u sound like u are looking to commit insurance fraud. reguardless if the guy was drunk or sober, u are looking at this as if its a cash cow. the insurance will only give u fair market value based on the blue book value. they will NOT give u a blank check for u to go out and get a escalade.

be advised, if it is found that u did commit insurance fraud, u will be bunking with a guy named bubba in the state pen, along with a felony on ur record. a lawyer might be able to get a better settlement, but u will also have to pay him.....from ur settlement money, and u will NOT be advised how to 'milk' the other ins. company. get over it.

Can I switch car insurance after a car accident in which I was at fault?

Car insurance policies can be switched any time without considering the fact that there was a claim in which you were at fault. Switching of the car insurance policy is allowed through portability which is available under car insurance plans. In an accident where you were at fault, the claim would be made in your existing insurance policy. If it is a third party claim made by another driver on your policy, the claim would be taken to the motor accidents tribunal. The tribunal would dictate the amount of claim payable. The decision of the tribunal takes time. In the meanwhile, if your policy is up for renewal, you can switch to another car insurance policy. However, you would still be liable for the claim incurred in the previous policy. if a lawsuit is filed by an individual hurt in the accident, it would be in your name even if your switch policies. Your old insurance policy would, however, pay for the damages suffered by the third party. If there have been own damages too, your old policy would pay for them too up to the Insured Declared Value applicable under the plan. Any additional costs and deductible would be paid by you for your car’s repairs. Moreover, since a claim is already going on in your existing policy, you would lose the accumulated no claim bonus discount in the premium. Should you settle with an insurance company after an accident?

A car accident? Were there any injuries? Document everything, if there were injuries, check out the book by Nolo Press--actually, check them all out, they are self-help legal guides written in plain english. I used their book for my own personal bodily injury accident about 10 years ago.

And if there weren't any injuries, as long as the adjuster is being reasonable, I would be reasonable in return. I did, however, double a settlement offered to me when I was a passenger in a vehicle hit by a tuned-out teenager who wasn't wearing his glasses. That adjuster for his insurance company was so bad I reported them to the regulating agency for insurance companies.

If you're  in an auto accident and you're at fault:If you have collision coverage insurance your carrier will pay for your repairs less your deductible. If you don't have collision coverage you will pay for your own repairs. The other driver and their carrier owes you nothing. If you have liability coverage insurance your carrier will fix the other car, or reimburse that drivers carrier if they paid first and will pay for injuries to the other driver, if any.   If you don't have liability coverage the other drivers collision coverage  carrier will pay for repairs and then can go after you.   If  the driver doesn't have collision coverage and you don't have liability coverage then that driver can/will come after you directly. It is common for drivers of older low value autos to have liability insurance but not collision coverage for the repair of their own vehicle.Note:  many states including California have financial responsibly laws making it illegal to drive without minimum liability insurance. What will happen to my insurance after ONE accident?

I didn't have Allstate. After my first auto accident my insurance went up, starting the next billing session. I had my first accident in December as well. My insurance didn't go up till the new cycle , which was in about June the following year. It will then stay at this new rate for about 3 years. During that 3 years if you have no accidents it should go back down after 3 years.

If you have to go to court just do and remember, not that you need to be told, keep your cool and don't start to argue with the judge or DA.

What happens if I got Car insurance after accident happened?

Okay so the other day I planned to go get insurance for my car because every my mom would ask me about it . And I had got hit by some one so I called progressive and got insurance. I know it's a bad thing but I felt like I had to and the lady who hit me told me she would wait to file any reports till after I get the insurance. But then when I reported the claim after all the details were given the progressive lady asked me if I got insurance after the accident and I lied and said no. Then she said how did you get insurance at 1031 and the police report was at 1007 so then I she knew I was lieing. I'm just worried becUse I tried to look up what will happen and websites are saying its insurance fraud. If anyone knows what will happen please let me know
