Yes it is considered stalking. Telepathy stays connected for a minimum of one hour. That means that if you only talk telepathically for 15 minutes, the other 45 minutes you will still stay connected, thus you will hear and know what the other is doing, like going on a date, eating, studying, or rubbing one off.
