Can Someone Report Stalking In A County Other Than The One They Were In When Calls Were Made

What do you do when someone files a false police report on you?

First, just because someone contacts the police, doesn’t mean a report will be filed. If a report is made, it also doesn’t mean that an arrest will follow. If when talking to the reporting party it is determined that a crime has occurred, or it would be reasonable to believe that a crime as occurred, and that it’s not a civil matter, that report will get filed.If it’s a civil matter, the party is informed of that, and if it’s just un Either the officer or a detective, depending on the size and policies of the department involved, will follow up and perform additional investigation, which will likely involve talking to you. A determination will be made as to whether they believe the allegation to be true, at which point the accused may be arrested, or a warrant obtained for their arrest. This is rather rare, and generally involves very serious allegations, rape, kidnapping, etc., things that have caused huge community disruption and/or cost to municipalities or states in terms of manpower for searches, etc. Beyond that, you could potentially have a civil case for harassment, but those are difficult and expensive to prevail.

I think someone is stalking me.....?

Okay so yesterday, i was walking home after going for a walk around my neighborhood. There was a car that was parked next to my friends house. It started going forward and then as i got closer to it, it started reversing so i started to speedwalk. This other car came up next to it and the people in the car were talking so i didnt think too much of it. I started walking and then i felt like it was kind of driving up behind me at the same pace. I finally got home and i noticed it left as soon as i got in the house. The next day, as i was walking past my window, i noticed a car that stopped on the other road across the street. It just "stopped" there. And it looked like the same car too. It just really shook me up. Back in february, while me and my mom were away, a man who was painting inside out house, saw a man walk out of the house and down the street. The painter called his name but he didnt answer. We filed a police report on the man but they didnt find him. And im so worried its the same man. Do you think its the same man or a coincidence? Im really shooken up. Im 14 going into my freshman year of highschool.

How can one get a restraining order against someone in another state? What evidence do I need that this person has been harassing me? How do out of state restraining orders work?

Depends on the state.  Most restraining orders are enforced in all states.  If you want to get one issued in Connecticut because an offender lives there with his grandmother, you drive to the Superior Court courthouse and apply for an emergency restraining order; if a judge agrees -- the bar is high in Connecticut, see below -- and approves your ex parte emergency order petition, you're off to the races.  It is effective in other states by Connecticut law, so long as it's served and the respondent has received notice.  Rules and terms vary.  Connecticut issues ex parte emergency restraining orders if the Superior Court judge believes the applicant is in imminent danger.  If there's no imminent danger, the request is denied.  The term ex parte simply refers to the fact that a petition was approved based on the testimony of only one side.  They schedule a hearing for a permanent restraining order. In New York, ex parte orders of protection are issued by Family Court judges.  The bar is low, or nonexistent.  Which is why the New York statute states: "an ex parte order of protection is not a finding of wrongdoing."  It's called an "ex parte order of protection", but it isn't an order of protection until the real hearing is held and both sides have made their cases and the judge agrees to issue one. Your question could be answered easily for free by one of the services in your state that helps people in this situation.  Because the laws are so different, without knowing what state you were in when you posted this question, neither I nor anyone else can tell you much more.

My neighbours keep calling the Police on me. What can i do?

I have lived in my house a very long time and never had any issues with my neighbours. Last summer though they started calling the cops on us, starting out once every other week and escalating to several times a week. Some of the reasons he called were: we were too loud swimming one afternoon, we were too loud eating dinner (our kitchen windows are about 5 feet from each other), we were too loud playing cards on our back deck (with my grandparents). Silly things like that. The cops started showing up with "anonymous" noise complaints but eventually our neighbour came to us saying it was him and he was tired of our "rude behaviour" (we knew the whole time it was him anyway). Eventually the cops were showing up so often they told us they were going to make us pay a fine for all the false claims. Once i explained what was going on the officer told us it happens a lot (people using police to harass their neighbours). Now that the weather is getting nicer, he has already started calling the police on us (for having a BBQ at dinner time) I was wondering what i can do, because i'm tired of having the police show up here all the time, even the cops see were not doing anything but they say they cant do anything because they cant just ignore his calls.

What can I do about a stalking psycho neighbor?

Document, document, document. Every single time. It will be a pain in the butt, but buy a note pad and get out your digital camera and take a picture of him following you, take a picture of him opening the garage door etc. and let him see you take his pic. Then ask the apt manager (if you don't have the info) for the apartment owner's info, It would be better if you can google it or get in from the county assessor and write a letter to the owner just like another poster suggested. cc: the manager, but wait a day or two to send the manager her copy. Don't throw the manager under the bus, just state that you feel threatened by your neighbor, you are emotionally traumatized by his behavior and don't want it to escalate any further. You have documented the incidences and you have been advised to go to the police, but you would prefer to give the owner & property management the opportunity to handle it first. You realize the manager has attempted to speak with the neighbor, but nothing has changed and at this point you are requesting he immediately stop this harassment and apologize. (whether or not he feels he has done anything wrong or not - it is still perceived by you as him having done so.) My neighbors keep calling the police on me and falsely accusing me of criminal acts. I am afraid to go outside of my house. What do I do?

I have a neighbor that is fixated on my husband. She seemed a little off, but once she found out about his time in prison she developed a full blown obsession. She wrote the association board for our community a complaint about him slamming doors and watching her when she was outside. This was nonsense but they still had to address it with us. She wrote subsequent letters to the board stating he has a key to her car, and gains entry to turn on her radio...that he lets air out of her tires...that he's getting in her home and releasing ants...and he's poisoning the food in her refrigerator. We'd see police at her door, but they never stopped by to talk to us. One day last fall, my husband was riding his bike. This neighbor pulled her car in front of him and slammed on her brakes, causing him to fall off his bike. Her behavior was now endangering him so we went to the police to file a report. The police were helpful, and knew our neighbor well. Apparently she'd filed lots of police reports about my husband and a few other men from the neighborhood. The police recognized she has mental health issues and never pursued her later complaints. So what can you do? Try to have your cell phone ready to record if you think your neighbor will confront you. Keep a cool head, there's nothing wrong with not engaging in an argument. Don't be afraid to talk to the police to see what your options are if you're being harassed. You don't want to end up on the wrong side of this problem.UPDATE: my local police department reached out to the neighbour's daughter, the daughter called my husband to apologize and let him know she will be intervening in a medically supervised care program for her mother. She made sure he has her contact info should we have any problems. I give her all the credit in the world, she was wonderful and it's great that she wants to be involved in her care! Here's hoping my neighbor gets back on track.

Can I have the police say that someone has to stay away from me without filing a restraining order?

First of all, you need to notify the police of this person's actions. You should of called them when the initial "threat" happened and every time this person is driving by your street or driveway. There has to be some type of official documentation for an restraining order to take place, which needs to be presented in court. Now, its up to a police officers discretion, to call this person and advise that a police report has been generated and its "best" to stay away. Start building up your case. If he/she shows up at your house, a criminal trespass warning can be issued. If this person shows up again, he/she can be arrested. Good luck!
