Can I Go To Juvie For Missing Court Or For My Charges

Truancy charges? missing too much school.?

Well, the worst that is going to happen is that your parents are going to get dragged into court for not making sure you are in school.

I missed 127 days of school in one year. My parents went to court and were almost fined a ridiculous amount of money. I didn't suffer any penalty from the school or truancy officers...but when my mom saw the amount of the fine she punched me in the face. Ended up with a nice shiner and remembered to go to homeroom everyday before I left, that way I was marked as present for the day.

Of course, my teachers eventually called home and my mom found out I wasn't in school...I ended up dropping out and it was a really big mistake. I had to take placement exams to get into college, and I have to deal with "the look" when you say you have a GED. I did graduate from college as valedictorian so it doesn't really bother me, but it's something you should think about.

Going to court Nov. 13th for Truancy, what will happen?

How truancy is handled will vary based on where you are. I can tell you how my jurisdiction handles it but your specific state/county may do it differently. In our area, a juvenile who is charged with an offense that is ONLY a crime because they are minors are called "status offenders." These are things like truancy and runaway charges. They are handled completely differently than actual juvenile delinquency charges, which are the sort of thing that can lead to juvenile detention or formal probation. For status offenders, specifically truancy, my area files a court case in front of a circuit court judge. They usually result in having a review hearing every 90 days in front of the judge to see about the status of the case. If the juvenile is comply with the terms of the court (specifically for truants, attending school) then the case will be dismissed after a bit of time watching it. If they are NOT complying then the state can take temporary custody of the juvenile and place them in a facility where they will be forced to go to school on site. This is, however, only the way we do it in my area and it could be different where you are. Also, in my area juveniles are appointed an attorney for the process since its in court. You might try checking around your area for attorneys who do juvenile defense work. Most of them would probably outline the general process for you over the phone if you called and they'd know your specific area's practices.

Does a juvenile warrant (petition) go away when you turn 18 in MI?

The warrant stays active until the warrant is served. It won't matter whether you are an adult or not. In fact the judge may provide you with stiffer penalties if you wait and get caught as an adult. A juvenile runaway warrant would be a good example.

As a juvenile he would not have to sit in adult jail waiting on judge or bail money.

Warrants generally have radius restrictions assigned to them; if you stay outside that radius you won't have to worry about being arrested for the warrant.

Severe crimes generally do not have radius restrictions on them but yours doesn't sound like a warrant for murder etc. So as long as you never plan to return to the radius for which the warrant specifies, then you will be in the clear.

The reason they put radius restrictions on most warrants is because it cost the department a lot of money and police manpower to go get a guy that another jurisdiction is holding for them. They do not want to pick up a guy on a petty drug charge if he is 100's of miles away. Nor do they want to go through the expense if he is in another state.

So if you flee the state, you will most likely be fine. Its really depends on how bad they want you; and for small drug crimes you wont have to lose sleep over it if you are in another state or far enough away in state of jurisdiction the warrant was issued by.

This does not however apply to federal charges, say on a military base and a warrant is issued.

The best move though is to turn yourself in while you are still a juvenile and get this behind you.

If someone is charged with "attachment with a juvenile" what does that mean?

how odd
but theres no such thing
maybe ur wording is incorrect of the charge?

What Happens if I Miss my Community Service for Juvenile Probation?

So today I've missed my community service for my probation. My community service wasn't part of my agreement with the judge and court, my probation officer just sort of arranged these things for me on Saturday to go to. Again, it was never part of my plea bargain. I've missed one before and I got a violation for it. This time I didn't do it on purpose or on my own.

I'm a minor, and I cannot drive and I don't have any form of transportation of getting down to the community service other than my dad. My dad woke me up, got ready, then went back to bed. I've tried telling him to take me, but he simply won't. Now I'm afraid I'm going to get a violation for this and get re-sentenced. But it wasn't really my fault, I couldn't get there!

So here are my questions:

How can I avoid the re-sentencing?
What will happen to me if I get re-sentenced, will I go straight to a detention facility, or what?
What can/should I do now for my best intrest?
Will I have a second chance?
And how can I explain this to my probation officer so they can understand the nature of the situation and are less likely to put a violation in for me?

Thank you.

Going on the run on juvenile probation?

You miss court they put a warrant out for your arrest. This never goes away untill your caught and are forced by the courts to take care of it and probley will have additional charges. How are you going to support yourself on the run? Anyone who helps you will be charged with harboring a fugitive. Being under 18 you need a parents permission to work, unless you are emancipated, but you have to go to court for that and then you will be caught. And the courts will find you through your social security number. You need to wise up and face the consequences that you put yourself in.

What happens if I leave my town and state and skip court for a theft charge?

Well once the Judge has confirmed you aren’t dead and laying in a ditch or have an otherwise legitimate excuse for missing court via your lawyer (if you have one) than a Warrant will be sworn out for your arrest and will be entered into a nationwide database. This warrant will follow you anywhere you go, So if you are arrested in any of the 50 states or trying to cross the border into Canada or Mexico you will be arrested on your warrant and sent back to wherever the warrant was sworn out at.Once you are back in your local town custody I can assure you that you will NOW be deemed a flight risk and you will be given a no-bail condition and will remain in county lock up until your trial and will remain in county lockup until your sentence where the judge will either give you time served and let you out or will give you more time than you’ve already served but will credit you for time served.Running out on a charge as petty as theft when there is a chance you will get probation is just silly and not worth the risk donchathink after what I just explained to you?DON’T RUN YOU WILL BE CAUGHT!
