Uh, the whole point of trademark is to keep you from using the name yourself if there's already an operation out there with similar characteristics and the same name. There can be some situations where if you're in different markets, you might still be able to use it. For example, someone might trademark a name for a chain of hair salons in a particular region, but if you're not operating nearby and there's not likely to be any consumer confusion, you may be able to use the same name yourself elsewhere. Anyway, it's unlikely you'll be able to register.

What kind of fonts can I safely use while designing logos?
When designing logos you can safely use any font really if you are using a program like illustrator, Photoshop, Corel Draw, etc.In those programs you can convert the type to outlines (curves in Draw) which makes them no longer a font. When creating a logo, you want to make sure, when it is finalized, that you don't have to keep recreating it. It is an identity and should be treated as such.After creation, make a vector and raster file of the logo to use for specific media mediums.However, always save the original (native) file without the text converted just in case you need to tweak it in the future or happen to lose all existing art of he logo.So choose the font you want and looks best.Worry about font issues when designing newsletters, brochures, flyers, posters, etc.
If you have a registered trademark, do you have to use ® in your logo?
The (R) signal is a message to the general public that a particular trademark is registered and is protected under the provisions of Trademarks Act. The symbol TM means that the mark is pending for registration. The former gives statutory rights and the later gives common law right.Use of symbol (R) is a privilege and not an obligation. Which fonts can I use for logo designs?
All fonts that are bundled on your computer with the Operating System and Software come with an End User Licence (EULA) those will explain the use you can put them to. Almost any typeface you buy will also have a EULA and will permit you to use them for commercial work. Some of the fonts on sites like dafont are free for use commercially, most of them are free for personal use only (there is a small notice next to the download button). There is a variety in the quality of these fonts (some have very poor kerning, poorly drawn, reduced character set, no numerals etc.). It is not unusual for logo designers to use a commercial typeface and adapt it to suit the purpose and appearance of the design, some will not bother – and that can be to the detriment of the design. It is rare that most designers are actually capable of lettering a logo from scratch (type design and lettering are very specialised).
