Can I Leave Without 1 Months Notice If No Contract Was Signed

How much notice do i need to give to leave my job?

As someone mentioned earlier, if you signed a contract you are bound by this, even if it's as ludicrous as this one.

If it was me, I'd give my notice in writing and then put in a sentence to the effect of "as per my contract, I am giving 4 weeks notice with a termination date of ____. However, I am more than willing to negotiate this, simply because it doesn't seem to benefit either party to the contract".

And it doesn't. Many companies will go ahead and pay an employee for those last 2 weeks and then escort them out the door the day they resign. There's many downsides for a company when someone who is bailing remains on their payroll, so if this way my company, I'd renegotiate that in a heartbeat. I have a feeling it's for long term employees who they have a lot invested in. They have nothing invested in you after one month.

But if they say 4 weeks for some reason, then you need to do it.

I had signed an employment bond for certain years, but now I wish to leave the company. What is the best way of dealing with this situation?

Although I am not a legal expert, a lawyer would better answer your question, but I can answer this on the basis of my knowledge. As per Contract act in India, such bonds are not enforceable, since they are considered in restraint of trade. In the past, many employees have violated such bonds and in such cases, companies have resorted to different means:Allow the employee to go, take no action - In this situation, you lose nothing, the company will discharge you.Allow the employee to go, hold his Salary - In this situation, they will not pay your full and final settlement salary. Probably you will lose gratuity, leave encashments etc. and your unpaid salary.Restrict the employee from going, sue the employee - In this case, the company will go to the court. It will be a very lengthy procedure. According to the past cases, the company will have to prove that due to your layoff, the company is bearing direct costs. Further, the courts would rule in favour of a company only if the terms and conditions mentioned in the agreement are reasonable. Having a penalty clause in the agreement makes it unenforceable since it is not a reasonable term. So generally the company will be able to recover training costs only. This option is exercised only when the employee is very highly resourceful or employee is at a high ranked position.Recommendation:In maximum cases, Option B takes place. So you need to plan your exit smartly so that your salary cannot be withheld by your employer. However, you are at risks only if you are positioned at a very unique post and there is no replacement for you in the market or maybe if your services are highly important for the company projects and without you they will not be able to continue the projects. Then the company will never sue you since the legal costs are too high to keep spending it on every employee who leaves. If you think your post can be replaced easily, the best thing is you may try writing an email to the company, mentioning a notice period and ask them to permit layoff. Mutual understanding is the best way to solve problems. One problem will be that, it will be difficult to get experience letter and employment relieved letter which is actually asked for by various companies, when you join them, as a documentary evidence.

Can my landlord ask me for 2 months noticed ?

Tenants have rights. I was given 90 days notice, but stayed 6 months. She can ask you to leave and give you the papers but you don't have to leave until she has taken out a court order to have you evicted. If you are in the UK, in order to be rehouse by the council you must stay in the property until you get evicted otherwise its classed and making yourself homeless and they wont help you. When you get the notice to leave take it to the council housing department and they will help you. They have a department that deals with private tenant's rights.

Can I shorten the notice period of my resignation?

As state on the contract, a 2 months resignation notice should be given. What if I want to quit my job now, can I give my company a 2 week notice or 3 week notice? I'm just afraid that if I do that, they will not accept my resignation letter. I've only worked for them for 1 month. I just don't want to quit without giving them notice because I will be bad record. My contract is 1year. But I will be leaving because i'll further my studies..

Since left TCS after two months there as a fresher, and I received a bill regarding final settlement charging me for the bond amount of 48,000, so should I pay it?

You don't need to pay anything.Just because an agreement is notarized with a stamp paper attached, doesn't mean that it is defensible in court. In layman's terms, the stamp paper merely says that an agreement did take place. But if TCS were to take you to court for breaking it, the court will rule that this agreement is unconstitutional because it is in violation of your rights. Courts have already made this ruling before in the past, so a legal precedent is already set. The case would not last long. This is similar to how a law can be passed in the parliament but later if a petitioner challenges it in court, and the law is found to be in violation or in contradiction of other legal tenets, then the court can strike it down.TCS knows well that these agreements cannot be defended in the court. They are never going to take you to court, because they already know they'll lose. But making an agreement is not illegal, so they do it anyway. Simply because it scares and discourages less-informed employees from leaving before 2 years. What the government needs to do it make this agreement bullshit illegal and make people more aware about this widespread scam.I left my first company without paying my bond. In fact, I challenged them to sue me. Ofc, they didn't. At my next job when they wanted me to sign a bond, I told them, "You know as well as me, that these bonds don't hold in court". You should've seen the look on that HR person's face. But that wasn't a win for me... They reduced my monthly salary and told me that I would be paid 2 lacs together after 1 year, thus ensuring that I would have to stay for a year if I want my money. In fact, this is what most companies do now. TCS can't because they don't want to pay so much in the first place, which is why they resort to these empty legal threats.
