hi. i just got hired from a company 3weeks ago.. i accept the probationary contract coz i have to have a job right away to take over of my expenses coz i lived independently. however my previous employer wants me back for a regular post, before im only a casual employee there. i really like to grab the opportunity from my previous employer since i also enjoyed my stay there and i know that accepting theyre offer will help me towards my goals for my career.they need me on jan 2 2008. is it ok or possible for me to hand over my resignation letter on the spot or for 3 day notice period only? hope you can give answer to this thanks a lot.
I have a 5 month contract period w/ my previous employer and i finished the contract.by the way my previous employer is offering me a purchasing staff/buyer position. My position now with my new employer is admin. assistant.

Since left TCS after two months there as a fresher, and I received a bill regarding final settlement charging me for the bond amount of 48,000, so should I pay it?

You don't need to pay anything.Just because an agreement is notarized with a stamp paper attached, doesn't mean that it is defensible in court. In layman's terms, the stamp paper merely says that an agreement did take place. But if TCS were to take you to court for breaking it, the court will rule that this agreement is unconstitutional because it is in violation of your rights. Courts have already made this ruling before in the past, so a legal precedent is already set. The case would not last long.This is similar to how a law can be passed in the parliament but later if a petitioner challenges it in court, and the law is found to be in violation or in contradiction of other legal tenets, then the court can strike it down.TCS knows well that these agreements cannot be defended in the court. They are never going to take you to court, because they already know they'll lose. But making an agreement is not illegal, so they do it anyway. Simply because it scares and discourages less-informed employees from leaving before 2 years.What the government needs to do it make this agreement bullshit illegal and make people more aware about this widespread scam.I left my first company without paying my bond. In fact, I challenged them to sue me. Ofc, they didn't. At my next job when they wanted me to sign a bond, I told them, "You know as well as me, that these bonds don't hold in court". You should've seen the look on that HR person's face. But that wasn't a win for me... They reduced my monthly salary and told me that I would be paid 2 lacs together after 1 year, thus ensuring that I would have to stay for a year if I want my money. In fact, this is what most companies do now. TCS can't because they don't want to pay so much in the first place, which is why they resort to these empty legal threats.

Hi; I have a question on overlap in employment dates?

I worked with Company A and submitted my resignation after 18 months after i got an offer from Company B. Company A was not ready to releve me and was kept postponing my releaving date.

Meanwhile , Company B accepted to take me without the releaving letter from Company A and i joined them, a week later Company A accepted to give me the releaving letter.

Now i have a overlap of one week with my employment dates . (i.e) Company A gave me releaving letter on 10-May and company B gave me the joining date as 3-May.

Please let me know if this could create a problem , when i join my next company.

Should I take a project after joining the base location in TCS if I'm planning to leave the company in 2 months? Also, will it affect me negatively if I give my resignation letter immediately after joining?

If you're in TCS (or other services provider), it doesn't matter you're in a project or bench. You have to serve the whole notice period.When you resign , you suprisingly become a critical resource and they cannot let you go before 3 months( notice period).There will be a formality, where they (hypothetical ly) tried their best to retain the critical resource without giving promotion or salary hike or written confirmation of onsite(trap to destroy your technical career).If you have a job in hand, I would suggest you not to join TCS and get the offer from other company telling your present salary to them. You will get a good salary and that would be your first company. That helps when you again try to switch. This shows you are loyal to your company and you would be to the new one also.Moreover, best thing to do is getting a master's either from A level institutes either MS or MBA, otherwise, you might stuck in the office politics , you have to remind your manager even for a 50 rupee cab reimbursement that you took on Diwali holiday to come to office.Decision is yours.

Resign without notice period in CTS USA?

Hi,

I joined CTS (USA) 3 months back...I literally dont have any work in this project, I am just sitting idle for 8 hrs per day...hence I started my job hunt and got an offer from another company..

The new company is asking me to join them in 3 weeks time..Visa transfer is in progress (in new company) and will take 2 more weeks for completion..

Now the issue is that, I cant resign here immediately as I am yet to get my visa transferred to new company, hence I am planning to resign with just 1 week of notice (instead of 2 weeks).. Do you think CTS will create any issue due to this?

Note: I am an employee at will, its clearly stated tat I can quit with or without advance notice.
