Can Someone Who Has Been Baker Acted Own A Gun Legally

What does it mean to get 'Baker Acted'?

One of my bestfriends got Baker Acted the other day. What does it mean? Should I be worried. I didn't want to seem like an idiot asking him so I asked my mom about it and she said that its where they take crazy people and check them out? He's not crazy though...

Will The Gun-Free School Zones Act be repealed any time soon?

Thanks for the A2A. I can't add much more to what Chris Knox has already done as far as pointing out the utter ridiculousness of Gun-Free School Zones and the bad legislation that permits them to exist. Gun-Free Zones aren't magical and they don't stop psychopathic criminals from murdering other people. If we thought they did any good, we'd get serious and make the entire country a Murder-Free Zone, wouldn't we? 'Cause obviously, laws already on the books against murder are not doing any good.Is that bullied college wallflower on Xanax and Ritalin really going to stop outside of a Gun-Free zone and balk at the extra fines or prison time he could incur by having a gun there? No. He's so crazy he probably didn't even see the sign, much less care about what it meant. Is Mohammed bin Mohammed going to re-think his carefully-planned jihad on Baker Elementary's schoolchildren just because the infidels put up a Gun-Free Zone sign? No. In fact, he may have chosen Baker Elementary for his Go-Pro filmed murder spree because they have no armed security and no armed teachers or other staff. No resistance will be had at Baker, other than some flimsy locked doors and the "bullet-resistant" whiteboard in the assembly hall. These zones are invitations to commit unresisted murder. And when people like me say such things, and suggest that teachers should be trained to carry concealed weapons or there should be an armed security presence at the school like the one in place for the elite's kids at Sidwell Friends, the opposition gets red in the face and screams "I don't want guns around my kids!"But the psychopaths and the jihadists don't give a damn about what you want. The teacher and the security guards care about your kids, at least."You want children to be killed by guns! You want bodies piled up to satisfy your bloodlust!" The Left won't engage in a discussion based on reason. The guns are bad. All the guns are bad and must be banned. The people who use them to kill other people? They don't have an answer for that. Guns are at fault. Not people. When you ask about repeal of laws that do nothing to deter crime and everything to deter a person's natural right to defend his own life or the lives of others, remember that you are dealing with unreasonable people who will sooner defend crazy people than cease blaming inanimate objects for murder.

Can bipolar people own guns?

So long as one is not a threat to self or others there is no reason that someone with bipolar or any other mental illness should be barred from owning or have access to a gun. I repeat, so long as they are not a threat to self or others.I have Type I bipolar and have never felt suicidal. I have of course felt depressed but never self harmed. I have never harmed myself or others. While I have never been involuntarily committed I have had PHP, IOP and DBT groups to help me with coping with my mental illnesses. All of it helps along with my meds.I take a hard stance that if one cannot be trusted with a gun then one must require 24/7 supervision and be barred from owning or driving a vehicle, having access to sharp objects, chemicals, and items that can cause asphyxiation. Any of those items can cause threats to self or others. I know it sounds harsh and it is. I see firearms as a litmus test for independence and self governance.Back to the matter at hand. Just because one has mental illness or even depression for that matter, does not necessarily mean one cannot have and use a firearm. I know neurotypical people who agould not be trusted with a crayon and people with mental illness who are a threat to no one for as long as I can recall. Case by case us a better determinant.

I live in the US and I've intentionally overdosed on legal drugs. Could I buy a long gun if I meet all the other criteria?

These are the two relevant questions from the 4473 form:Question e refers to the present tense. An overdose in the past does not meet the disqualifying standard. If you just did this, then that’s a bit shakier. Note that the government has no way of checking this particular line item.Question f is very specific. Adjudicated mentally defective or committed to a mental institution. The first part can snag unsuspecting people who get ruled as incompetent to manage their own affairs for some reason or another, but who are really not. But based on the question alone, there is no reason to think that you are a prohibited person. The government CAN check this one (though states are notoriously bad at actually reporting the data).

If you have bipolar disorder can you own a gun?

No, you cannot.

However, with the way that our privacy laws prevent mental health records reaching the FBI where they need to be in order to prevent "consumers" (crazy people) from buying a gun, there is often nothing to prevent them from doing so.

The law against mentally ill people purchasing handguns would have prevented both the VA Tech and Arizona shootings had those states been allowed to share their mental health records with those who need to know. Instead, people want those with mental illness to be able to blend in with the rest of us and are surprised when they are allowed easy access to firearms that they shouldn't otherwise be getting. Sometimes the privacy rights of the individual do not outweigh the need for public safety.

How long are Baker Act records kept...I don't want one mistake to cost me my career?

It sounds like being held under the baker act is the same thing as a 72 hour hold. That is not an involuntary commitment. however, there are legal implications in some states such as firearms ownership. I know that there are restrictions in California, Texas, New York, Illionois, Hawaii, and probably a couple other states. Most states go based on the Brady Bill, which involves involuntary commitment which is a LEGAL process where you go to court in front of a judge, which did not happen to you.

Of course, the issue of legally owning a firearm is much more lax that the issue of being a police officer or in the military. You cannot lie on your forms, and they do background checks for the police. My husband got a phone call about someone he knew, who wanted to be a state trooper, for example.

Just because HIPPA will keep that info under wraps, doesn't mean you can lie to the military (Federal offense) or the police.

There is a process in the courts to get your rights restored, at least for being a police officer, because I have read about how in CA, people who were on a 72 hour hold go to the judge to get their gun rights back, so they can work as a police officer again.

I dunno about the military.

Will people at the gun store know about my attempted suicide?

I haven't been in the wrong mind for almost 10 years now. My medicine is exactly what I need and I no longer wish to end my life but would like a firearm to keep around my house for I live in a scary neighborhood. Will the people at the gun store know about my history of trying to commit suicide?
