Can I Sue A Company Because They Gave A False Statement When I Was Fired

Falsely accused of stealing and fired from job?

I would file a police report. Legally, the accuser, in this case your former employer, has the burden of proof. That mean, they have to prove of what they are accusing you of, otherwise they are making defamatory statements that can tarnish your reputation. If this defamation causes you financial burden, like losing your job, you can sue them. Hopefully they wrote you up, this mean it is libel. If they only verbally accused you, this is known as slander. Either way, get a police report written up, call a lawyer, and get employment compensation and get them to retract what they are accusing you of.

If you think it may be discrimination, call the Equal Employment Opportunity Commission at 1-866-408-8075 or visit their site at www. eeoc.gov

My Ex filed false police report and had me arrested. Should I press charges against her.?

The police arrested me based on her lies. I have all I need to prove that things she said were not true. She threatened to overdose on pills when we broke up. I was going to have her baker acted if I felt she was serious. I wanted to talk to her to see if she was. She asked me to follow her to another place to talk and I did. She then contacted police while I was behind her vehicle and told them I was following her and she was afraid of me. I was arrested. I can easily prove she lied with text messages but I don't know if an arrest would drive her to harm herself. The break up and the arrest may be too much. But on the other hand, I have to defend my reputation. I was arrested for "Stalking". I have no desire to be with her and was not wanting to talk to her to reconcile or attempt to harm her. She did give the police the impression that I was violent and threatening. I'm the complete opposite. I was fired due to the arrest and that upsets me. But I also don't want her to make an attempt on her life.

Can a company fire me not having a drivers license when the job description never stated it as a requirement?

My bosses's approaches me yesterday and said that i cannot work here due to not having a drivers license, just a learner's permit. This was not stated in my offer letter or the job description as a requirement. This is also not stated as a requirement anywhere on the compay's site or on any corporate documentation. Is this legal or can I sue the company for discrimination? What's the law?

Former Boss tells everyone i'm fired, but i quit?

I wouldn't concern yourself about the letter of resignation, because an employer can just simply deny you ever gave them one...so don't think that you made a mistake by not giving them one.

Here is what I would do if I were you:

Since Kinko's specifically told you that ONE of your references said you were fired, then you need to find out which one it was.

You need to call, AS IF you were verifying employment for yourself (just say you are calling from the Walmart HR department, McDonalds, just make up something), and ask them first that you want to speak to someone in HR that can verify employment.

Be very professional, very official...these people know the drill. Ask if you are speaking to the correct person, and then just say that you are looking to confirm dates of employment.

They will give them to you. DO NOT ask if "you" were fired...ask if "you" left voluntarily or involuntarily...and see what they say.

GET THE PERSON'S NAME FIRST, before you start asking questions...that is another standard procedure...they will tell you...that way you know who is giving the information out.

As soon as you have the information confirmed of which company is giving false information. Hang up, then call back and ask to speak to the Director of Human Resources, tell them you are aware that there is false information that is being communicated, and THAT IS slander.

Now, keep one thing in mind:

If you resigned and did not complete your notice, they will report you as being fired.

Your mother is incorrect, they don't have to offer you your job back...there is no such law.

However, if they have you down as being fired in error, then you sure can collect unemployment.

I was fired from my job and admitted to stealing, what can they do?

Ok so I was working for a major retail company and was a cashier. I recently was let go because they said they had me on camera.. The LP manger called me in his office and sat me down and asked me to be honest with him and me letting things slip out the door without the customer paying for it.. I couldn't remember me doing such a thing so I told him there was a good chance that could have happened( Seeing as I had alot of customers come through my register in 2 years with being with the company) I had admitted to knowing one time I had missed a drill a customer was trying to purchase and didnt say anything and watched the customer walk out the door with it.. Then he had asked me if I ever stole a soda from the soda machine, I had told him no but maybe I forgot to pay for at least one.. Then he asked me if I ever stole money from the cash draw. I had told him no. Only a few times I have taken a dollar out for a snack out of the vending machine on my break but I always paid it back the same day..
I know this story is confusing and it is..

After telling him all this he wanted me to write a statement of everything I had told him.. Like an idiot I agreed, simply because I thought my job was in danger and I felt if I was honest they would let me off with a slap on the wrist.. So I wrote the statement and then HE TOLD ME, to write that I would agree to pay back all that was lost, and again like an IDIOT I DID! So they sent me home and said I was suspended until someone would call me, well the next day some had called me and told me to meet with them at the store, I went in and they gave me my vacation time and personal time owed to me and sent me packing (Which I wasnt surprised about).. But now my question...

Can the company or will the company come at me with any lawsuit making me pay back any that was lost.. I mean they said they had me on camera, which I never saw the footage.. i Also wrote and signed that I would pay back what was lost.. They never said anything the day they fired me.. So should I be worried, should I expect a letter in the mail..

Someone please help me make sense of this!!

Thanks!

If a candidate has provided fake documents of their previous employment, what action can be taken by the company?

This happened with one of my colleague few years ago who joined a reputed MNC in Bangalore. He got fake documents from an agent who ensured that if any verification happens he’ll handle it.But to his bad luck when background verification started at same time multiple fake document rackets were busted by cops over here due to which the agent ran away.My friend himself told the HR about it thinking he’ll be caught anyway. HR called him in person and asked for the resignation the very next day. That is it. He resigned and soon after joined another MNC.So only thing they can do is either ask you to resign(most likely) or may fire/blacklist from that specific company only in worst case.

My husband recently was fired and wants to sue for wrongful termination. The problem with this is he wasn’t wrongfully terminated and he wants me to lie and say his boss sexually harassed me. What should I do?

Please don’t do this. It would be wrong. You will be interrogated alone by lawyers who have spent years honing their interview skills in order to get the truth out of a person. It won’t just be about your first statement about being sexually harassed, it will be about the history of your existence as a woman. They will know in the first hour of grilling you that it didn’t happen. False accusations of sexual harassment are against the law. You could be charged. Right now, you have done nothing wrong. Don’t change that.Keep your information to your husband short and clear. “I won’t do it. I could be charged for what you are asking me to do. Just go and get a new job.”Then refuse to discuss it further except to repeat yourself.Your husband is in panic mode. He knows he screwed up. The panic will clear soon. Just keep the message short and clear. If he gets outrageous, leave for a few days, but have no part in something illegal.

Can I sue somebody for calling me a racist?

You would lose such a suit here in the US. Calling someone a racist here is a statement of opinion. Opinions are protected. However, let me give you a different scenario where you might have a chance to succeed.Someone claims you called a black man the n word. He writes on Facebook, “I saw Asker walking down the street, and all of a sudden, he called a black man the n word.” He doesn’t have to call you a racist, he will cause other people to reach the conclusion that you are.The post goes viral. People start sharing it all over the place. They call your employer and complain. They spam the employer’s Facebook page and Yelp page with negative reviews, insisting that you be fired. Your employer decides to fire you, because it doesn’t want to have a racist working for it. Or even if it believes you aren’t racist and that the person was lying, it simply doesn’t want to deal with the trouble, so it sacrifices you to the cause of protecting its own reputation. Now you have had someone make a false factual allegation about you which has caused you actual damage. It is conceivable that such a thing could lead to a successful claim for defamation, depending upon whether it meets all of the requirements for the appropriate state law in question.
