Can You Defend Yourself Against A Police Officer

Are you allowed to defend yourself against a police officer?

But you need to be able to prove it was self defense. They almost always side with the police officer. For example if they shove you during a traffic stop can't you push them back?

The truth is you will most likely get convicted unless you can prove it was self defense. Isn't that a fact?

I knew a guy at the doctor's office in Burbank/Sun Valley area well back in the early 80s he and his gf got pulled over. The officer was intentionally sticking his hands inside the girl's shirt during the patdown and he was saying really nice. So the guy goes over and punches the cop in the face really hard. He got 12 months in jail even though he and the gf were witnesses. He was told that he only got 12 months because of the self defense claim that otherwise he would of easily gotten over 5 years.

Are there any car cameras that you recommend that the officer's cannot tamper with?
Like two cameras that cover both angles the drivers window and the passenger's window? It should come with sound and cannot be easilt tampered with by the officer where one copy goes directly to a separate residence or something.

When are you justified in defending yourself against a police officer?

The technical answer is if the officer is acting outside the scope of their authority, presenting a threat of great harm to you, and you have no other way of making preventing it.The real world answer is never. You don’t get to decide wether the cops have a right to arrest you on the spot. The judge does. You aren’t justified in fighting them right then and there, that comes later and it’s your lawyer’s job.If you did defend yourself from a cop, you would have to prove not only that they didn’t have the legal authority to arrest you, but also that they knew that they didn’t. If the officers didn’t have grounds to arrest you, but they thought that they did (for instance they thought that you were someone else who had warrants, or thought your bag of powdered sugar was cocane) you are still in the wrong.Min reality, you won’t be harmed if you comply, and you and your lawyer can sort things out later.

Can you defend your self against a police officer if you think they are illegally assaulting you?

Fight the cops in court, NO WHERE ELSE!What do you think will happen, are you going to overpower him?Beat him up?SHOOT him?A cop WILL ESCALATE the violence until you’re in handcuffs, or unconscious, or DEAD, or HE is.And if HE can’t handle you, more cops will pile on, and more, and MORE, they even have a cutesy name for it, “the polyester pile up” OR they’ll beat, pepper spray, tase and/or SHOOT you, until any resistance is crushed, or YOU are.Fight the cops in court, NO WHERE ELSE.If you are stupid enough, or have the misfortune to royally piss off a bent cop, cover up as well as you can and scream ‘I give up” as LOUD as you can, so anyone watching can hear, try to stay intact until you can get to a lawyer.Fight the cops in court, NO WHERE ELSE!

Can you defend yourself from a police officer hitting you?

It is obvious in the first few minutes of the "link" that these individuals are trying to evoke a hostile response from police. It appears they got what they were looking for. You can defend yourself from a police officer hitting you, but be prepared for the consequences. In the vast majority of cases, people are treated according to how they treat law enforcement. If they are hostile, confrontational, or demanding and arrogant, they deserve to be treated with the same disrespect. Police are usually too busy to harass someone for no reason. Mistreatment at the hands of law enforcement does happen, but something done or said generally precedes it.

Self defense against a police officer or black belt?

Being calm is a way to keep things from escalating. If absolutely needed, fightingg a police officer is bad legally. If one attacks you, do your best to run to where there are witnesses, otherwise try to dodge or block or something, making sure not to strike them in any way, doing what you can to run. Try to never be alone with anyone, good or bad, you don't know.
For a black belt, I would suggest not fighting one of these. Unless you have taken defense classes in line with this. Many black-belts are cocky, thinking that since they have trained and have a certain colored belt they are invincible. This is not the case. They certainly are dangerous, but an important rule in a fight is to always assume your enemy is a better fighter than you. ********* causes careless mistakes. Just try to stay out of the way when things go bad.

On a side note, some of you who have replied to this question, it says in the community guidlines not to insult people. Some of you are being terribly immature. People ask questions to get an answer, if you don't have a serious answer or a way to help, grow up and don't post, ok?

How do you defend yourself against corrupt police?

Get what evidence you can. Be aware that the cop is likely to smash your phone so try to use something small and not too visible. Be as non-threatening as you can, keep saying you will comply unless the situation is rape. If the latter try to be silent and get a DNA sample, but don’t fight. You can’t win against a bullet. If you survive the attack, as soon as you can, keep asking for a lawyer. Do not talk; don’t explain; don’t justify. Just keep saying you are using your right to remain silent and want a lawyer. Then when you get out, hire someone and sue the bastards civilly. It is a mistake to try to prosecute because all that happens is that the law enforcement community closes ranks, even for a bad cop.I know there are thousands of law enforcement officers who stay calm and within their limits, but they are human and may have had a friend killed recently, or experienced other traumatic events. Speak softly and avoid hand gestures or arguments. The cop is not a judge or jury and may not care what the merits of the case are. Try to stay close to a lighted area. Do everything you can to be non-threatening because civil rights are nice, but don’t matter if you aren’t alive to claim them. But do everyone a favor and make ’em pay. They are a disgrace to the community and need to be removed from the force.

Can I shoot a police officer in self-defense? What if a police officer mistakenly believes that I am a threat, but I actually am not, and is now prepared to kill me?

Per the question title, Such a thing has actually happened a few times in the US.  It's such an incredibly rare set of circumstances that it is quite literally a case where the exception proves the rule.   Per the edit and question details,  not so much.  First off, you need to survive the encounter.  That's difficult enough from the get go, and if you don't the question is moot.  Second, you will almost certainly be charged, regardless of the circumstances of the case.  Even if a cop is murdering school children sandy hook style, and I kill him in the middle of it, I would expect to be charged with capital murder, and to face the full resources of the state to try and convict me and sentence me to death. That's the practical reality of the matter.Legally, a few states define in statute very limited situations where deadly force can be used to stop law enforcement.  Again, such situations are VERY slim, and generally only arise after the officer is question has clearly and obviously broken many laws.  You question details don't fit the mold there.  If an officer views you as a threat, for objectively legitimate reasons, you attempting to defend yourself with deadly force would do little more than convince him (and a jury) that his view was correct.  As such, Tim's answer is correct.  If you are for some reason being viewed as a threat by law enforcement, quit doing things that can be viewed that way. Now, in spite of this, bad things happen.  The man killed by the London metropolitan police is a perfect example of a police overreaction that resulted in what can only be called state sponsored manslaughter.  Had this taken place in the US, AND had, for example, the cops just opened fire with no surrender demand and missed a bunch, AND he had a firearm and used it to defend himself, AND had not been killed in the process, AND he had merely been standing around and doing absolutely nothing that could be considered threatening, then he MIGHT have been able to to mount a defense on the basis of self-defense.  He would want a very good lawyer. That's a lot of qualifiers, obviously, to the question and the situation. The most recent case that I'm aware of where this sort of thing happened for real was a wrong-house no-knock raid where the homeowner shot one of the police officers.  iirc, the police weren't in the house that was on the warrant, meaning that their entry was objectively illegal.  That homeowner was (somewhat to my amazement) actually not charged.

Can you shoot or kill a police officer in self defense?

What if a police officer unlawfully invades my house without probable cause or a search warrant? Am I allowed to defend myself since I am on my property & he is unlawfully breaking into my property for whatever reason? I watched a video where 3 officers broke down some persons door, came in and tazed the man before arresting him. They had no warrant or probable cause. They claim they were called in because of domestic violence (which they use as their probable cause) but both the man and woman who were the only people living their were talking to the police through a window and told them everything was fine. They then busted the door down, tazed the man and woman and arrested them! Did they have probable cause?! I just put myself in that situation and I would probably defend myself if that happened to me because they don't have the right to barge into anyones house like that without a warrant or probable cause. My question is, would I have the right to defend myself against officers breaking into my house without a warrant or probable cause? I do own guns so would I have the right to use them?

Are you legally allowed to defend yourself against police?

Say hypothetically a police officer was to abuse his authority and was using excessive force. Like they just started beating on you when it wasn't necessary to do so would you be allowed to fight back against them or are you just supposed to let them beat you up and them just file a complain later? Just something I was curious about
