Can I sue the Sheriff's Office for selling my property to pay for someone else's fine?

No.. you can't sue the Sheriff's Department. Do you think we're all dumb? If a notice of someone else's fine had been sent to your address, you would have contested it as soon as you received it. You wouldn't have just sat around and waited for the Court to order that the Sheriff's Office seize your property and sell it for non-payment of a fine.

okay my father was murdered in 2003. The Lumpkin Co. PD. had had evidence against a person, ( like had an undercover cop tape him) stuff at the scene. You know the usual. and then when it came time to convict the guy. The Sheriff's Department lost ALL the evidence! And the guy was found innocent! (T_T) and some have told me that I could sue the Department! No body has told me I cant, but I just wasnted some asurrity before I called a Lawyer. So what do you think?

I need to know before Monday and its Sunday and 10:46 p.m. right now! So please someone help me!?!

Also there were some rumors going around that the "accused" guy's Step Dad Payed the P.D to trash the evidence. < but i dont think that would matter. Or would it? >

bucks?,serve them papers and summonses yourself,pay fees to city clerk,,maybe the party you serve on is the city attorney,,the county or city has a municipal library so you can look up cases & precedents,bring a portable scanner/printer to copy pertinent poop.
If big bucks in damages/negligence was caused,you need an "ATTORNEY",a real legal eagle who wants to get paid too.

Who has the authority to arrest a sheriff?

In the State of Alabama the only person who can legally arrest a county sheriff is the coroner for that county. No police officer, deputy sheriff, state trooper, or any other sworn peace officer has the authority to arrest a sheriff.If Officer Smith stops a car and the driver is the county sheriff who is drunk, Officer Smith can legally detain the sheriff until the county coroner can get there to place the sheriff under arrest. If officers were dispatched to a domestic violence call at the sheriff’s house and found probable cause to arrest the sheriff for domestic violence, they can legally detain him on scene until the coroner can arrive to legally arrest the sheriff.Even if a warrant of arrest is issued for the sheriff, the coroner has to execute it.

What can I do, Sheriff's Dept. did not & will not investigate crime scene. They assumed, ruled, & closed case?

The incident happened 6/16/07 in a very small Texas town (pop. 3000) about 2 hrs SW of the DFW area, inside my dads house. There was only 2 people involved, no other witnesses saw what happened. The lady was shot in the right arm and lived, my dad died of a contact wound to the right side of the head. They ruled it assault/suicide. BUT, they did not fingerprint the gun, no forensics, no ballistics, no verification, no GSR test on the lady, the GSR test on my dad came back negative. I have done my own investigating and found a lot of questionable things. The ladies story of what happened holds lies and has changed as she told it to different people. I've taken all my findings to the Sheriff's Dept and to the DA, they refuse to investigate. They say There is not enough solid evidence to warrant a re-investigation. This is my point....there isn't "solid" evidence "proving" what happened because the Sheriff's Dept. failed to do their job. They don't even have proof to back the ruling. So, my family is left wondering...was this suicide or homocide? They did not rule out any other possibilities. The DAs office says they have to look at the probables, not the possibles. Well, I think it is total BS and I refuse to just sit back and accept it. I've been told that a Sheriff's Dept answers to no one, except their citizens and they are immune from being sued. This can't be true...that would be saying that a Sheriff's Dept. could do whatever they want and get away with it. And I have seen cases and stories on the web of people suing Sheriff's depts. So what gives here? What else can I do? I can't afford to hire a private investigator or an attorney. I need help from someone who still cares more about truth and justice, rather than money. Are there any professional investigators, lawyers, law enforcement or citizens willing and able to help me seek the truth and find closure with this case. I am open to any suggestions, Thank You

How would I go about suing the Sheriff's Department?

Ok, so my fiance is an inmate at our county jail in Ohio. He's been there for about 4 months now and the entire time he's been there I've been running into numerous problems with the deputies. Every time I go in to visit him they threaten to ban me from visitaion for allegedy wearing revealing tops (in what century is a modest tank-top considered revealing? My grandma wears skimpier tops then what I'm talking about) and saying that its causing an issue with the other inmates when none of them can even see me the way the booths are set up. They've also taken to reading our mail ( it clearly states in the Inmate Handbook that they cannot do that nor keep him from recieving letters as long as there is no contraband or nudity in them, and they take my letters away from him on a regular basis calling them contraband) some of the guards have even made obscene comments to him about the contents of our letters. Its disgusting.

I know it sounds like I'm complaining about nothing or that I'm making it up (which Im not, this is a very real problem), but this is actually becoming a serious issue because I have to go there twice a week and go through this. I really feel like they're singling me out as I have never seen or heard of them treating anybody else like this in the entire time I've been going to see him.

It makes me feel like I'm some filthy streetwalker or anything. Its to the point where I dread going up there because I always come home crying. I dont go in there with the intention of causing a scene. Yes I want to look nice for my fiance, but I dont think my appearance is exteme enough to warrant this kind of response from them.


So my question is, is this grounds for a lawsuit, and if so how would I go about doing this? Would it be considered harassment, emotional distress, or something else like that? Im pretty clueless about the legal process lol So, if anybody has any ideas I would love to hear them! Thanks!

Cops LOVE throwing their weight around and act rude as if they can talk down to anyone... even those whose taxes pay their salary. But, you didn't handle the situation too well, either. Do you think the cops would DARE use that tone with say, an attorney? Or with some influential person?

The cop obviously over-reacted but don't make matters worse by also overreacting and stressing yourself out unnecessarily. YOU are not doing yourself any favors by ALSO over-reacting. I KNOW firsthand about Fibromyalgia and its many effects and how one's emotional state can trigger an episode.

No matter what you said, the cop was determined to give YOU a difficult time. Best course of action would have been to thank him for bringing your child home to you, and saying you would deal with the situation. And once your child was inside, all you had to do was close the door.

Whenever a cop has tried that "what if" routine with me, I've always said, "I don't deal with 'what if' scenarios, suppositions or hypothetical situations or engage in idle banter; I deal in facts." First thing, I make certain I am correct and I won't deviate or digress or let the topic go astray.

IF you want, place a call to the precinct and ask (and insist with a firm tone) to speak with the Precinct Commander; they'll try to switch you over to the desk sergeant who acts as "interference" for the Commander. IF you get to speak with the Commander, explain the situation to him as calmly as you possibly can and let him know you do not appreciate condescending rudeness from those who depend on your taxes for their salary, particularly in front of your child. (IF the Commander suggests that it was good so that you could use that to discipline your child, tell him/her that you do not need lessons on raising YOUR OWN child after the cop went to the 8-year old who sold your son the BB rifle and did not scold or discipline or speak condescending to that other child's parents).

Oh, by the way, forget the $4 and the BB rifle; don't even mention it because it makes you appear as petty. EVEN BETTER, drop the whole thing and don't let it eat at you. Really.

I don't blame the police at all. Your going to consider suing them over your son pointing a gun (I don't care if its a BB gun) at someones house. Do you have any idea how many people get shot at because they hold up "fake" guns. The people on the other end have NO IDEA if its real or not. So, he's 11? So what. Do you know how many 11 year olds have REAL guns. Get you head out out of the clouds and see what is really going on here. Stop blaming the police for your lack of supervising your own child. And your medical excuses have no bearing on how to raise a child. With parents like you, no wonder the jails are overcrowded. Please, by all means, take the department to court, it might be good for you to see where he is going to end up in a few years if you keep making excuses for him. Plus, the judge will side with the police. Trust me on that one.

I have a "real gun", legally. If I ever pointed it at someones house, or at another person (outside of the line of duty), not only would the police take my gun, I would loose my license, and be out of a job, and possibly face real time. Just because you have something LEGALLY doesn't mean you can use it in an irresponsible manner.

How do you sue a police officer for false arrest?

Yes, I agree with Kurt, you most prove 100%  the arrest  not justified! You can even sue  if your convicted  of the arrest, as long as you can prove and have factual undisputed evidence that would have proven your innocent if presented. It's unfortunate that now days your "guilty until proven innocent" and without a attorney who will fight to prove this. innocent people have their lives ruin by officers and prosecutors everyday. Most Americans who have been falsely arrested and convicted couldn't  afford  a attorney and were at the mercy of a public defender. Although some will fight for their  "innocent" clients most just convince you to plea out violating your rights. Remember it's  Innocent people who need attorneys, not the guilty ones. If you think your rights have been violated and you are one of the  innocent, then contact the ACLU and they will decide if you have a case. Good luck.

I think i need a lawyer to sue a jail..... Can anyone help??

August of 2009 I was arrested along with my girlfriend after an argument. I spent 48 hrs in Haywood County Jail in Tennessee. When I was booked I left a ring, cellphone, wallet, and things of that sort with the booking officer. On the day that I was released everything was in my bag except for my ring. They wanted me to sign a paper stating that I received all of my property but I refused. I have a statement from the officer saying that I did not have my ring and it was in the system that I had it when I came in. Since then many calls have been made to the jail. They have told me many times that I need to take a lie detector test and they were supposed to set one up. After not hearing from them for a while I called the sheriffs office. They made a report to the D.A (which the jail said that they did) and said that they were investigating. Now, no one is returning my calls and I feel like I am getting the run around! What do I need to do? Also, I am now not working. Can I sue for a lawyer as well as my ring?

Someone please help me
