Can I sue someone for putting false accusations about me on Facebook?

Currently, I am marginally involved in such a case within the iurisdiction of 2 US-american states:Both parties have a facebook page related to their professional life, and a considerable count of customers is following those pages. The slander going on from one party has indeed at least the potential to cause financial damage, as well as big damage to the reputation of the (non-profit) victim.Standing up against the slander lead to the FBI getting involved. They investigate the case, and they have already taken legal action in so far that they ordered the alleged party to cease any more referrence and involvement with the victim on the page in question. The case is still pending, because the alleged party seems to be part of a troll network and is suspected to have commited many more criminal acts on the internet, but it shows that US law enforcement has begun to treat things as seriously as they are. In Florida can you sue someone for false accusation to DCFS?

An ex-wife called Children & Family Services to make false accusations just to stir up trouble with ex-husbands new girlfriend & her family. All charges were proved false and unfounded and the case dropped, with apologies from 2 counties. Can we sue her for Deflamation of Character, or whatever, for the minor she accused, his parents, sister and the boyfriend. It was 7-8 weeks of pure hell and embrassment for all concerned. She has a pretty bad past and was trying to make us pay for her stupidity. I would like to know if Florida laws would let us sue her or something for what she did. We have only lived here since August 23, 2007 and less than 2 weeks later she called DCFS with her lies. We are just courious because this has never happened to us before and she should not be allowed to do this to my son, my husband, myself, and my daughter and her boyfriend, and his kids. Any answer or help would be appreciated in this mess.thank you for your help

Oscar, you sound like me in someways. I don't like to be accused of things I didn't do, and will go to great lengths to prove I am correct.

Yes you can sue him or her. You can pretty much sue anyone you like. But it doesn't mean you are going to win. Chances are you are going to lose. And since you are the plaintiff, the burden of proof is on you. It won't be an issue of whether or not you damaged his car. You will have to prove, to the judge's satisfaction, that the person maliciously slandered your name. If the guy believes you did actually damage his car, even if you know you didn't, but he believes you did then there is no malice.

In other words, you would be taking a day off work to sit in a court room. You would lose wages for that day. And if the defendant wins, you could end up paying his court costs. He may also use this as an opportunity to sue you for the damages he believes you did to his vehicle.

My advice? Let it go!

In most states, reporting a crime is HIGHLY protected speech. In some states, it is referred to as the "litigation privilege" and also protect you from being sued because of your testimony.

Because the claim would be based on state law, you should really speak with a location attorney instead of relying on the advice in this forum. Your potential claims are defamation and malicious prosecution.

Like all things, it depends. Two of the factors:

-How did this person falsely accuse you. Did they make some off-hand remark about you? Or did they make a big campaign about it (personally telling people false things about you, etc)
-How much damage did it do (to your psyche, reputation, etc). Are people just teasing you a bit more, or has your ability to do things been impaired by these false accusations (ie cannot coach Little League because you were falsely accused of child molestation)

You probably can't sue unless 1.) you can definitively prove that the allegations against you are false and 2. they have severely impacted your mental health, your ability to get a job or make a living, a court decision against you, or some other SIGNIFICANT way

Can I sue walmart for false accusations of shoplifting?

I was in a walmart store earlier today getting WIC items for my son and getting a prescription. After I got my WIC items it still had not been the 30 minutes the pharmacy told me to wait before coming back. So I went to the register and purchased my WIC items (when you purchase with WIC they do not give you a receipt because it goes to the federal office) it was raining out side so I decided to go have a seat at the pharmacy and wait for my presentation. After about 45 minutes. I received my prescription and went to leave the store. As I was walking out the door. ( I had not made it out side) a man runs in front of me and yells stop. I ask what the problem was he said where is your receipt. I explained to him they do not give a receipt for WIC items. ( He never acknowledges himself to be a walmart employee or security). At that time a manager appears and askes where my receipt. They harass me infort of customers until I am at the point of crying. Then they walk me to the front of the store (in front of everyone) and continue to harass me about stealing. They never took me to a back room or anything. Just kept me there in the front of the store crying and saying I did not steal anything. The cashier I had been checked out by was no longer there so I had to figure out which register I was at so they could see the WIC vouchers to show I was noy lying. They stopped the present cashier while she was checking out other customers and made me stand there (still crying) while she said in a very loud tone "we have a shoplifter who claims she was checked out here earlier". Infront of other customers and some people I knew. That ruined my reputation. When she opened the register I told her my sons name because thay was the name on the voucher. Then she asked to see my ID so I gave it to her. Then she said I am not sure if these are yours because you have a different last name ( I was not married when I had my son so I gave him his fathers last name).

Can you sue someone that has falsely accused you of child abuse?

I have relative that I can't stand. This person to get back at me became close to my wife and alignated her. Our marriage fell apart and she divorced me.

This same relative had my young daughter draw dirty pictures of me and called the state social services. My parental rights are now threatened. My entire family knows this is BS and will testify on my behalf if necessary. If my attorney (who knows this is case is utter crap) can prove that that this was coached or proded out my daughter can I sue her? i think this will be the only thing that might stop this sick and reckless witch HELP!!

false allegations about : criminal mischief, harrassment, and to DYFS? Also for missing work due to these allegations? As well as paying for a lawyer also because of these allegations? please give me something i can sue them for! they will not get away with this by any means!!! I have proof of them harrassing me..can i sue them for that?
