Can I Get In Trouble If My Dog Attacks Someone

Can you kill a dog if it attacks you?

Yes, you can kill a dog who attacks you- if you feel your life is in jeopardy, defend yourself and worry about the law later…. most jurisdictions allow self defense. See all the posts about fighting off a police dog for that specific issue. But, can you actually kill the dog?Not without weapons, training and help. Unless it was a mop dog or lap dog, of course, but anything over say 10–12 kg (maybe less) and you are in trouble. Thats how much a staffordshire bull terrier weighs, and although I love staffies, I’ve seen one take a face full of pepper spray and keep attacking, and he was not going to stop unless he was prevented from attacking by some brave soul, who happened to be the SPCA officer with a neck loop. The SPCA guy nearly garrotted that dog before he would stop biting.Dogs attack for various reasons- because they are insanely aggressive, territorial, food-/resource guarding, or feel their breeding rights/pups are threatened. When they attack, unless they have been trained to attack “properly” like a Police dog, they go for the kill, because they assume you will. Unless you know what to do, they will get you before you get them. Most have a bite force strong enough to break bones and tear flesh. They will fight until subdued but you will stop when you are hurt. Other dogs may join in if present. If the dog has been trained to attack people, you’re in serious trouble.Best thing to do is learn to read dog calming signals and tell if a dog is aggressive- and if they are, calmly and quickly go the other way.http://en.turid-rugaas.no/calmin...

Is it legal to shoot or stab a dog if it attacks someone?

During an attack where there's the threat of serous bodily harm, you are allowed to defend yourself and it would be legal.

After the attack it wouldn't be considered self defense, and would be illegal.

What would happen if my dog killed or attacked someone?

First the negstives.Assuming your dog was on the street when it happened, again it would depend on whether or not the dog was on leash. If he were, and someone attacked you, he’s probably be hailed as a hero. If the person was not threatening you, he would most likely be picked up by the local SPCA to be held until his fate was determined. If he was not on leash, you could be sued for damages by the victim and/or his family for not having a dangerous dog on leash. The fact that he bit someone would label him as vicious. A hearing would be held to determine if he would be euthanized.Inside your home or on your property, it’s a different story. At worst, the dog could bite someone who was invited, but was not threatening you. Then you could be sued for damages, but it’s uncertain whether the dog would be confiscated. If the person he bit wasn’t invited, then he would be considered as defending you and your property and probably he would not be confiscated. If you were at fault in any way, your homeowner’s insurance would likely pay damages to the victim. You could expect your premiums to go up as long as you have the dog. Please don’t let your dog bite someone.

If someone robs my house and my dog mauls them, am I liable?

You're quite safe from the law in this case, unless your dog is a canine psychopath. The only way you're responsible for your dog attacking, biting or mauling someone is if the victim can prove the dog owner was negligent. An intruder is someone who unlawfully enters a property with the intent to commit a crime. So under normal circumstances, burglars haven't got a legal leg to stand on if the family pet attacks them in your property."All dog bite statutes exclude burglars and other trespassers. Therefore the only way a burglar can recover compensation would be under the common law (i.e., stemming from English law and modified by court cases in the state having jurisdiction). The common law says that when a person has an animal known to cause injury because of a dangerous propensity, there is strict liability. This is the so-called "one-bite rule" but it applies to all domestic animals and all types of injuries. Under RARE circumstances, even a burglar can recover compensation."Source | Dog Bite LawMY THOUGHTSIt's quite usual for a dog to want to protect its human family and its territory. Most pet dogs have a bark that is far worse than their bite, but this often acts as a good deterrent against intruders. And dogs that do bite tend to nip and tear at clothing more so than flesh. If you have a dog that an intruder can prove to be a dangerous animal, then they may have a case. You use the word "maul" in your question, a term often used to identify a vicious or fatal attack by a wild animal or a dangerous and unpredictable canine. If a dog mauls an intruder to the point where they're in really bad condition, then they may have a case.

If my dog bites someone who trespasses am I liable?

Trespassing needs to be better defined. If you have a gate around your property and a sign saying to be alert of the dog and the mailman comes onto your property and get bitten, you are probably liable.Second case. You have an auto yard guarded by three vicious dogs, a sign warning intruders, and a padlocked gate. At two AM somebody with a bolt cutter breaks the padlock and enters your property in an attempt to rob you—and the dog gets to him. You call the police but you are probably not liable for the dog bite.

Can I shoot my neighbors dog if it attacks me on my property?

The answer really depends on where you are. In general, you can shoot anything that threatens your life or health as long as you didn’t provoke the situation that put you in danger. If the neighbor’s dog is coming onto your property and attacking you, you are justified in shooting the dog.Whether you should resort to lethal force in self-defense depends on the situation. At a minimum, you should consider whether you can make the shot without endangering other people with a stray bullet. Beyond that minimum, you should look for other ways to handle the situation before you reach that point. If you’re walking to the mailbox and a big dog grabs your arm, pulls you to the ground, and starts shaking you, you certainly have the right to defend yourself. If you have a gun on your person, you should draw the gun, put the muzzle against the dog’s chest, and keep pulling the trigger until the dog stops biting you. You should then call police and ambulance. After the ER fixes your arm and anything else the dog damaged, you should call your lawyer to sue the idiots who allowed their big dog to attack you in your yard. I have zero sympathy for people who allow large dogs to attack other people. If a dog hasn’t attacked but is harassing you in your yard, you would ideally ask the neighbors to keep their dog restrained. If they refuse to do so, you should talk to animal control. If the local laws don’t force the neighbors to stop their dog from menacing you or your family, things become cloudy. The situation isn’t as clear if the dog is menacing people but not in an actual attack at the moment when you fire the gun. Personally, I’d always favor the person being menaced. No one should have to face harassment on his or her own property. If someone has kids and a big dog is threatening family members, I understand wanting to kill the dog before the dog attacks a child. Some dogs can be threatening and menacing without an intent to attack. A neighbor’s dog used to bark threateningly at me whenever I went to the mailbox. He would circle me the whole time barking. Occasionally, I would become angry and run directly at him. When I did that, he’d run back into his own yard. Knowing that he would retreat from me, I never felt a need to escalate force any further.

Should dog owners be charged with a crime if their dog attacks someone?

I believe they should. As owners, we should know if we own a potentially dangerous dog and if we choose to own it, we're responsible. And should only own a dog like this if they are a strong alpha leader. We, as the public, believe you have control over YOUR dog so if something happens….HELL YEAH you should be charged with a crime! And the dog should be euthanized because you not only let society down, you let your dog down.I've been attacked by a dog at a dog park and the owner was no where to be found because he knew he had a dangerous dog and was responsible. So he got his dog and took off as my dog lays there with his throat ripped open bleeding and me bleeding from being bitten severely twice.Dog owners, let's be responsible if we choose to own a potentially dangerous dog. We're responsible for our kids, right?
