Allegations made to CPS are *very* highly protected because as a matter of public policy we want to encourage people to call CPS if they suspect abuse without being afraid that they'll be sued if they are wrong.

As a result it is *almost* impossible to successfully sue someone for making a false complaint.

However, deliberately making a false complaint to CPS is a criminal offense, so while the subject of the false allegation may not be able to sue, the State can certainly press criminal charges. The mother should file a formal police complaint. She should also ask the CPS caseworker to do the same - CPS are overworked and REALLY don't appreciate people abusing them for their own purposes.

The First Amendment guarantees that the government can not prevent you from saying what you want, but does not protect you from being sued if what you said causes harm to another. If no one overheard what you said, then there really is no damage to the other person’s reputation, so they would not be able to collect anything from you in a civil suit. There would be no criminal proceedings.

So if it is your honest opinion that this teacher is unqualified and there are no repercussions from that then you're fine. I would doubt that they would fire a teacher on one persons bad rating. Usually it's their annual evaluations that they go by and it's not easy being a teacher and it's not easy finding teachers. So I wouldn't worry about it too much.This is something that I think teachers deal with regularly from other staff and parents because there are so many expectations on so many levels that somebody's going to be dissatisfied. Now if you were to say that she was a child molester or he was a safecracker or a felon and they got fired because of that then you could be looking at a libel suit. You knew it wasn't true or you blatantly lied and that person was damaged because of your lie. But a benign, one time comment that is just your opinion it's really difficult to hold someone responsible for someone's teaching career just on that. I really don't think you have anything to worryabout.

You can be sued for pretty much anything, but I highly doubt that you'd lose if the person was indeed fat.
