Can I Make A Citizens Arrest Of A Police Officer

Can i make a citizens arrest on a police officer?

It should be taken VERY seriously, but most people accept the fact that police endanger people all the time in irresponsible fashion. We can thank shows such as Walker Texas Ranger and COPS for desensetizing us to their actions. They aren't supposed to carry vendettas, but sadly they do all the time. And usually the people who want to be cops the most were picked on while they were school-aged and are now out to "show the world who's boss". Therefore I wouldn't recommend it.

Can you citizen’s arrest a police officer in the USA?

To answer your question with either a yes or no answer, the answer is yes you can. But, there are several things you should know before jumping out there like Gomer Pyle and yelling “Citizens Arrest, Citizens Arrest.” In most states, if not all, for a citizen to make an arrest the crime must be a felony - no misdemeanor arrest or you just might find yourself facing criminal charges while the person you arrested is sitting home, drinking a beer and watching the NFL with his buddy.Secondly, if the person you arrested received any injuries during your arrest and is later found not guilty by a court of law, you may very well find yourself responsible for medical bills, not to mention the poor slob you arrested is suffering PTSD and will try to bleed you for the rest of your life.Next, yours and the public at large, safety. Let's say you go to arrested someone for a felony and he/she pulls out a 15 round 9mm and starts blasting away at you. Maybe you get lucky and do not take a round in the gut or elsewhere, but what about the little boy and girl playing in their own yard and take a bullet to the head, or that senior citizen coming home and takes a shot in the back. Or how about that high school student taking his girlfriend for a ride in his new car, take a bullet meant for you causing him to swerve into oncoming traffic and meets an 18 wheeler doing 65 mph, killing both the boy and girl and causing serious injury to the driver of the 18 wheeler. Who do you think is going to be held liable for those damages, not to mention how you are going to feel if say that senior citizen or that little boy or girl playing in their own yard dies from one out of the 15 rounds Billy Bad fired at you kills one of them. Was it worth it?So before you go racing out there to make a citizens arrest give some thought of everything that could go wrong. Chances are if you think about it, it is better to let the police handled any arrest.NOTE: Keep an eye out for my new blog “The Badge and Shield” starting around the first of Jan. 2019. The website will allow you to get answers to questions like this from local, county, state and federal law enforcement officers. I will be sending an invitation also to Interpol and you may be able to ask questions about tracking down and arresting criminals worldwide.

Can you citizen arrest a police officer in NYC?

Of course you can. You can inform a police officer that he or she is under citizen arrest. You can call the police and have an officer come out with the paperwork, which YOU have to sign. If the arrest is false, YOU are liable both criminally and civilly. If you use force to detain the officer ( which theoretically you can do ) you better be darn sure your citizen arrest will hold up in court. Otherwise you will also find yourself indicted for kidnapping, assault and battery, and various offenses against an officer of the law.So yes, but in practical terms you better have a video of the officer committing a serious crime. Thanks to Shay Katz for pointing out that in the real world, you’ll almost certainly be met with violence, possibly lethal, from the officer involved. My answer was to point out that it’s legal. It’s also very very risky.

Citizens arrest vs police arrest?

From what I've read citizens can arrest you for ANY offense they saw you do, (and not read you your miranda rights) even for infractions where the police cannot arrest you but at most write you a ticket.
Can the citizen always use force to detain you?
Is it illegal to resist citizens arrest?
How long can they detain you if the police never come?
Can they transport you without your consent?
I know I'm in the Twilight Zone but am just curious about these technicalities.

If you see a police officer breaking the law can you make a citizens arrest?

if you are 7'0" tall, 300 lbs, bulletproof and resistant to electrical shock, then yeah, sure. other than though, good luck.

What I would do is record it on video and give the video to the station. then create a website dedicated to shutting down corrupt PO's and post your video on there. invite other ppl to do the same thing and eventually ur site will garner attention and create an outcry from Civil Rights groups and the stations will be pressured into cracking down on bad police, because most of them aren't gonna fire a PO for breaking "the law". To them, the law is something that only applies to other people.

In Australia, can one make a citizens arrest against a police officer?

This is what the law is relating to a citizens arrest in Australia (NSW), so I think you'd have to be very, VERY sure a police officer was clearly breaking the law if you were to attempt it against the police. I'm guessing that in this case you would be in breach of the law though I really don't know. All States have a legal basis to make a citizen's arrest. In NSW it's under Section 100 of the Law Enforcement (Powers and Responsibilities) Act 2002. It reads:A person (other than a police officer) may, without a warrant, arrest a person if:the person is in the act of committing an offence under any Act or statutory instrument, orthe person has just committed any such offence, orthe person has committed a serious indictable offence for which the person has not been tried.A person who arrests another person under this section must, as soon as is reasonably practicable, take the person, and any property found on the person, before an authorised officer to be dealt with according to law.http://www.mondaq.com/australia/...In this recent case a transit police officer got away with doing this to a 15 year old girl who hadn't payed for her train ticket and punched him in the face, citizens are currently extremely pissed off that she was charged and he wasn't.Video of incident included in this article -Girl evading train fare slammed on back by officer
