Can My Employer Ask For My Monthly Benefits Back After I Resign

Is it true that an employer can make you pay back insurance paid during your maternity leave if you don't come back to work for a period of one month after maternity leave (before quitting)?

An employer who currently pays for health insurance under a group health plan (medical, dental, vision) must continue to maintain a pregnant employee’s coverage under the plan as if she was actively working.  The employer must maintain benefits for the period of the PDL. From HR California...The Employer can recover premiums that were already paid if both of the following conditions are met:The employee fails to return from leave after the designated leave period expires; andThe employee’s failure to return from leave is for a reason other than one of the following:The employee is taking leave under the California Family Rights Act (CFRA), unless the employee chooses not to return to work following the CFRA leave. The continuation, recurrence or onset of a health condition entitles the employee to pregnancy disability leave, unless the employee chooses not to return to work following the leave.Non-pregnancy related medical conditions require further leave, unless the employee chooses not to return to work following the leave.Any circumstances beyond the control of the employee, including, but not limited to, circumstances where the employer is responsible for the employee’s failure to return (the employee is not returned to her same position or to a comparable position), or when the employee must care for herself or a family member (such as the employee gives birth to a child with a serious health condition).

Can I still collect unemployment if I quit my job?

My employer is cutting my position. He has offered me another job with the company but with a significant pay cut which I cannot afford to live on. Is this an exception to collecting unemployment if I refuse the lower paying job? I may have to move home with family and go back to school to improve job opportunities.

If you don’t have enough credit in the system to get unemployment (most states require at least three quarters of employment with one or more employers, meaning nine months, unless there were extraordinary circumstances) you may not be eligible; but at least you’ll have made the effort.In the future, I would also advise that you carefully listen to what you are told during your interview process. While this startup may be run by incompetent people, it’s probable that you were informed of your need to be flexible and that you were unwilling or unable to do so.

Can i get unemployment benefits if after 5 years with my employer i quit?

I worked with my employer since high school on school holidays about 5 years and full time another 5 years. Last month I quit and that same day I went back and said that I didn't want to quit. Nevertheless, at the end of the day they let me go. For the past month I have been looking for any job with no luck. I have recently applied for food stamps and was told by the county worker that I should file for unemployment. I always thought if you quit that you don't get unemployment, but she told me that I still could get them, I just would be penalized a couple of weeks. I am going to file because I have bills to pay and need some kind of help. Does anyone know what my chances are of getting unemployment?

How long do insurance benefits last after you quit a job?

In most cases health insurance continues until the end of the month (or in the case of my last employer the end of the following month that you terminated employment). You'd best check with your employer's HR department for verification.

After this time you can continue your health insurance by utilizing COBRA coverage.(But of course that is expensive).

I was the receptionist/general secretary in an office where a sales manager was actively working to undermine the general manager so that she could take his job. She intentionally targeted employees who were loyal to the GM, bullying and harassing us, and if we resisted or responded, she then reported on our “insubordination” or “unprofessional behavior” to the company owners.She knew that the general office staff had been instructed that they were not to be in the office past the 5 p.m. closing time under any circumstances (because the owners did not want to pay overtime). So one of her favorite tricks was to walk into the office at ten minutes to close with a 12- to 15 page contract that needed to be typed “by 8 a.m.” Our contracts were five-copy carbonless forms that had to be typed on an actual typewriter, and they had numerous blanks and check boxes that were challenging to line up properly. A 12-page contract could easily take 2 hours to type. After getting in trouble for staying late to complete a couple of these assignments, and then getting yelled at for saying that the work could not be completed in the time frame requested or for asking her to get permission from the GM for me to stay late, I found out that she was reporting me to the owners for not being a team player. How did I find out? I got a letter from one of the owners telling me that if I could not get along with this person, I needed to “get along” out of his company. I was young and not very courageous, so I decided I was done and turned in a letter of resignation. Even though I’d worked there for 2 years and had nothing but excellent feedback from every other supervisor I worked for, I was denied unemployment benefits, solely because “you resigned.”So my recommendation is to let / make them fire you. That way, unless they can show clear and documented cause for the termination, you’ll be eligible for unemployment benefits.

Can a company deny the relieving letter if the employee has resigned and served the notice period as per the contract?

This will only happen in India and (1) When you have given a resignation letter you should make 2 copies and give one and get the acknowledgement on the another one. (2) They can -till they have shown certain way of teaching a lesson. Let's see the other ways.. 1. Do you have copy of your resignation letter? If not make one and of the same date and if you have sent it through the mail then there must be a acknowledgement from them you get that print out keep it with you. If not tomorrow morning you send  email ( very politely) that you have submitted your resignation on so and so date and you would like to know the status of it.  ( whether accepted or pending or not accepted etc) say only status.  And then start reminding them by phone or in person every alternative day. once you got the acknowledgement and reason for dealy etc take a print out and keep it with you.Now you write a nice polite letter to your HR Manager from where you got the offer. explaining the situations and attaching the resignation letter you sent to them 15 / 20 days back - and inform them ( never blame the present employer) that " I am afraid that the management is not happy about my resignation and may delay the approval of it.  As I have the salary certificate and resignation letter copy with me - will it be sufficient for you to accept me and issue me the appointment letter? If they say yes.. then you must be careful to write a letters informing the present co that : with reference to my letters where in I requested you to relieve me as early as possible and I till now even after 25 days neither I received any communication or information about the status of my resignation letter.  I would like to inform you I will not be attending the office from ( give a date) so I request you to make arrangements to relieve me by taking over the papers, and other files which I am presently handling now as soon as possible or designate some one so I can handover the things to him. Still if these people are playing tricks - Issue another letter after 3 days - making it as reminder - the plan is to create a record of sorts.. - like you resigned long back, on your own, you need to handover few things ( tomorow they should not give a police complaint about that some thing was lost etc) and the HR managers should know that you are creating a record. Still these people are adamant - then you need to consult a lawyer.

I have resigned from my current company and already serving my notice period. The company found my replacement, however, the HR is not giving me an email acceptance on my resignation. What do I do?

The company does not have to ‘accept’ your resignation. You resigned - that’s it. They agreed to let you work out your 2-week notice so work your two weeks then leave. Not sure what exactly it is that you want. The purpose of the resignation letter is to do one thing and only one thing. It is to provide documentation that you voluntarily quit your job there. They don’t need anything else but the email/letter from you that says you are quitting and what you would like your last day to be. The reason the company needs this documentation is related to unemployment. I’m assuming we are talking about working in the US. If you quit a job, then you are legally NOT eligible to collect unemployment. Unemployment benefits are for people who, for no fault of their own, lost their job. The government offers this to people who are laid-off but not to people who had a job but quit. If someone quits their job and then decides to file an claim for unemployment benefits, the government will send that company a letter asking if that person quit their job or was laid off. The company then needs to pull your file and your resignation letter and send a copy of that to the unemployment commission. Therefore proving that you quit your job and are not entitle to unemployment against that particular time they worked there. That’s it. So whatever you’re expecting from the employer, you aren’t likely to get it. In the US all employment is considered At Will which means anyone can quit their job anytime they want to. So again, there is no “accepting your resignation letter”. You quit. You put it in writing and gave it to them. That’s all there is.

If my boss asks me to resign because he doesn't believe I'm the right fit and gives me a one-month notice, does it mean he fired me?

I am not in the US. The country I’m in doesn’t give unemployment benefits and the company where I work isn’t obliged to give a severance package. They give a month’s notice prior to termination if the staff isn’t working out. The staff can try to transfer to another department if it offers a better fit, but the transfer might be blocked if the staff actually has more problems than just job fit. The staff is also free to resign during that month if he has secured another job.Jobs evolve, so wrong fit may also imply skills obsolescence. We recently let go a large number of staff because their department closed down and the skills most of them had were not relevant to the rest of the company. Only about a quarter of them secured a transfer because their skills could be applied to other jobs.Your boss is terminating you. It’s up to you to determine if resignation or termination is more advantageous to you, and if you have any grounds to fight this termination. If your boss has already warned or counselled you before for lacklustre performance and you have tried your best but still can’t do any better, then bite the bullet and leave. Negotiate for severance if you can, but don’t do so if your poor work has already cost your company clients and profit. Our department was once investigated by the labour ministry because a staff with exceedingly poor performance reported our supervisor for giving her an “unfairly” bad review. We had to provide the mountain of evidence against her. If I had had the choice, I would have suggested she resign. She was really “wrong fit” because she was poorly educated, poorly motivated, and absolutely delusional regarding her work performance. The boss kept her on out of pity. A couple of years later, she was swept up in a companywide tide of retrenchments to clear the “deadwood”. At least the union was involved and she received a severance package.

I joined Mindtree 1 month back and want to abscond it due to bad management and the work. Also I have a better offer in a different company. What will be the consequences if I abscond or resign without serving the notice period?

Its not a good idea to abscond without serving a notice period in general. But in your case, you have been with mindtree for just a month, so incase if you abscond you won’t get the papers from mindtree. So don’t show it in your resume and when the employer asks about this 1 month gap, you can come up with a reason. However the big question is, in the resume that you have sent to the company from which you’ve got this job offer, have you mentioned about your current employment with mindtree. If yes, then you have no other choice except to put your papers and serve the notice period at mindtree and get the documents from them. Again your new employer or any future employer will surely question you about this one month stint at mindtree and it’ll be a big negative in your resume in the long run.So do think carefully before taking any action.
