriate paperwork for the boxThere are regulations against people not applying person for PO boxes. These are in place to prevent such boxes from being fraudulently used. It is inadvisable to attempt to "circumvent" these regulations as the penalties can be somewhat severe.If you are seeking  US mailing address, you have several options:Purchase or lease a residential or commercial property in the US - This will allow you to immediately begin to receive both private and commercial mailings to this address.Use the service of a private mailing service - Unfortunately, as with the Post Office this will likely have to be done in person. However, you can begin immediately receiving commercial and personal mailings s soon as you obtain the box.Use the services of a private office company - While these  quickly fading with the increase in online services, most major cities have one or more companies which allow a business to "rent" their office space and use it to receive mail,phone calls,faxes,etc. They will usually open an account for you as soon as you give them  credit card or wire them  deposit.

Question: Can I use a PO box as a physical address in the US?It depends.If you live in a very rural area or if you live in an area with high levels of mail theft, you can use your postal mailbox address as a “physical address” on many non-government forms. For government forms, you’ll need to discuss your living situation or mail theft concerns with the particular department. They may allow you to do it…or they may not.If you need an actually physical address, but you don’t want to divulge where you actually live, you might consider using a paid mail drop. While they aren’t cheap, they do offer a measure of privacy if that is what you are seeking, questioner. They will give you a physical address that you be able to give anyone and where you can receive packages , if necessary.

Can a PO box be a legal business address in the US?

For tax reporting purposes in most cases a P O Box can be a legal address. There are a few IRS forms that specifically prohibit the use of a P O Box and in those cases you would need to have a physical address that you can use.Legal purposes, every state is going to require a physical address connected to an LLC. You have a registered agent with your Delaware LLC who is required to maintain a physical address in the state of Delaware. That probably serves your purposes, legally.Simply having a P O Box in a state will not constitute nexus or an obligation to pay taxes in the state.(**SEE UPDATE BELOW) The flip side of that is having a P O Box in another state does not allow you to avoid taxation in any state where you physically reside and work. Even if you reside in numerous locations through out the year with no real “permanent residence”.In fact not having a so called “permanent residence” can actually have some tax downsides. States can look at any number of factors to determine residency or partial year residency. For example if you maintain a California driver’s license or California voter registration, California considers you are a CA resident and subject to CA tax. If you spend one day working in CA, CA considers you at least a partial year resident and subject to CA tax. Also if you truly are itinerant, you can never deduct any business travel expenses.Having said all of that, CA is one state where I would not maintain a mailing address if you truly are not living and working there. I use CA for examples, because CA is by far one of the most aggressive states about claiming nexus and being able to tax you according to their state laws. Having a P O Box in the state will almost certainly guarantee a letter from the state wanting you to file a tax return in CA and pay tax in CA. Not that you could not ultimately win the argument, but I just hate for my clients to even get into a disagreement with any government agency because it incurs unnecessary cost even if you win.2018 UPDATE: As of 2018 several states have either enacted laws or changed their interpretation of existing nexus rules to say that a mailing address in their state does constitute nexus in the state. Most notability California, New York and Michigan are now taking this stand. My advice as of this writing is that you use a virtual mailing address or PO Box only in states where you reside or your business is registered as a legal entity.

A passport is a document issued by the United States Department of State requesting that a U.S. citizen be permitted to enter a foreign country. While some more repressive countries have required "internal passports" for domestic travel, we are fortunate that one of our freedoms is the ability to travel freely around our own country without restriction, including having to produce identification at state borders. (You should have learned this in civics class!) However, you do need a valid government-issued ID to clear security and board the aircraft, but a state ID card should work. Check with your airline to see what forms of ID are required.

Incorporation: Can I use my registered agent's address for my business address? (Instead of applying for a PO Box)

No, you should probably not use your registered agent. The terms of their agreement with you probably include a qualification that they will only forward legal process, state notices, and other "official" notices that they receive. There are possibly services that will also forward other mail, but they will do so for a fee,  and not for the $99 fee your registered agent charges for the basic service.NY (and all other states) require you to qualify a business in the state if you are conducting business in the state on a regular basis, thus subjecting the business to state taxes. If your business is in NY and that is where you operate, you need to qualify the business in NY. It doesn't matter if your address is in Delaware, what matters is where you are actually conducting business. Some businesses try to get around this qualification requirement by having an address for the business in Delaware or elsewhere. But that is not a very good idea as many businesses eventually either get caught or fess-up, and then you'll owe back taxes, penalties and interest. Not to mention that if you are knowingly maintaining a Delaware address as a means of avoiding tax payments there is a possible argument that you are committing tax fraud, which could lead to criminal penalties.So, you should probably just get an address wherever you are operating. Of course, you can certainly get an address elsewhere if that is convenient for you, so long as your business is qualified and paying taxes in whichever state where it is actually conducting business.Oh, and you should really have a lawyer with whom you can talk about this stuff.

Can i use a PO Box address to switch my Drivers license?

Okay i moved from North Carolina to New York can i use a PO Box here in New York as a residency address showing that i have mail and i am living here in NYS? Reason i asked is because i rent a apartment basement apartment and my landlord would prefer to not have any of my mail going up stairs. I also have My NC License SSC proof of bank statement with PO Box address and birth certificate is this enough to use to switch my license? i also can use my debit card which has my name on it.
