Can I Use This Buisness Name

Can you sell Avon under your own business name?

The answer to your question is yes. There are many Avon reps who have incorporated business and have changed the name of their business from their personal name to their corporate name.

What I suggest you do is first sign up under your own name and once the account has been created contact Avon and ask them what information they need so that you can change the name on your account to your corporate name.

Now sure if you are aware but you can sign yourself up online, the sign up information is on my profile and I have more information listed on my site.

Feel free to email me if you happen to have further questions.

And to respond to the yahoo responder below my answer they are incorrect there are many Avon reps who strictly go by their corporate name. Even when Avon recognizes them in National contests they are recognized by their corporate name not their personal name. Hope that gave you better insight.

How can I check if a business name is taken?

Here are some links where you can do some preliminary checking. However, please be aware that this is merely scratching the surface of what's out there.

http://www.uspto.gov/trademarks/index.js... -- USPTO – Preliminary Search of Federal trademarks; Click Search Marks
http://www.statelocalgov.net/50states-se... --Go to your state's Secretary of State page to see if they have a searchable database of business names
http://www.hoovers.com/free/
http://www.thomasnet.com – Must register (free) to search their database

Only comprehensive research will tell you if the name is truly available. But, these links are free & a great place to start, so I'd try them out first.

Comprehensive research consists of looking at marks that are similar in Sound, Appearance or Meaning in the pending & registered Federal AND State trademark files as well as the US National Common-Law files.

Hope that helps! I wish you much success & happiness in all your ventures!

What should I do if my business name is trademarked by another company?

You may use that business name as Trademark if the target audience of your goods is totally different even if the class of good is the same. If that Trademark is not so popular in your country, then it shouldn't be a problem to use it. However, if the trademark of his goods is popular worldwide and has acquired a distinct identity of its own among the masses, then you may not able to use that name. For example- We all know how popular a brand is Mercedes. Now, you simply cannot start manufacturing a product, say underwears using the name “Mercedes”. This will lead to wrongful loss to the image of THAT huge brand which has target audience all over the world.Only in two cases, one can use the same Trademark as that of the other. First is the case of honest concurrent use. Second is the case of jointly owned trademarks.Hope this helps you. This is just a broad idea to your question. To get your business name trademarked at an affordable attorney's fee or in case you need to seek professional advice by a Trademark Agent, you may visit Trade Mark Registration Agency | Trade Mark Registration Company | Copyright Registration Agent in Delhi , India .

Can I use "Inc." in my business name and domain name without being incorporated?

In addition to Jon Mixon's answer, you could also be committing fraud by indicating that you are incorporated when you really are not, which could cause severe repercussions down the road.  Get a lawyer and get incorporated (or form an LLC) if you really want to claim it.

Can you use lowercase letters for the llc after your business name?

I'm getting letterhead and brochures etc. made up for my business and was wondering if it is required to use upper case letters when listing the LLC behind the company name it doesnt look as good as the lowercase. Someone told me it had to be all caps but I cannot reference it anywhere

How do I find out if a business name is already registered?

There are many alternatives to search for a suitable company name:· Search Name on Ministry of Corporate AffairsHowever, 'Available to use' is not a pre emptive statement. MCA store names as 'Available to Use' when the name does not matches with any other registered company or LLP name but with existing intellectual property name or having legal proceeding on it. This a minor bug which MCA should resolve soon.Henceforth I prefer the following Search:· Search on Private Limited Company and RegisterIn case you plan to incorporate a new company, to search the company's name, following steps should be kept in mindThe name should not be similar to a registered brand name or trademark,Name should not be similar to any existing company or LLP,Names are prohibited to be taken for 2 years by any company if an existing company voluntary wound up.If a company wound up from the force of law then that name shall be prohibited for 20 years.

Can I use a business name that's similar to a trademarked name?

If "Blue Moon" is the trademarked part, then you cannot use it to sell cameras.

If the whole thing "Blue Moon Cameras" is trademarked, you MIGHT be able to get away with a variant, but doubtful.

Here's why: in infringement cases, courts look at whether or not "the ordinary person" would be confused. Most people would say, yes, they thought "Blue Moon Cameras" and "Blue Moon Supply" (which sells cameras) were somehow related.

As such, because there would be confusion, you would not be allowed the name.

Problem is, the PTO might not deny the trademark. You might not find out until you get sued. At which point, you'll have to change your business cards, your web site, your ads, notify customers, etc. That can be very costly.

To prove my point, let me give one of the best known examples. "Apple Music" is a trademark (it's the music company for the Beatles). When Apple Computers started up iTunes, they were sued from infringement because the word "Apple" can only be used once for a music-related industry.

To use Inc. behind my business name in India, what should I need to do?

The naming guidelines in India are pretty clear.  A company cannot be incorporated with its name ending with Inc in India. As per Section 4 (1) (a) of the Companies Act 2013 (Section 13 of the Companies Act 1956) the memorandum of a company shall state:a) The name of the company with the last word “Limited” in the case of a Public Limited Company; andb) “Private Limited” in the case of a Private Limited Company. The above requirements are not applicable to companies registered with the charitable objects under Section 8 of the Act of 2013(Section 25 of the Act of 1956).Then there are specific guidelines on usage of words within the entire name.  Usage of words venture, India, global, will have to explained to the ROC and most probably, higher Authorized capital is required.

Can I use a brand name which exists in another country for my new company in my own country where it doesn't operate?

This is a risk and you must consult a Trademark lawyer before taking this risk. It needs to be seen whether your country is a member of World Intellectual Property Organization or not? If yes, then that company may have some kind of a protection under Paris convention even when it is not operating in your country.Secondly there is a concept of cross border reputation in Trademark law which means that you may be refused the trademark registration if the other company is able to prove that their reputation crossed from their country to your country and you were aware of their brand. In such a scenario, it would be extremely difficult for you get the registration of mark in your name. And with the emergence of internet it would not be difficult for them to claim this. You can get that trademark only if you are lucky enough that your trademark application skips their attention and they don't take any action.Hope this answers your query.
