Can I withhold rent if there is something broken with my apartment that i have asked my landlord to fix?

Yes you can! When you with hold rent the send you a court notice, take the proof (pictures, letters saying you called to have it fixed and whatever else proof you have) with you to court, tell the judge the reason show the proof and that they didn't fix it and that you asked to have it fix and nothing was done. If the judge sees it in your favor you won't have to pay the rent until it gets fix (he will order then landlord to fix it), and you won't have to pay the late fee because you had probable cause, but if he doesn't see it in your favor, you'll have to pay the owed rent money right away and possible the late fee

How long can you typically go without paying your apartment rent if you got a 3 days notice to pay the rent or get out?

I assure you that not paying your rent is one of the worst decisions that you can make. Your life will not be the same after an eviction. It can be a very traumatic experience.Every state is going to have slightly different eviction laws but here in Ohio my company has a very large rental portfolio in the Cleveland area and this is how we handle tenants who do not pay rent.Rent is due on the 1st.Rent is late on the 2nd.We call tenants 3x day from the 5th through the 10th.We put up 3 day notices on the 10th.After the 3 day notices we file for eviction. Once we file we will no longer accept rent. At this point the non paying tenant can't pay or get out of the legal ramifications of their actions.We win the court eviction and get a write to regain possession of the property. The eviction remains on your record for life. It will be incredibly hard if not impossible to find another landlord willing to rent to you.We send in the bailiffs (guns drawn) to the home. If you do not open the door they kick it in and forcibly remove any occupants living in the home.Everything that the tenant owns is placed on the curb by a moving crew. They can clear out an entire home in about 2 hours. They are not vary delicate with your possessions. Everything stays on the curb until 5pm. Scrappers and thieves usually come by and steal anything of value. At 5pm we bring a dump truck and load up everything that is left and take it to storage. After 30 days in storage we take it to the dump.After all of the above a non paying tenant can also expect the following to happen.We take you back to court and sue you for back rent, legal costs and damages.We garnish your wages until all debts are paid off.As you can gather from everything above being evicted is a terrible experience that is 100% preventable by you. Can I break the contract without paying the two months rent notice if I find mice in the apartment?

The proper thing to do if you find mice in your apartment is to ask the landlord to get rid of them. The landlord should call in a pest control company. This company should be able to get rid of the mice. You should also accept some responsibility for making your dwelling unattractive to mice by making sure that all food is kept in sealed containers and that you keep the place very clean.Also, it might help if you read your lease. This is the document that lays out what the landlord’s responsibilities are and what yours are. If you want something from your landlord that they are obliged by the lease to provide, then ask for it in writing. If the landlord’s response is inadequate, complain in writing. That way you will have documentation if you are ever sued by your landlord. You are always responsible for paying rent while you are living there, but if the landlord fails to provide basic necessities like a vermin free dwelling, you could argue that this violates your lease and leave whenever you want.As a practical matter, it probably isn’t worth the effort for your landlord to sue you if you leave before the end of the lease. You might not get your security deposit back, but you could deal with that by just not paying that portion of your last month’s rent. You won’t get a good reference from this landlord, but perhaps you won’t need one to find another place. If you are planning to leave, you should line up a new place before giving any notice to your current landlord, so you really aren’t in a position to use this landlord as a reference anyway.

Land lord entering my apartment?

Well today I was given a 24 hour notice that the land lord was coming in to check out my apartment.
Cool. I don't want to say no, but what is a lender inspection? I just moved in here a week ago so I don't understand why a lender inspection is needed so soon.

Secondly, like I said I just moved in, I don't have time to get everything unpacked because I work for a living so boxes are stacked up everywhere but otherwise it's fine. (Theres boxes and furniture, and enough room for a walk way to the bedroom, the bedroom has clothes everywhere...Will I get in trouble for this?

Lastly is this actually legal? I thought they had to ask if they could enter when I was not home or schedule a time when I am.

I'm actually very territorial and the thought of my land lord with random people checking **** out makes me pretty cross so can I put my foot down and tell them to wait until I get home?

My apartment complex won't give me a signed copy of my lease, what can I do?

You were saying two things. You're saying that you need a copy of the lease, to see what it will take to break it early. And you're also saying that you don't have a signed copy of the lease.These are different problems. If you need a copy of the lease how much is asking for a copy of the lease, they should have the copy with your signature on it and they can send that to you. If you want their signed copy of the lease, why? The lease needs to be signed by both parties for it to be valid, if it is not signed by both parties, it's not valid. So you should be able to leave your apartment with a 30 day notice.It sounds like you have a crappy landlord. If you really want to leave, you can play your cards like this. Send them a certified, return receipt required letter stating that you want a copy of your lease by March 25th. Mentioned in that letter that you have not receive a copy of your signed lease since whenever you moved in. And since they have not signed it when you moved in you think that you do not have a valid lease.One of two things will happen, they will send you your lease, and then you will have the information you need. Or they will not send you a lease, and then you can assume you do not have a lease. Check your state rules but Most states allow for a 30-day notification. If you tell them on March 31st you're going to move out on April 30th, that is fine.You then get the move out on April 30th, hold on to the certified letter, and the delivery receipt showing they received it, and then when they try to bring you to court for the remainder of the lease, you show the judge this letter which says you did not have a legally binding lease on March 25th, or they would have sent it to you.

Can I use air freshener in my apartment?

Can a landlord cancel the contract agreement at the last minute?

I already sign the contract papers for a 1 year lease with this apt, but the owner simply changed her mind at the last minute not wanting to rent the apt to me for no reasonable reason. Now i am living in my current apt paying day by day because my lease is already up and will be homeless in 2 weeks, because my current landlord already found someone to rent this apt. So, do i have any rights as a tenant? I mean, i packed my things, paid my deposit, paid the association fees of $100 and now i dont have an apt because my supposedly to be landlord changed her mind. What should i do?

Can I sue the apartment management?

I need to know whether I can take legal action against my landlord. It's actually my girlfriends landlord. She lives in an apartment complex where five girls live in a room. Each have their own room. The management has been horrible. Here are a few things they've done.
- Charged her twice for the same month. After she talks to them about the "mistake" they say they will credit her account but never do.
-Promised her a parking pass but she hasn't gotten it. She's been there over a year.
-Raised her rates after she renewed the lease.
-They will have people come in to see the apartment unannounced
The biggest thing was what happened two nights ago.
My girlfriend locked her keys in her individual room at 6PM. The office was already closed but there's suppose to be an emergency number in these situations. On their website it says "incase of emergency call this number" but there's no number.
My girlfriend finally found a number in her email to call and no one answered. I videoed myself calling the correct number showed a few times. We didn't get an answer or a call back. She filed out a message on the website saying she needed help and no one responded.
She slept on the couch. The office didn't open until 10:30 the next day. She missed class, work and sleep because she couldn't get in. She had medication in her room that she couldn't take which was dangerous. I'm sick of her being treated so poorly and hearing these promises that don't happen.

What can I do?

Can a landlord move my things without my consent?

Not while you are living there and paying rent, but if you are not paying rent and are in default, then per your lease or laws and ways or your local jurisdiction, at some point the place is back in the Landlord’s possession. If your stuff is still there it will either be moved and stored for a while, thrown out, or become the Landlord’s property.You might not be actively consenting to this at the time, but in fact you did consent to this when you signed the lease in this town and then chose not to pay rent or remove your belongings.(And if the first part of the first sentence above applies to you then the rest of this is not actually for you, just for tenants in general.)

Can an apartment complex make you take down your satelite dish after allowing it under previous mgmt?

I have Direct TV and the new mgmt at my apt complex wants to make me take it down because it is against its new policy. I have a contract with my satelite company and cant break it. Is it legal for them to do this?
