If you get married, then leave and go to your home country, there’s no such problem. Although, getting readmitted as a visitor at a later point *might* be tricky, the State Department would likely want to see proof of your intent to depart, failing which, they would request that you file for an immigrant visa.

you can't apply for a fiance visa while in the US. that's a nonimmigrant visa that would require you to marry within 90 days after you arrive. since you're already here that wouldn't help you. you can certainly marry in the US. if you do, your spouse will need to file an I-130 immigrant petition, an I-485 adjustment of status form and an I-765 work authorization form. they need to be filed together or things will go astray. there's no need to be fearful of marrying and filing the forms. while it's possible that your adjustment request could be turned down, the worst that will happen is that you'll have to leave to get an immigrant visa interview back home. chances are pretty good it will be approved though. check out www.uscis.gov for more information and downloadable forms. check out the fees too. it will cost you over $1,400 to file all the forms required. be sure to read through the instructions for the I-485 as well. lots of important information for you there.

2) The I-130 takes 5 months to process. Once that's done, a priority date is being assigned and then the petition goes on ice until the priority date becomes current. As the spouse of a permanent resident, you are in the F2A preference category. The wait for that is about 2 years and 9 months after the I-130 has been approved.

3) You need to stay outside the U.S. You are not allowed to wait in the U.S. beyond the date on your I-94. Once your priority date has become current, the I-130 goes first to the National Visa Center and from there to the U.S. consulate in your home country. There you will have an interview and receive your immigrant visa to the U.S.
