Can You Be Fired Even Though You Not Working That Day

Can you be fired for not working on a holiday?

I have a part-time job, 32 hours per week. When I first started, I worked 2 days, off 2 days, not a set schedule. About a month or so ago one of the managers told me that I would be getting a set schedule, which is now Saturday, Sunday, Monday and Tuesday. I am off Wednesday, Thursday and Friday. I went ahead and planned Thanksgiving at my house, with people flying in from out of state. We were informed about a week and a half ago that EVERYONE will be scheduled to work on Thanksgiving. Needless to say alot of people got upset, including myself. At the second meeting we were told again. When one of the employees asked what if they had non-refundable travel plans, the manager said that anyone that has to call off, then call off.
We just had a third meeting, with a different manager. He informed us that everyone will work or not have a job the following day. Is this legal?

Can you get fired for not working on your day off?

Today, I got called asking if I could come in and work on my day off. I told them that I couldn't and my boss said that my job could be on the line.

I thought you couldn't be fired for not working when you are not scheduled to work.

I had requested last Thursday for the day off. My boss agreed since it was my boyfriend's graduation and graduation party. Then the day before his graduation she changed the schedule and made me work that day. Luckily I didn't miss his graduation, but I missed other important stuff. but I still came in and my boss confronted me and said "Oh, I'm sorry you had to miss his graduation." I didn't say anything about it and just worked as usual.

Now, because I couldn't come in on my day off, I'm being threatened my job? I work at Kroger deli in Ohio.

Can I be fired for not working on Christmas day?

I am 18 years old. Black male. Work in a Chinese restaurant. Boss told every single employee( dishwasher, waiter, chef, line cook, host)"if scheduled and you do not show up...FIRED". I am Christian, Christmas means the world to me. I am scared to get fired, because it is hard to get a job these days. I am a dishwasher. Not proud of it. They are opened 365 days a year. They LOVE MONEY. Help!

Fired For Not WOrking Overtime?

Most of the co-workers , supervisor and boss for the company i work for dont like me. The place that i work for has alot of people that dont like my kind of race. I mean no problem with that you dont have to like my race if you dont want to. It is a free country. But everymorning I work from 5am-3:30pm on a normal day. First two hours are overtime. Sometimes I have stuff to do and a family to take care of at times. So I cant "always" stay after 3:30, they tell me if "I" dont work overtime. I will lose my job and dont have one. But alot of other co-workers dont work overtime either, they go home when their regular day is over. And they still have their job. I know they are just waiting to get rid of me. I mean I know that they dont like my race. But that isnt right for them to get rid of me because of it. But if they do fire me, it is a At Will State. They can fire you regardless. They can give you a reason or not. What is a way a can prove they fired me because of my race?

Can you get fired for missing a day at work because of a death in the family?

I once fired a worker for this reason. It was a beautiful summer's day. The guy called me to say that he wouldn't be able to work the next day as his grandmother had just died and her funeral was the next day. Funerals don't generally happen that fast but I gave him the benefit of doubt. Two days later he came into to work on crutches with his leg in plaster to tell me he'd broken his leg and couldn't work for a few weeks. "What happened?", I asked. "We were at the swimming pool and I slipped and fell"."The funeral was held at the pool?""Funeral? Oh yes. No, this was afterwards. My grandmother loved swimming so the whole family went to the pool after the funeral to celebrate her life"."You all went to the pool after the funeral? Your whole family?","Yes","Andy?","Yes?","There was no funeral, was there?", "No. Should I look for another job?","Yes". Andy's brother was a friend of mine and was very impressed with this incredible show of intelligence.

Can You Get Fired For Not Working Overtime?

I work for a company.....i work from 5-5 some and probably most days. The regular time would be 7-3. If I couldnt work overtime, could i be fired from the job? Can they really do that?...That wouldnt really be fair or right. Could this company be in trouble for firing a worker becasue he or she couldnt work overtime? But the problem would be that this State is "At Will". How could you prove that they had fired you becasue you couldnt work overtime? I read the company's employee orientation packet and stuff. And it didnt say that overtime is Mandatory. I thought Overtime was Optional

Can you get fired by calling off with a doctor note?

Generally no, in my experience. But there are exceptions to any rule. It is theoretically illegal in many jurisdictions to fire someone for being ill. However, doctors are known to write notes for anyone who asks based entirely on what the individual tells the doctor. So if you get a note every week for a day or two off for ‘a severe headache’ I’d be making you go to the company paid doctor for a lot more detail about how often this is likely to recur, etc., etc. I can’t ask for underlying cause, but I can ask many details about whether you should be in some other job where your regular absences, if that’s what it’s going to be, make much less difference… like you might end up cleaning the parking lot on the days when you can make it in. More likely the doctor is going to tell me that you could fix the problem, but you aren’t taking steps to do so. Now I have a chance of firing you for not making the fix in a reasonable time frame. But obviously that means I can’t fire you the first time something happens.

Will I be fired for not coming in on my day off?

Absolutely not. If it your day off, and you haven't agreed previously that you will come into work, then you are entitled to it off. Even if you are on a "zero hours" or "as and when needed" contract, that doesn't allow your employer to take advantage. You HAVE to be given prior warning of a shift.

Some employers try to guilt their employees (especially newer ones who are trying to give a good impression) into working these shifts with little to no warning. If you receive a call on your day off and no agreement has been made prior to that, then the call from your employer should be ASKING YOU if you are free/willing to cover. You should not be expected to work. By all means work it if you want the extra money/hours, and it's definitely worth taking these shifts when you can as you will look committed and enthusiastic, but don't let your employer take advantage. You are fully within your right to say that you would not like to work that shift. You do not need to make an excuse. Simply say you are busy and can't do it. You are only obliged to work what has been agreed for the week (or month, or however your rota's work etc.)
