Can My Husband Adopt My Son Now

Do I need a lawyer for my husband to adopt my son (his stepson)? His biological father abandoned him since he was 6 months old and still won't consent.

An adoption is the termination of parental rights, which are constitutionally protected and and the creation of new parental rights. There are usually three types of adoption, a direct placement adoption where the parties are not related by blood or marriage. The family adoption where the parties are related to the child by blood or marriage, and then the step parent adoption where a person wants to adopt the child of their spouse.In a step parent adoption, there is the issue of whether or not the parent whose rights are sought to be terminated as been paying child support and if they have had contact with their child. In a termination of parental rights proceedings, it is an issue of fact whether the parent whose rights are sought to be terminated have regularly and substantially have paid child support and had substantial contact with the child [ren] to prevent the termination of their parental rights.Before a court can terminate the parental rights of a parent, that parent has a right to a trial, AND he/she will be granted a court appointed attorney to defend his/her constitutional rights.In short, absolutely you need an attorney.

My ex husband adopted my son quite a few years ago. He is the only dad my son has ever known. My son loves his dad very much. My ex husband has now met a girl that is trying to convince him to un adopt my son. Can he do that?

I'm crying right now because I feel like I can't efficiently be a parent to my son. I grew up in a shitty family, without love or support. I'm actually the black sheep/scape goat, went out in the world looking for love only to end up involved with a guy that was just using the baby and I as a means of survival for himself. Once I broke up with him he disappeared and got into a relationship with this coworker I always thought he had a thing for. I think she is part of the reason he doesn't help care for our son but also his family doesn't really want anything to do with him either so it just makes it easier for his dad not to come around. Anyways I lost everything (job, house, car) and now luckily stay with family but I'm the only one working so obviously someone has to watch my son. Hes autistic so hes a handful its putting alot of stress on my sister's relationship. I'm paying her though so it seems like she can't handle a job because she's used to living off SSI and her partner suffers with mental illness I'm afraid they're mean to my son when I'm not around. I want to give up. I made a dumb decision bringing my child into the world it was selfish of me. Now I'm at a point i feel like maybe he deserves more than i can give him emotionally financially idk someone please give me some advice I'm just tired of life already.

if i have sole legal and physical custody can my husband to be adopt my child? if so would her bio father still be able to see her? or what if i have sole legal custody? can my husband to be still adopt her if I give permission? also can i move out of state without his permission. the bio father already lives in a different state. I also needed to know if getting child support would have any relation to these concerns
